A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM DENYING WITHOUT PREJUDICE
APPLICATION NO. 60 -61 -56 FOR A CHANGE OF
ZONE IN A CERTAIN AREA OF THE CITY HERE-
INAFTER DESCRIBED.
WHEREAS, the City Planning Commission of the City of
Anaheim has heretofore duly passed and adopted a resolution
recommending a change in the boundaries of the zone or zones
hereinafter mentioned and described, after having fixed a time
and place for the holding of a public hearing thereon in the manner
and as prescribed in Title 18 of the Anaheim Municipal Code, and
after having duly held and conducted such public hearing to
consider said proposed change of zone or zones, and after having
received evidence and reports from persons interested therein;
and
WHEREAS, within a period of forty (40) days following
the hearing thereon, the Planning Commission did duly announce by
formal resolution its findings of facts and declare its opinions
and reasons for recommending said proposed change in the boundaries
of the zone or zones hereinafter mentioned and described; and
WHEREAS, upon receipt of the report and recommendation
of the City Planning Commission, the City Council did thereupon
fix the 7th day of March, 1961, as the time and the Council
Chambers in the City Hall of the City of Anaheim as the place
for a public hearing upon said proposed change of zone and did
give notice thereof in the manner and as provided in said
Title 18 of the Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said public
hearing, the City Council did duly hold and conduct such public
hearing and did give all persons interested therein an opportunity
to be heard and did receive evidence and reports, and did there-
upon consider the recommendations of the City Planning Commission;
and
WHEREAS, the City Council does find and determine that
the property and area proposed to be changed from the zone in which
it is now situated to a different zone, as hereinafter set forth,
is more suitable for the zone in which it is now incorporated and
that a change of zone should not be granted.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that all of the property and area situated in
the City of Anaheim, County of Orange, State of California,
described as follows, to wit:
The North 112.00 feet of the South half of the
Northeast quarter of the Northeast quarter of
the Southeast quarter of Section 18, Township 4
South, Range 10 West, in the Rancho Los Coyotes,
as shown on a Map recorded in Book 51, page 10
of Miscellaneous Maps, records of Orange County,
California.
Excepting therefrom the Westerly 263.60 feet;

remain in R -A, RESIDENTIAL- AGRICULTURAL ZONE, in which it is
now incorporated, and that the reclassification to C -2, GENERAL
COMMERCIAL ZONE, be denied without prejudice to permit the
submission of an application for a Conditional Use Permit.
BE IT FURTHER RESOLVED that should the applicant
file an application for a Conditional Use Permit to construct
a drive -in restaurant on the property hereinabove described,
the filing fee shall be waived.
THE FOREGOING RESOLUTION is approved and signed by
me this 7th day of March, 1961.
