1961-6670A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ing; No. F- 60 -61 -51 to consider an amendment to Title 18 of the Anaheim Municipal Code relating.to zoning and to con- sider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon, the Planning Commission did duly adopt a resolu- tion containing a report of its findings, a summary of the evi- dence presented at said hearing and a recommendation that the proposed amendment be adopted by the City Council and that cer- tain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Plan- ning Commission, the City Council did flit :the!.., 14th day of February 1961 as the time, and the City Council Chambers in the City Hall in the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone in which it is now situated and the in- corporation thereof in the zones hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of said Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did thereupon con- sider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings, and recom- mendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated, and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby amended, and that the following described property: All that certain property situated in the City of Anaheim, County of Orange, State of California, described as follows: RESOLUTION NO 6670 -1- F- 60 -61 -51 PARCEL A: That portion of Lot 7 of Tract No. 151, Coffman Sub- division, as shown on a Map thereof recorded in Book 11, page 41 of Miscellaneous Maps, records of Orange County, California described as follows: Beginning at a point on the Easterly line of said lot, distant thereon, North 15° 38' 36" West 30.00 feet from the Southeasterly corner thereof; thence North 15° 38' 36" West, along said Easterly line, 109.33 feet to the Northeasterly corner of said lot; thence South 74° 21' 24" West along the Northerly line thereof, 29.97 feet; thence South 15° 48' 02" West 26.08 feet to a point in that certain curve concave Southwesterly having a radius of 8040 feet in the Northeasterly line of the 80 -foot strip of land described in deed from James M. Smith, and wife, to the State of California, recorded in Book 764, page 152 of Official Records, records of said Orange County (the center of said curve bears South 47 18' 37" West, from said last mentioned point); thence Southeasterly, along said curve, through an angle of 0° 41' 42 97.51 fee to the point of beginning. ALSO Lots 5 and 6 of Tract No. 151, as shown on a Map recorded in Book 11, page 41 of Miscellaneous Maps, records of Orange County, California. EXCEPTING from Lot 6 that portion thereof described as follows: Beginning at the Southwesterly corner of said Lot 6; thence North 88° 48: 17" East along the Southerly line of said lot, 17.47 feet to a point in that certain curve concave Southwesterly and having a radius of 8040 le( in the Northeasterly line of the 80 -foot strip of land described in the deed from James M. EXCEPTING from Lot 4 that portion described as follows: Beginning at the Northwest corner of said Lot 4; thence North 74 28' 00" East along the Northerly line of said Lot 4, a distance of 8.03 feet; thence South 50 15' 17" West 45.00 feet to a point in the Westerly line of said Lot 4, distant South 15 32' 00" West 1}11.28 feet from the Northwest corner of said Lot 4; thence North 15 32' 00" West )1.28 feet to the point of beginning; be excluded from the C -2, GENERAL COMMERCIAL ZONE, and incor- porated in the following zones: That Parcel A, hereinabove described, be changed to C -3, HEAVY- COMMERCIAL ZONE; and That Parcel B, hereinabove described, be changed to M -1, LIGHT -MANUFACTURING ZONE, upon the following conditions: 1. That the owner of subject property place of record City of Anaheim C -3 and M Deed Restrictions cover- ing the respective areas, approved by the City At- torney, which restrictions shall limit the uses of the C -3 portion of subject property, being Parcel A, to a service station or any C -2 uses, shall limit the uses of the M -1 portion of subject property, being Parcel B, to a wholesale warehouse or any C -2 uses, and shall provide that said restricted uses shall remain in effect for a period of 10 years from date hereof. 2. Laz)..That sidewalks and driveways be installed on Manchester Avenue as required by the City Engineer, and in accordance with standard plans and specifi- cations on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim be posted with the City to guarantee the installation of said sidewalks and driveways. 3. That structural protection be provided for exist- ing storm drains as required by the City Engineer. 4. That the owner of subject property deed to the City of Anaheim a strip of land 45 feet in width, from the center line of the street, along Manchester Avenue for street widening purposes. 5. That Conditions Nos. 1, 2(b) and 4, above mentioned, be complied with within a period of 90 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Ana- heim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
