A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM ACCEPTING A GRANT DEED
CONVEYING TO THE CITY OF ANAHEIM CERTAIN
REAL PROPERTY FOR AN EASEMENT FOR DRAINAGE
PURPOSES.
WHEREAS, the City Council of the City of Anaheim is
desirous of purchasing the hereinafter described real property for
municipal purposes, to wit: An easement for drainage purposes;
and
WHEREAS, the owners of said property have offered to
sell and convey the same to the City; and
WHEREAS, the City Council of the City of Anaheim finds
that it is for the benefit and best interest of the City of Anaheim
to accept said offer and purchase said real property.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the offer of JOHN J. CYPRIEN and
KATHERINE A. CYPRIEN, husband and wife, to sell to the City of
Anahetisi the following described real property situated in the
City of Anaheim, County of Orange, State of California to be
used for an easement for drainage purposes, and more particularly
described as follows:
An easement for drainage purposes located in the
south half of the north half of the southwest quarter
of the northeast quarter of Section 12, Township 4
South, Range 10 West, in the Rancho San Juan Cajon
de Santa Ana, City of Anaheim, County of Orange,
State of California, as said section is shown on a
map recorded in Book 51, Page 10 of Miscellaneous
Maps, in the Office of the County Recorder of said
County, described as:
A strip of land 14.00 feet in width, the southerly
boundary of which is described as follows: Beginning
at the southwest corner of said south half; thence
South 89° 34t 32" East 257.00 feet.
Except the westerly 20.00 feet thereof;
upon the following express conditions:
1. That said easement shall cease and automatically
terminate at such time as the property lying
south of that property described as Parcel 1
in a deed recorded June 2, 1959, in Book 4741,
494 of Official Records of Orange County, California,
in the office of the County Recorder thereof, and
south of the south line of said easement herein
described, shall be subdivided and /or developed
and the street shown as Milton Street on the
map of Tract No. 2767 is extended in a southerly
direction (said map of Tract No. 2767 is recorded
in Book 136, Pages 21, 22 and 23 of Miscellaneous
Maps, Records of Orange County, California).

2. That any drainage construction on the land
covered by said easement, shall be without
cost to Grantors, their heirs or assigns
and shall be of such type as the same can
be used as a driveway by Grantors, their
heirs and assigns in driving to and from
Grantors' adjoining property.
The Grantee shall maintain a locked gate
or chain across the east end of said easement
to prevent vehicle traffic upon said easement,
except as herein reserved to Grantors.
4. The Grantee shall keep the property covered
by said easement free and clear of debris.
That in the event that Grantee violates or
fails to comply with any of the conditions
numbered 2, 3 and 4 hereof, and shall fail to
remedy such violation or non compliance within
one month after receiving written notice so
to do, then, irrespective of any other provision
of this deed, said easement shall automatically
cease and terminate.
Any notice to the Grantee for violation or
compliance of any condition of said easement
shall be in writing, addressed to the City of
Anaheim and deposited with the City Clerk of
said City of Anaheim;
be, and the same is hereby, accepted by the City Council of the
City of Anaheim, and that the City of Anaheim accept a conveyance
of said property.
BE IT FURTHER RESOLVED that the City Auditor of the
City of Anaheim be, and he is hereby, authorized to pay to the
owners of said real property, out of General Funds of the City
of Anaheim, the sum of One Dollar ($1.00).
THE FOREGOING RESOLUTION is approved and signed by
me this 7th day of March 1961.
