1961-6726RESOLUTION NO. 6726 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING CONDITIONAL USE PERMIT NO. 100 TO DR. C. ROSS DEAN TO EXPAND EXISTING ANIMAL HOSPITAL AND PROVIDE LIVING QUARTERS FOR ATTENDANTS ON THE PROPERTY HEREINAFTER DESCRIBED. WHEREAS, the City Planning Commission of the City of Anaheim did receive an application from C. Ross Dean, 1561 West Lincoln Avenue, Anaheim, California, for a Conditional Use Permit to expand the existing animal hospital situated on the property hereinafter described, and provide living quarters for attendants. Said property is described as follows: That portion of the Southeast quarter of the Southwest quarter of Section 9, in Township 4 South, Range 10 West, San Bernardino Base and Meridian, in the City of Anaheim, County of Orange, State of California, more particularly described as follows: Beginning at the Southwest corner of the said Southeast quarter of the Southwest quarter of Section 9, running thence North 0 431 06« West 157.60 feet along the West line of the said Southeast quarter of the Southwest quarter, said West line being the center line of Loara Street; thence North 89 16' 54" East 20.00 feet to the true point of beginning of the parcel herein described, said true point of beginning being a point in the East line of said Loara Street, running thence North 89 16+ 54" East 160.00 feet; thence South 0 43' 06" East 107.20 feet along a line parallel to the center line of said Loara Street to a point in the Northeasterly line of the Southern Pacific Railway right of way, 100.00 wide; thence North 57 12' 16" West 191.91 feet along the said Northeasterly right of way line to a point in the said Easterly line of Loara Street; thence North 0 43' 06" West 1.25 feet along the said East line of Loara Street to the true point of beginning. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said application on February 6, 1961, notices of which said public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, investigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. 171 Series 1960 -61, granting Conditional Use Permit No. 100, upon the conditions therein set forth; and WHEREAS, thereafter, within twenty (20) days from the date of the adoption of said resolution, a written appeal was filed with the City Council protesting the conditions imposed by the City Planning Commission in granting said Conditional Use Permit, and said appeal was set for public hearing on March 7, 1961, at the City Hall, in the City of Anaheim, and notices of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council finds, after careful consideration of the recommendations of the City Planning Commission and all evidence and reports offered at said hearing, that: 2. The proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 3. The size and shape of the site proposed for the use is adequate to allow the full devel- opment of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare. 4. The traffic generated by the proposed use will not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area. 5. The granting of the Conditional Use Permit under the conditions imposed will not be detrimental to the peace, health, safety, and general welfare of the citizens of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commission granting said Conditional Use Permit be, and the same is, hereby sustained; but that said Conditional Use Permit No. 100 be, and the same is, hereby granted to C. Ross Dean, 1561 West Lincoln Avenue, Anaheim, California, permitting the expansion of the animal hospital now located on the property hereinabove described, and permitting living quarters to be provided for the attendants, subject to the following conditions: 1. That subject property be developed substantially in accordance with the plans presented to the City Council and on file with the City of Anaheim. 2. That the sum of S2.00 per front foot, along Lincoln Avenue, be paid to the City of Anaheim to be used for street lighting purposes. 1. The proposed use is properly one for which a Conditional Use Permit is authorized by the Anaheim Municipal Code. -2- The City Council hereby reserves the right to revoke such Conditional Use Permit for good cause or failure of said owner, his heirs, successors or assians to comply with the Anaheim Municipal Code and regulations and the conditions herein.
