1961-6833RESOLUTION NO. 6833 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT AN AMENDMENT TO TITLE 18 OF THE ANAHEIM MUNICIPAL CODE SHOULD BE ADOPTED, CHANGING THE BOUNDARIES OF CERTAIN OF THE ZONES THEREBY ESTABLISHED SO AS TO EXCLUDE THE PROPERTY HEREINAFTER DESCRIBED FROM THE R -A ZONE AND TO INCORPORATE IT IN THE P -L ZONE AND THE M -1 ZONE AS HEREINAFTER SET FORTH. WHEREAS, the City Council of the City of Anaheim did heretofore, to wit, on the 21st day of February, 1961, adopt Resolution No. 6683 in Reclassification No. 60- 61 -79, initiating and proposing the adoption of an amendment to Title 18 of the Anaheim Municipal Code so as to exclude The property described as the westerly 10 acres of the southerly half of the westerly half of lot 17 in Block K of the Kraemer Tract, in the City of Anaheim, County of Orange, State of California, as per map recorded in Book 12, Pages 87 and 88, of Miscellaneous Records, in the Office of the County Recorder of Los Angeles County, California; which land is also included within the area shown on a map filed in Book 34, Page 37, of Record of Surveys, in the Office of the County Recorder of Orange County, California, and is hereinafter referred to as "said property," from the R -A, Residential Agricultural Zone and to incorporate a portion of said property 50 feet in width along La Palma Avenue in the P -L, Parking- Landscaping Zone, and to incorporate the balance of said property in the M -1, Light Manufacturing Zone, upon certain conditions set forth in said resolution; and WHEREAS, said proposed amendment and change of zones was referred to the City Planning Commission for a report of findings, summary of hearing and recommendation and said Planning Commission was directed to hold at least one public hearing in the City Hall in the City of Anaheim in the manner prescribed by law to consider said proposed amendment and zone change; and WHEREAS, as directed by said Resolution No. 6683, the City Planning Commission did upon April 3, 1961, hold a public hearing at the City Hall in the City of Anaheim to consider said proposed amendment and zone change, notice of which was given as required by law; and WHEREAS, on said date the City Planning Commission did adopt its Resolution No. 217, containing a report of its findings, a summary of the evidence presented at said hearing and a recommendation that the said proposed amendment be adopted by the City Council; and F- 60 -61 -79 WHEREAS, upon receipt of a copy of said Resolution No. 217 so adopted by the Planning Commission, the City Council did thereupon fix the 25th day of April, 1961, as the time and the City Council Chambers in the City Hall in the City of Anaheim as the place for a public hearing to consider said proposed amendment and the exclusion of the property hereinabove mentioned from the zone in which it is now situated and the incorporation thereof in the zones as proposed in Resolution No. 6683 adopted by the City Council on the 21st day of February, 1961, and as recommended by the City Planning Commission by its Resolution No. 217; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports, and did con- sider the summary of evidence presented to the City Planning Commission at its public hearing held on April 3, 1961, as set forth in Resolution No. 217, and did consider the report of findings and recommendation of the Planning Commission; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code initiated and proposed by Resolution No. 6683 adopted on February 21, 1961, should be adopted and that said property should be excluded from the zone in which it is now situated and incorporated in the zones as set forth in said resolution and as recommended by the Planning Commission, and as hereinafter more particularly set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be,and the same is, hereby amended and that The property described as the westerly 10 acres of the southerly half of the westerly half of Lot 17 in Block K of the Kraemer Tract, in the City of Anaheim, County of Orange, State of California, as per map recorded in Book 12, Pages 87 and 88 of Miscellaneous Records, in the Office of the County Recorder of Los Angeles County, California, which land is also included within the area shown on a map filed in Book 34, Page 37, of Record of Surveys, in the Office of the County Recorder of Orange County, California, be excluded from the R -A, Residential Agricultural Zone and that a portion of said property 50 feet in width along La Palma Avenue be incorporated in the P -L, Parking Landscaping Zone, and that the balance of said property be incorporated in the M -1, Light Manufacturing Zone upon the following conditions: 1. The owners of said property deed to the City of Anaheim, for street widening purposes, a strip of land 53 feet in width, extending northerly from and along the center line of La Palma Avenue. -2- ATTEST: 2. All engineering requirements of the City of Anaheim along La Palma Avenue, relating to curbs, gutters and rough grading, be complied with as required by the City Engineer and in accordance with standard plans and specifi- cations on file in the Office of the City Engineer, and that said engineering require- ments or improvements be installed at the time the property is developed. 3. The owners of said property shall concurrently with the installation of the improvements under paragraph 2 hereof either: (a) Pay to the City of Anaheim at the time said property is developed the sum of $2.00 per front foot on La Palma Avenue for street lighting purposes, or (b) Install street lights in accordance with plans and specifications approved by the Office of the City Engineer. 4. The owners of said property place of record M -1 deed restrictions approved by the City Attorney. 5. Conditions Nos. 1 and 4 hereof be satisfied within 90 days from date of the adoption of this resolution or within such further time as the City Council may grant. BE IT FURTHER RESOLVED, that the City Attorney be, and he is hereby, authorized and directed to prepare and sub- mit to the City Council an amendment to Title 18 of the Anaheim Municipal Code to amend said Anaheim Municipal Code to accom- plish the object herein found and determined to be necessary and proper.
