A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM AUTHORIZING THE PURCHASE
AND ACQUISITION OF CERTAIN REAL PROPERTY
FOR MUNICIPAL PURPOSES.
WHEREAS, SOUTHERN PACIFIC COMPANY, a corporation of
the State of Delaware, and NORTHWESTERN PACIFIC RAILROAD COM-
PANY, a corporation of the State of California, are the owners
of the hereinafter described real property situated in the City
of Anaheim, County of Orange, State of California; and
WHEREAS, said owners have offered to sell said
property to the City of Anaheim for the sum of $11,4.55.00 cash,
lawful money of the United States; and
WHEREAS, the City Council does find and determine that
public convenience and necessity require the purchase and acquisi-
tion of said real property for municipal purposes, and that the
price which the owners thereof are willing to accept is reasonable
and not out of proportion to the fair market value of said pro-
perty;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the offer of Southern Pacific Company,
a corporation of the State of Delaware, and Northwestern Pacific
Railroad Company, a corporation of the State of California, to
=yell to the City of Anaheim all that real property, situated in
the City of Anaheim, County of Orange, State of California, des-
cribed as follows, to wit:
Parcel C.
The westerly 45 feet of the easterly 535 feet of the
Northeast Quarter of the Northeast Quarter of the
Southwest Quarter of Section 23, Township 4 South,
Range 10 West, in the Rancho San Juan Cajon de Santa
Ana, as shown on a map recorded in book 51, page 10
of Miscellaneous Maps, records of Orange County,
California.
Parcel D.
The westerly 4.5 feet of the easterly 535 feet of the
Southeast Quarter of the Northeast Quarter of the
Southwest Quarter of Section 23, Township 4 South,
Range 10 West, in the Rancho San Juan Cajon de Santa
Ana, as shown on a map recorded in book 51, page 10
of Miscellaneous Maps, records of Orange County,
California.
EXCEPT that portion lying southerly of a line that
is parallel with and distant 295.00 feet northwesterly,
measured at right angles, from the center line of that
certain 50.00 foot wide right -of -way conveyed to the
Southern Pacific Railroad Company by deed recorded
in book 570, page 288 of Deeds, records of Los Angeles
County, California;
for the sum of $11,455.00 cash, lawful money of the United States,
be, and the same is hereby, accepted subject to the following
terms and conditions:

ATTEST:
1. That said property shall be conveyed to the
City of Anaheim free and clear of all encum-
brances except the second half of all general
and special taxes for the fiscal year 1960 -61,
including any special district levies, payment
of which is included therein and collected
therewith; and all covenants, conditions, re-
strictions, reservations, rights, rights of way
and easements of record approved by the City
Attorney.
2. That the Sellers shall pay that portion of the
second half of the taxes for the fiscal year
1960 -61 on subject property, from January 1, 1961
to date the deed conveying said property to
the City is recorded.
BE IT FURTHER RESOLVED that the City shall pay one
half of the escrow and title expenses and that the Sellers shall
pay for all revenue stamps to be affixed to the deed; and
BE IT FURTHER RESOLVED that the City Attorney and
the City Manager be, and either of them is hereby authorized
to enter into an escrow with Sellers for the purchase of the
real property hereinabove described and that the Finance Direc-
tor of the City of Anaheim, be, and she is hereby authorized
to deposit in escrow the amount of the purchase price of said
property as herein set forth together with any sum or sums
necessary to repay the City's share of the escrow and title
expenses.
THE FOREGOING RESOLUTION is approved and signed by
me this 7th day of March, 1961.
