1961-6686RESOLUTION NO. 6686 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING THE PROPOSED OPTION AGREEMENT SUBMITTED TO IT BY THE CITY OF GARDEN GROVE RELATIVE TO THE ACQUISITION OF THAT PORTION OF THE DYKE WATER COMPANY WITHIN THE ANAHEIM SYSTEM, AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT FOR AND ON BEHALF OF THE CITY OF ANAHEIM. IN ACCORDANCE THEREWITH. —1— Auditor Water Supt WHEREAS, the City of Garden Grove and The Dyke Water Company have executed a certain agreement entitled "THE CITY OF GARDEN GROVE, THE DYKE WATER COMPANY WATER WORKS ACQUISITION AGREEMENT 1960," pursuant to which Garden Grove expects to acquire the property and assets of the Dyke Water Company; and WHEREAS, some of the property and assets to be sold and transferred pursuant to said agreement are used for or are useful in rendering water service to customers of said Dyke Water Company within the City of Anaheim, and it is necessary for the City of Garden Grove to acquire such property and assets in order to acquire the water works used for or useful in rendering water service to the inhabitants of Garden Grove; and WHEREAS, an option and agreement has been drafted and presented to the City of Anaheim giving and granting to the City of Anaheim an option to purchase that portion of the Dyke Water System within the "Anaheim System" upon the terms, conditions, and limitations set forth in said proposed option and agreement this day submitted to the City Council; and WHEREAS, the City Council does find and determine that it is in the best interest of Anaheim that it acquire from Garden Grove said property and assets used for or useful in rendering water services to customers of said Dyke Water Company within the "Anaheim System" which shall mean that portion of the Dyke Water System as defined in Section II, Subsection 2.02 of the James Montgomery Report on Water System Development, Part 1, Inventory and Appraisal of the Dyke Water Company dated, September, 1959, and as shown on Plate I, Vicinity Map and Proposed Water System Boundaries prepared by James Montgomery and dated June, 1959. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the option and agreement this day submitted to the City Council by the City of Garden Grove dated the 24th day of February, 1964 and hereby referred to and incorporated by reference and made a part hereof is hereby approved and the Mayor and the City Clerk be, and they are hereby, authorized to execute said option and agreement for and on behalf of the City of Anaheim. AND BE IT FURTHER RESOLVED that upon the completion of the execution of said option and agreement between the City of Garden Grove and the City of Anaheim herein referred to and approved that an ordinance of the City of Anaheim consenting to the City of Garden Grove furnishing water services to inhabitants of the City of Anaheim within said "Anaheim System" of the Dyke Water Company be adopted. NOES: COUNCILMEN: None. ABSENT: COUNCILMEN: Coons. AND I FURTHER CERTIFY that the Mayor of the City of Anaheim approved and signed said resolution on the 24th day of February, 1961.
