RESOLUTION NO. 6650 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINALLY ACCEPTING THE COMPLETION AND THE FURNISHING OF ALL PLANT, LABOR, SERVICES, MATERIALS AND EQUIPMENT AND ALL UTILITIES AND TRANSPORTATION INCLUDING POWER, FUEL AND WATER, AND PERFORMING ALL WORK NECESSARY TO CONSTRUCT AND COMPLETE THE FOLLOWING PUBLIC IMPROVEMENT, TO WIT: ,LlyBROOK PARK SEWER IMPROVEMENT. IN THE CITY OF ANAF 1 JOB NO_ l2nl j WHEREAS, the City Council of th City of Anaheim did cause to be published in a newspaper of g neral circulation,. printed, published and circulated in the City of Anaheim, to wit: The Anaheim Bulletin on 0� tober L� and October 11 9 c 19 60 9 a no e nvit ng sealed proposels or urn s ng following: All plant, labor, services, materials and equipment, and all utilities and transportation, including power, fuel and water, and performing all work necessary to construct and complete in a good and workmanlike manner, in strict accordance with the specifications, plans and drawings therefor on file in the Office of the City Engineer or City Clerk of the City of Anaheim, the following public improvement, to wit: The "Linbrook Park" Sewer Improvement, in Aladdin Drive from approximately 1260 feet north of Lincoln Ave. to Lincoln Ave.; in Berniece Drive from approximately 1220 Feet north of Diane Way to Diane Way; in Carol Drive from approximately 1220 feet north of Diane Way to Diane Way; in Dahlia Drive from approximately 1220 feet north of Diane Way to Diane Way, and in Diane Way from approximately 775 feet east of Aladdin Drive to Aladdin Drive, consisting of the construction of sanitary sewers; construction of standard brick manholes; construction of 4-inch house laterals, and appurtenant work as more particularly set forth in the plans and specifications on file in the Office of the City Clerk or City Engineer, Job No. 1201; in accordance with the designs, plan: profiles and specifica- tions prepared by es .n e 1_ 'nee 9 and the notice inv'.ting sewed proposals, which said notice specified that sealed proposals as specified in said notice would be received up until 2 :00 o'clock P.M. of the 20th day of October 9 l 0 9 and which said notice did state an dec are that, pursuant to the provisions of Section 1770 of the Labor Code, the City Council of the City of Anaheim had ascertained the prevailing rat of wages for each type of labor needed to execute said contract and did set forth the prevailing hourly wage scale so ascertained; and 19_121 at the hour of 2 :00 o °clock .M. 9 the y erk an ity Engineer of WHEREAS, on October 20 the City of Anaheim did open s.id sealed proposal received up to that time for th,- furnishing of all plant, labor, servic materials and equipment, and all utilities and transport, :.tion,. including power, fu <1 and w ter, a d performing all work neces- sary to construct and complete, in a good and workmanlike manner, in strict accordance with the specifications, plans and drawings therefor on file in the Office of the City Clerk of the City of Anaheim, the public improv =went hereinabove more parti- cularly described and set forth, in public, in the City Council Chamber in the City Hall, Anaheim, California, and the City Engineer did t- ."bulate th result of said sealed proposals and did make a report to the City Council :.t its next adanvrnea regular meeting; and WHEREAS, the City C uncii of the City of Anaheim did, at its next ad 'ourned_ regular meeting, held On the 1 day of November st 713 60 at the hour c *f 0 o'clock 'oMo� cons L• r e sealeed propos 71_,s submitted or nishing the materi is and performing the work hereinabove more particularly described and set forth, and did thereupon find and determine that the seal4 d proposal submitted by DE LEON CONSTRUCTION CO. T Coffman Avenue Anaheim Cali ornia or the construction, installation and completion o •v- No. 1201, ere nab ve mentioned and thsc©rib -;d, was the lowest re: pon:yib1e proposal submitted there3:gr^, and thereupon accepted said bid and did award a contract to said DE LEON CONSTRUCTION CO for furnic hing 11 plant, labor, services, mater°ia7.s and equ p- ment and all utilities and transportation, including power, fuel and water, and performing all work necessary to construct and complete, in a good and workmanlike manner, in strict accordance with the specifications, plans, and drawings, the said public improvement as specified In said notice inviting sealed proposals, and did authorize the Mayor and the City Clerk of the City of Anaheim to ex cute a contract for and on behalf of the City of Anaheim with DE LEON CONSTRUCTION CO. which -aid contract was du-,y made an mere xate the 2nd day of November 19 60; and WHEREAS, the said DE LEON CONSTRUCTION CO has furnish:d a l plant, abor, sere ces, materia s and equipm_ nt and all utilities and transportation, and performed all work necessary for the construction and completion, in a good and workmanlike manner, in strict accordance with the specifications, plans, drawings, of said public improvement as specified in the notice inviting sealed proposals and in the detail, designs, plans, profiles, drawings and specification: pre- pared by Thornton E Piersall Cit Engineer and th contract Rasa and enterer into w it •y he City of Anaheim; and WHEREAS, t h e p NS R T 1 has duly certified to th construct' on an com etion of i p1 public im- provement hereinabove mentioned and described, in accordance with the plans and sp: cifio tion.s and the contract documents duly made and entered into with said nF LEnN Cori ialic ON cO_ 1 1 H j 11 and WHEREAS, the City Council finds that said contractor has completed said public improvement hereinabove more particularly described in accordance with the provisions of the contract and the contract documents, and that notice of completion should be filed and payment of the balance du said contractor'authorized in accord- ance with the contract documents. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that 11 pia «,t labor, services, materials and equipment and all utilities and transportation, and the per formano of all work neoe_;sary to construct, install and complete, in a good and workmanlike ma.n.ter, in strict accordance with the specifications, plans and drawings therefor on file in the Office of the City Clerk of th City of Anaheim, together with the appurtenance:, thereto, said public improvement hereinabove more particularly th ecrib 9d. and set forth, in the City of Anaheim, by said contractor, be and the same; are hereby ace =pted, subject, nevertheless, to _11 the terms, conditions and provisions of the contract documents, and that the balance due said contractor for said work be paid to thirty -five (35) days from and after final acceptance of sa work as evidenced by the adoption of this resolution, but not sooner th =n thirty (30) days after the date of the filing of notic '•-f oomp1etion, excepting only such sum or sums as may lawfully be withheld in accordanc with the provisions of said contract and contract docents Th t.coeptance by the con- tractor of .,aid payments made in accordanc with said final, estimate shall operate and shall be release to the City of Anaheim, its officers, agents and employees from all claims and liabilities due the contractor for anything done or furnished or withheld or for anything relating to the work or any at or neglect of the City, its officers, agents and employees, xcepting only ci ims against the City for any amounts withheld by the City at the time of such payment, AND BE IT FURTHER RESOLVED that, the Mayor and the City Clerk of the City of An :helm be, and thy are her by uthorized to execute and file a notice; of completion of said work as required by law THE FOREGOING RESOLUTION is approved and signed by me this 7th day of February 19 61 0 (SEAL) STATE OF CALIFORNIA COUNTY OF ORANGE ss CITY OF ANAHEIM 1 DENE M.
