1961-6788RESOLUTION NO. 6788 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED, WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No F- 60 -61 -68 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon, the Planning Commission did duly adopt a resolu- tion containing a report of its findings, a summary of the evi- dence presented at said hearing and a recommendation that the proposed amendment be adopted by the City Council and that cer- tain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Plan- ning Commission, the City Council did fix the 4th day of April 19 61 as the time, and the City Council Cham- bers in the City Hall in the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, here- inafter described, from the zone in which it is now situated and the incorporation thereof in the zone hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of said Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did there- upon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated, and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby amended, and that the following des- cribed property, situated in the City of Anaheim, County of Orange, State of California, to wit: -1- F- 60 -61 -68 Lot 8 and the South 58 feet of Lot 7 in Tract No. 230, in the City of Anaheim, as shown on a map thereof recorded in book 13, page 25, Miscellaneous Maps, records of said Orange County; be excluded from the R -3, MULTIPLE FAMILY RESIDENTIAL. ZONE, and incorporated in the following zone or zones: C -3, HEAVY COMMERCIAL ZONE, upon the following conditions: 1. That subject property be developed substantially in accordance with the plans presented to the City Council and on file with the City of Anaheim. 2. That the owner of subject property deed to the City of Anaheim a strip of land 45 feet in width, from the center line of the street, along Los Angeles Street for street widening purposes. 3. That the owner of subject property pay to the City of Anaheim the sum of $2.00 per front foot along Los Angeles Street and Vermont Avenue, for street lighting purposes. 4. That a 6 -foot masonry wall be constructed on subject property along the north property line to within 15 feet of the west property line, where said wall shall be reduced to 3z feet in height and shall continue along said north property line to the west property line; and that a 6 -foot masonry wall be constructed on subject property along the east property line to within 20 feet of the south property line. 5. That a bond in an amount and form satisfactory to the City of Anaheim be posted with the City to guarantee construction of said walls mentioned in Condition No. 4 hereof. 6. That the owner of subject property place of record standard City of Anaheim C -3 Deed Restrictions,approved by the City Attorney, -2- which restrictions shall limit the uses of the property to a service station or any C -1 uses. 7. That Conditions Nos. 2, 3, 5 and 6 above mentioned be complied with within a period of 90 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title i8 of the Anaheim Municipal Code to accomplish the objects herein found and de- termined to be necessary and proper.
