A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM AUTHORIZING AND APPROVING
THE USE OF THE "DUVAL PIT" BY THE LA PALMA
LITTLE LEAGUE FOR BASEBALL GAMES, AND
AUTHORIZING THE EXECUTION OF AN AGREEMENT
THEREFOR.
WHEREAS, the City of Anaheim owns certain property
sometimes referred to as the "Duval Pit," situated at North
and Loara Streets, which the City has designated as a future
park site, and which is hereinafter referred to as the "Duval
Site and
WHEREAS, the La Palma Little League, a non profit
youth organization, desires the use of said Duval Site for
the purpose of conducting non- profit baseball games to be
open without charge to the public; and
WHEREAS, Cecil Harris, dba Anaheim Golf Center, is
willing to provide the necessary water for the development and
watering of the Duval Site, the cost of which shall be paid for
by the La Palma Little League on a metered basis; and
WHEREAS, the City Council of the City of Anaheim finds
and determines that the use of the Duval Site by the La Palma
Little League will not conflict with the use of said Duval Site
by the City or any other organization, and that said use will
be of public benefit;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that an agreement be made and entered into
by and between the City of Anaheim, the La Palma Little League,
a non profit youth organization, and Cecil Harris, dba Anaheim
Golf Center, as of April 1, 1960, for the use of said Duval
Site by the La Palma Little League, the terms and conditions of
which agreement shall be as follows:
1. The City of Anaheim shall:
(a) Provide the Duval Site for improvement by
the La Palma Little League.
(b) Plant the turf on the proposed area for the
baseball diamond with the seed provided by
the La Palma Little League. Said proposed
area for the baseball diamond shall be shown
on a map which shall be attached to and made
a part of the agreement.
(c) Mow the turf on a regular schedule.
(d) Grant the use of said Duval Site to the La
Palma Little League so long as said use does
not impair the Cityts future recreation pro-
gram at said site. In the event the City
finds it necessary to terminate said agreement,
the Park and Recreation Department shall
notify the La Palma Little League, in writing,
on or before August 31st following any prior
season of use of said site.
2. The La Palma Little League shall:
(a) Prepare the land provided by the City, as
shown on said map to be attached to said
agreement, for the planting of turf by
the City.
(b) Provide grass seed for the turf to be planted
by the City, and provide all material and
labor for the installation of a sprinkler
system and a water meter, all under the super-
vision of the City Park Development Coordinator.
(c) Pay Cecil Harris, dba Anaheim Golf Center, for
the water tapped from the water system of the
Anaheim Golf Center and consumed at said Duval
Site, at a flat fee of $15.00 per month.
(d) Tap the existing water line of the Anaheim
Golf Center and extend a water line to a
point to be shown on said map hereinbefore
mentioned, on City property, and install a
cut -off valve at said point; accomplish
ditching and water line installations for
the Duval Site sprinkling system; and accom-
plish the replacement of turf on the Anaheim
Golf Center's property to its original condi-
tion, all at La Palma Little League's expense.
(e) Install all necessary improvements for the
proper use of the Duval Site for baseball pur-
poses, including a.diamond and collateral ap-
purtenances, at La Palma Little League's
expense.
(f) Provide for the regular watering and keeping
of the grounds, including dust control for
the parking areas, at said La Palma Little
League's expense.
3. Cecil Harris, dba Anaheim Golf Center, shall:
(a) Permit the La Palma Little League to tap onto
the water line of the Anaheim Golf Center.
(b) Permit ditching and the making of necessary
installations on Anaheim Golf Center's property
for the laying of a water line to the Duval Site,
subject to a return of said property to its
original condition by said Little League.
(c) Accept reimbursement for the water used by the
La Palma Little League, based upon a flat
monthly charge of $15.00.
4. La Palma Little League shall carry insurance in the fol-
lowing amounts:

(a) Public liability insurance in the amounts
of $100,000.00 and $300,000.00.
(b) Property damage $5,000.00.
(c) Medical insurance in an amount to cover all
players and personnel;
and shall agree to indemnify and hold the City harmless from any
and all claims for damage to property or injury or death to
persons which may arise from the exercise of the rights granted
to said Little League.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
be, and they are hereby, authorized to execute said agreement
for and on behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by
me this 21st day of February, 1961.
