A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM GRANTING VARIANCE NO. 134
WHEREAS, the City Planning Commission of the City of
Anaheim did receive a petition for zoning variance from
EVE D. DIGGINS, owner of certain
real property situated in the City of Anaheim, County of Orange,
State of California, described as follows:
Lot 78 of Tract No. 2197 as shown on a map
recorded in Book 62, pages 46, 47 and 18
of Miscellaneous Maps, records of Orange
County, California.
AND WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim upon said
petition on 1_Tarch 20,, 1x61 notices of which said
public hearing were duly given as required by law and the pro-
visions of Title 18, Chapter 18.76 of the Anaheim Municipal
Code; and
WHEREAS, said City Planning Commission, after due
inspection, investigation and studies made by itself and in its
behalf, and after due consideration of all evidence and reports
offered at said hearing, did adopt Resolution No. 206 Series
19 60 -61 recommending that Variance No. 13114 be dented
and
WHEREAS, thereafter, within twenty (20) days from the
date of the adoption of said resolution, a written appeal was
filed with the City Council of the City of Anaheim protesting
the action of the City Planning Commission denying said
variance, and said appeal was set for public hearing on
April 25 19 61 at 7:00 o'clock P.M. at the
City Hall in the City of Anaheim, and notice of such public hear-
ing was duly given as required by law and the provisions of
Title 18, Chapter 18.76 of the Anaheim Municipal Code; and
WHEREAS, after due investigation and studies made by
itself and in its behalf, and after due consideration of all the
evidence and reports offered at said hearing, the City Council
does find and determine that:

1. There are exceptional or extraordinary circum-
stances or conditions applicable to the property
involved or to the intended use of the property
that do not apply generally to the property or
class of use in the same vicinity and zone.
2. That such a variance is necessary for the preserv-
ation and enjoyment of a substantial property right
possessed by other property in the same vicinity
and zone and denied to the property in question.
3. That the granting of such variance will not be
materially detrimental to the public welfare or
injurious to the property or improvements in such
vicinity and zone in which the property is located.
L. That the granting of such variance will not adversely
affect the comprehensive general zoning plan.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that a conditional zoning variance be, and
the same is hereby granted to EVE D. DIGGINS, 1307 Columbine
Place, Anaheim, California, premitting the use of one room of
the single family residence situated on the property hereinabove
described, for the operation of a beauty shop for a period of
six months from date hereof, subject to the following conditions:
1. That no beauty parlor equipment shall be installed
in the building with the exception of a one- person
110 volt A.C. dryer; that the dryer itself shall
be inspected to insure that it will cause no radio
or T. V. interference in the area.
2. That no signs or advertising factors, visible from
the street, and no newspaper, telephone or publications
of any sort, directing the public to this location,
shall be allowed.
3. That there shall be no employment of help, other
than the applicant herself.
4. That there shall be no sales of products or services
not produced on the premises.
5. That said use shall not generate pedestrian nor vehi-
cular traffic beyond that normal to the district in
which it is located.
6. That said use shall not involve the use of commercial
vehicles or delivery of materials to or from the
premises.
7. That there shall be no outdoor storage of materials
and/or supplies.
8. That in no way shall the appearance of the structure
be so altered or the conduct of the occupation within
the structure be such that the structure may be reason-
ably recognized as serving a non residential use
(either by color, materials, construction, lighting,
signs, sounds, noises or vibrations, etc.).
9. That such home occupation shall not create a noise,
odor, dust, vibration, fumes or smoke readily dis-
cernible at the exterior boundaries of the parcel
on which it is situated, nor create any electrical
disturbances adversely affecting the operation of
any equipment not on the same parcel.
The City Council hereby reserves the right to revoke
such variance permit for good cause or failure of said owner,
her heirs, successors or assigns, to comply with the Anaheim
Municipal Code and regulations and the conditions herein.
This variance is granted for a period of six months only from
date hereof.
THE FOREGOING RESOLUTION is approved and signed by
me this 25th day of April, 1961.

AND I FURTHER CERTIFY that the Mayor of the City of
Anaheim approved and signed said resolution on the 25th day of
April, 1961.
