A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM DETERMINING THE NECESSITY
FOR, AND DIRECTING THE ACQUISITION BY
EMINENT DOMAIN OF, REAL PROPERTY FOR PARK
AND RECREATION PURPOSES.

WHEREAS, public convenience and necessity require the
acquisition, improvement and maintenance of a public improvement
within the City of Anaheim, to wit: A public park, for park and
recreation purposes; and
WHEREAS, the City Council does find and determine that
public interest and necessity require the acquisition of all
that certain real property herein described by the City of
Anaheim for the improvement and maintenance of a public park
for park and recreation purposes;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that public interest and necessity require
the acquisition of that certain real property situated in the
City of Anaheim, County of Orange, State of California, more
particularly described as follows, to wit:
That portion of the Northwest quarter of Section
13, Township 4 South, Range 11 West, S. B. B. 4 M.,
described as follows:
Beginning at a point on the South line of the North
half of the Northwest quarter of said Section 13,
distant 1,162.58 feet North 89° 37' 30" East from
the Southwest corner of the North half of the North-
west quarter of said Section 13; thence along a
line bearing North 0 10' 15" West a distance of
330.00 feet, more or less, to the intersection with
the Southerly line of that parcel of land conveyed
to the Orange County Flood Control District by
final Order of Condemnation, recorded January 25,
1961 in Book 5605, Pages 236 through 238, inclusive,
said intersection also being in a curve concave
Southeasterly and having a radius of 1,400 feet,
and a central angle of 31° 50' 20 thence North-
easterly along the Southerly line of the parcel
of land conveyed to the said Flood Control District,
to the intersection with the West line of that
parcel of land conveyed to the Magnolia School
District of Orange County, recorded September 17,
1958 in Book i417, Page 535 of Official Records of
Orange County, California; thence Southerly along
the West line of the parcel of land conveyed to
the said Magnolia School District to the inter-
section with the South line of the North half of
the Northwest quarter of said Section 13; thence
Westerly along the South line of the North half
of the Northwest quarter to the point of beginning.
Containing 5 acres more or less.

BE IT FURTHER RESOLVED that the City Council does
hereby find and determine that public interest and necessity
require the acquisition of said land by the City of Anaheim for
the improvement and maintenance of the aforesaid project, and
that the taking of the property hereinabove described is neces-
sary therefor, and that the use to which it is to be applied
is a use authorized by law, and the taking of said property
is necessary to such use.
NOW, THEREFORE, IT IS HEREBY AUTHORIZED that said
property be acquired by the. City of Anaheim, and the City
Attorney of the City of Anaheim is hereby directed to institute
an action in eminent domain for the acquisition of the title
to said property, and to perform and carry out all of the
necessary proceedings and steps incident to the acquisition
of the title to said property and to obtaining possession
thereof.
THE FOREGOING RESOLUTION is approved and signed
by me this 25th day of April, 1961.

do hereby certify that the foregoing resolution was passed and
adopted at a regular meeting of the City Council held on the

AND I FURTHER CERTIFY that the Mayor of the City of
Anaheim approved and signed said resolution on the 25th day
of April, 1961.
