A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AUTHORIZING THE PURCHASE AND ACQUI-
SITION OF CERTAIN REAL PROPERTY FOR MUNICIPAL
PURPOSES.
WHEREAS, the STATE OF CALIFORNIA, DEPARTMENT OF
PUBLIC WORKS, is the owner of the hereinafter described real
property situated in the City of Anaheim, County of Orange,
State of California; and
WHEREAS, said owner has offered to sell said property
to the City of Anaheim for the sum of $450.00 cash, lawful
money of the United States; and
WHEREAS, the City Council does find and determine
that public convenience and necessity require the purchase
and acquisition of said parcel of real property for municipal
purposes, and that the price which the owner thereof is willing
to accept is reasonable and not out of proportion to the fair
market value of said property;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the offer of the STATE OF CALIFORNIA,
DEPARTMENT OF PUBLIC WORKS, to sell to the City of Anaheim all
that certain real property situated in the City of Anaheim,
County of Orange, State of California, described as follows,
to wit:
That portion of the Southwest 1/4 of the Southwest
1/4 of Section 23, T. 4 S., R 10 W., S.B.B. M.,
described in the Certificate of Title No. 8276 on
file in the office of the Registrar of Titles of
said County, described as follows:
Beginning at a point in that certain course given,
in the description of Parcel 2 in a deed to the
State of California recorded August 26, 1940, in
Book 1058, page 188 of Official Records in the
office of the County Recorder of said County, as
"along said Easterly line, N. 0 15' 35" W.,
400.80 feet distant along said certain course
North 0 15' 35" West, 142.95 feet from the
Southerly terminus thereof; thence continuing
along said certain course, North 0 15' 35" West,
117.16 feet to a curve, concave Northeasterly and
having a radius of 780.00 feet; thence from a tan-
gent, bearing South 50 00' 40"' East, Southeasterly
along said curve, through an angle of 3 26' 12
an arc distance of 46.79 feet; thence South 09
07' 08" East, 29.00 feet; thence South 34 24' 39"
West, 72.18 feet to the point of beginning.

EXCEPTING and RESERVING unto the State of California
any and all rights of ingress to or egress from the
real property herein conveyed to or from the freeway
constructed upon lands lying Northerly of said real
property; provided, however, that said real property
shall abut upon and have access to a frontage road
which will be connected with said freeway only at
such points as may be established by public authority.
ALSO EXCEPTING therefrom all minerals, oils, gases
and other hydrocarbons by whatsoever name known, that
may be within or under the parcel of land herein
above described without, however, the right to drill,
dig or mine through the surface thereof,
for the sum of $450.00 cash, lawful money of the United States,
be and the same is hereby accepted, subject to the following
condition:
BE IT FURTHER RESOLVED that the City Manager of the
City of Anaheim be, and he is hereby, authorized for and on
behalf of the City of Anaheim to sign escrow instructions for
the purchase of said real property, and to enter into an
escrow with the owner of said property at California Bank,
Anaheim Office, Anaheim, California.
BE IT FURTHER RESOLVED that the City Auditor be,
and he is hereby, authorized to deposit in escrow at California
Bank, Anaheim Office, Anaheim, California, the sum of $450.00
cash, lawful money of the United States, to be paid to the
owner of said real property when a deed conveying said property
to the City of Anaheim, free and clear of all encumbrances,
except as hereinabove set forth, can be recorded and a policy
of title insurance issued by Orange County Title Company,
Main Street at Fifth, Santa Ana, California, showing said
property vested in the City of Anaheim free and clear of all
encumbrances, except as hereinabove specified.
BE IT FURTHER RESOLVED that the City of Anaheim shall
pay all costs in the purchase of said property, including the
charges for furnishing a policy of title insurance necessary
to show title vested in the City of Anaheim, and all escrow
costs and fees.
THE FOREGOING RESOLUTION is approved and signed by
me this 7th day of Marrh 1961.

1. That subject property shall be conveyed to
the City of Anaheim free and clear of all
encumbrances except all covenants, conditions,
restrictions, reservations, rights, rights of
way and easements of record approved by the
City Attorney.
