A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM FINDING AND DETERMINING
THAT TITLE 18 OF THE ANAHEIM MUNICIPAL
CODE RELATING TO ZONING SHOULD BE AMENDED
AND THAT THE BOUNDARIES OF CERTAIN ZONES
SHOULD BE CHANGED.
WHEREAS, the City Planning Commission of the City of
Anaheim did hold a public hearing in Reclassification Proceed-
ings No, F 60 to consider an amendment to
Title 18 of the Anaheim Municipal Code relating to zoning and
to consider a change in the boundaries of the zone or zones
hereinafter mentioned and described, and at said hearing did
receive evidence and reports from persons interested therein
and from its staff; and
WHEREAS, within a period of forty days following said
hearing thereon, the Planning Commission did duly adopt a resolu-
tion containing a report of its findings, a summary of the evi-
dence presented at said hearing and a recommendation that the
proposed amendment be adopted by the City Council and that cer-
tain zone or zones be changed as hereinafter set forth; and
WHEREAS, upon receipt of said resolution, summary of
evidence, report of findings and recommendation of the City Plan-
ning Commission, the City Council did fix the 25th day of
April 19 61 as the time, and the City Council Cham-
bers in the City Hall in the City of Anaheim as the place for a
public hearing upon said proposed amendment to Title 18 of the
Anaheim Municipal Code, and the exclusion of said property, here-
inafter described, from the zone in which it is now situated and
the incorporation thereof in the zone hereinafter set forth;
and did give notice thereof in the manner and form as provided
in said Title 18 of said Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said public
hearing, the City Council did hold and conduct such public hear-
ing and did give all persons interested therein an opportunity
to be heard and did receive evidence and reports and did there-
upon consider the summary of evidence presented at said public
hearing before the Planning Commission, its report of findings,
and recommendation; and
WHEREAS, the City Council does find and determine that
the amendment to Title 18 of the Anaheim Municipal Code should
be adopted and that the property hereinafter described should
be excluded from the zone or zones in which it is now situated,
and incorporated in the zone or zones as hereinafter set forth;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that Title 18 of the Anaheim Municipal Code
be, and the same is hereby amended, and that the following des-
cribed property, situated in the City of Anaheim, County of
Orange, State of California, to wit:

PARCEL 1: That portion of the Southeast quarter of
the Southwest quarter of Section 13, Township 4 South,
Range 11 West, in the Rancho Los Coyotes, as shown on
a Map recorded in Book 51, Page 11 of Miscellaneous
Maps, Records of Orange County, California.
Beginning at the Southwest corner of land described in
a deed to Ted F. Koblitz and wife, recorded November 3,
1947 in Book 1594, Page 203 of Official Records, said
Southwest corner being South 89 59' 15" West 657.10
feet from the Southeast corner of said Southwest
quarter; thence South 89 59' 15" West along the
Southerly line of said Section 13, a distance of
80.00 feet; thence North 0 09' 30" East parallel
with the Westerly line of said land of Ted F. Koblitz
to the Southerly line of Tract No. 2228, as shown on
a Map recorded in Book 69, Pages 34 to 37 inclusive of
Miscellaneous Maps, Records of Orange County, Cali-
fornia; thence North 89 59' 26" East 80.00 feet along
said Southerly line to the Westerly line of said land
of Ted F. Koblitz; thence South 0 09' 30" West to the
point of beginning.
PARCEL 2: That portion of the Southeast quarter of the
Southwest quarter of Section 13, Township 4 South,
Range 11 West, in the Rancho Los Coyotes, as shown on
a Map recorded in Book 51, Page 11 of Miscellaneous
Maps, Records of Orange County, California, described
as follows:
Beginning at a point in the Southerly line of said
Section 13, said point being 80 feet South 89 59' 15"
West from the Southwest corner of land described in
deed to Ted F. Koblitz and wife, recorded November 3,
1947 in Book 1594, Page 203 of Official Records, said
Southwest corner being South 89 59' 15" West 657.10
feet from the Southeast corner of said Southwest
quarter; thence continuing South 89 59' 15" West
along the Southerly line of said Section 13, a dis-
tance of 80 feet; thence North 0 09' 30" East
parallel with the Westerly line of land of said Ted
Koblitz to the Southerly line of Tract No. 2228, as
shown on a Map recorded in Book 69, Pages 34 to 37
inclusive of Miscellaneous Maps, Records of Orange
County, California; thence North 89 59' 26" East
along said Southerly line 80 feet to the Northwest
corner of land conveyed to Richard N. Foresman and
wife by deed recorded April 8, 1958 in Book 4249
Page 404 of Official Records; thence South 0 09' 30"
West along said Westerly line of land conveyed to
Foresman to the point of beginning.
be excluded from the R -A, RESIDENTIAL AGRICULTURAL ZONE, and
incorporated in the following zone or zones: R -3, NULTIPLE-
FAMILY RESIDENTIAL ZONE, upon the following conditions:

1. That plans for the development of subject property
shall be presented to and approved by the City
Council.
2. That the owners of subject property deed to the
City of Anaheim a strip of land 53 feet in width,
from the center line of the street, along Ball
Road for street widening purposes.
3. That the owners of subject property deed to the
City of Anaheim a strip of land 20 feet in width
along the rear or north property line for alley
purposes.
4. (a) That all engineering requirements of the City
of Anaheim along Ball Road and for the alley along
the north property line, mentioned in Condition
No. 3 hereof, such as curbs and gutters, sidewalks,
street grading and paving, drainage facilities, or
other appurtenant work be complied with as required
by the City Engineer and in accordance with standard
plans and specifications on file in the Office of
the City Engineer; and (b) that a bond in an amount
and form satisfactory to the City of Anaheim be
posted with the City to guarantee the installation
of said engineering requirements.
5. That the owners of subject property place of record,
in the Office of the County Recorder of Orange
County, a conditional deed of dedication to the
City of Anaheim for access rights on Ball Road,
the conditions being that dedication of access
rights will be complete when an alley provides
access to the rear of the property from either
Ball Road or Dale Avenue.
6. That the owners of subject roperty pay to the
City of Anaheim the sum of $2.00 per front foot
for street lighting purposes.
7. That the owners of subject property pay to the
City of Anaheim the sum of $25.00 per dwelling
unit, to be used for park and recreation purposes,
said amount to be paid at the time the building
permit is issued.
8. That Conditions Nos. 2, 3, 4(b), 5 and 6 above
mentioned be complied with within a period of
90 days from date hereof, or such further time
as the City Council may grant.
BE IT FURTHER RESOLVED that the City Attorney be, and
he is hereby authorized and directed to prepare and submit to the
City Council an ordinance amending Title 18 of the Anaheim Muni-
cipal Code to accomplish the objects herein found and determined
to be necessary and proper.
THE FOREGOING RESOLUTION is approved and signed by me
this 25th day of April, 1961.
