1961-7060RESOLUTION NO. 7060 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ACCEPTING A SEALED PROPOSAL AND AWARDING A CONTRACT TO THE LOWEST RESPONSIBLE BIDDER FOR THE FURNISHING OF ALL PLANT, LABOR, SERVICES, MATERIALS AND EQUIPMENT AND ALL UTILITIES AND TRANSPORTATION, INCLUDING POWER, FUEL AND WATER, AND PERFORMING ALL WORK NECESSARY TO CONSTRUCT AND COMPLETE THE FOLLOWING PUBLIC IMPROVEMENT THE KN. WRENS, the City Council of the City of Anaheim did cause to b- in a newspaper of general circulation, printed, published nd circulated in the City of Anaheim, to wit: Th Anahei Bulletin on the 30th day cf June and the 7th day of Ju 1 1961 a notice nv t `ng seal e proposa s or urasis pug t e owing All plant, labor, services, materials and equipment, and all utilities and transportation, including power, fuel and water, and performing all work necessary to construct and complete in a good and workmanlike manner, in strict accordance with the specifications, plans and drawings therefor on file in the Office of the City Engineer or City Clerk of the City of Anaheim, the following public improvement, to wit: The Knott Avenue Street Improvement, from Ball Road to the South City Limits, in the City of Anaheim, consisting of excavation, removal and haulaway, construction of 3 -inch A.C. pavement over 6 inches of Aggregate Base, Portland Cement Concrete curb, gutter, and cross- gutters, and appurtenant work as more particularly set forth in the plans and specifications on file in the Office of the City Clerk or City Engineer, Project No. 96; in accordance with the design, plans, profiles and specifications of said public improvement on file in the office of the City Cl rte of the City of Anaheim; and WHEREAS, said notice inviting sealed proposals for said public improvement did provide that s a1ed proposals would be received by the City of Anaheim at the office of the City Clerk of the City of Anaheim up to the hour of 2.00 o'clock P.M. on the 13th day of July 19 61 for the fins ning of all plant, labor, services, materials, an uipent, all utilities and transportation, including power, fuel and water, and performing all work necessary to construct and complete in a good and workmanlike manner, the public improvement hereinabove more particularly mentioned and describ d, and which notice did state nd declare that pursuant to the provisions of Section 1770 of the Labor Code, the City Council of the City of Anaheim had ascertained the prevailing rate of wages in th locality in which this type of labor is to be performed for each craft or type of workman or mechanic needed to execute the contract and did sr. t forth the pr vailing hourly wage scale so ascertained; and WHEREAS the City Clerk of the City of Anaheim did receive the following sealed proposals prior to 2.on o'clock P.M. on the 13th day of 19 61 s in response to the notice afore- said inviting sealed proposals, to wit -1- U TOTAL PRICE NORWALK ASPHALTIC CONCRETE, INC. R. J. NOBLE COMPANY SULLY- MILLER CONTR. CO. GRIFFITH COMPANY BOECK PAVING COMPANY AND WHEREAS, the City Engineer did thereupon examine and tabu- late said sealed proposals and did report to the.City,Council the re- sult of his examination_ and tabulation.; and WHEREAS, the ._City Council finds that the sealed proposal .sub- mitted by NORWALK ASPHALTIC CONCRETE, INC., 12438 Bloomfield, Santa is the lowes.t responsible pro osal 9 p submitted f.or. .the __furnishing of 4.11 plant, labor .,....servic.es,.materials and equipment.,.. all utilities and transportati..on,.including power, fuel and water and performing all work.. necessary to construct and complete in a good and workmanlike manner, in strict accordance with the specifications, plans and drawings there- for on file in the office of the City Clerk of the City of Anaheim, the public improvement hereinabove mentioned and described, together with the appurtenances thereto, and as specified in the rot:i:c.e.inviting sealed proposals, and that said proposal of said above named bidder should be accepted and a contract awarded to said bidder in accordance therewith; and WHEREAS, the City Council finds that the above mentioned sealed proposal is the lowest responsible proposal received and that.,.the per- son, firm or ,corporation _submitting said proposal is a responsible person, firm or corporation and that the proposal submitted is the best suited and fitted for the public improvement to be constructed. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim, that the sealed proposal submitted by NORWALK ASPHALTIC CONCRETE. INC. for the furnishing of all plant, labor, s.ervices, materials and equip ment, all utilities and transportation, including power., fuel and water, and performing all work necessary to construct and complete, in a good and workmanlike manner, in strict accordance with the specifications, plans and drawings .therefor on file in the office of the City Clerk of the City of Anaheim and the notice inviting sealed proposals,, the pub, lic works and improvement hereinabove more particularly mentioned and described, together with the_appurtenan.ces thereto, be, and the same is- hereby, accepted, and that a contract for the construction. and com- pletion of said public .improvement be,._and the same i.s.hereby, awarded to the said above named bidder. AND. BE IT FURTHER. RESOLVED that the successful bidder or bidders upon each contract awarded as hereinab.ave set forth, shall be, and they are hereby required to execute.a contract in the required form with the City of _Anaheim upon. the ,terms and conditions specified in the notice inviting sealed proposals and the proposal submitted by said success- ful bidder or bidders and in accordance with the plans and specifica- tions for said public improvement hereinabove described, and in accord- -2- $19,07 20,794.52 21,925.48 22,837.05 24,700.45 ante with the terms, conditions and provisions of this resolution, and that said successful bidder or bidders to whom each contract is awarded shall be required to furnish a surety bond in an amount equal to one hundred per cent (100 of the contract price .for all labor, materials and equipment to be furnished and performed, as set forth in the sealed proposal submitted by said bidder for the construction of said public improvement, together with the appurtenances thereto or such portion thereof as is covered by said contract,. as ,s scurity for the faithful performance of said contract and a separate surety bon' in an amount equal to one hundred per cent (100%) of the con- struction cost of said public improvement covered by said contract, as Security for the payment of all persons performing labor.and fur nishing material for said project.' AND BE IT FURTHER RESOLVED that said successful bidder or bidders be, and they are hereby required to furnish to the City of Anaheim in companies satisfactory to the City of Anaheim,-..public lia- bility, property damage, compensation, and other insurance.. in the amounts and for the purposes as set forth and specified in the notice inviting sealed proposals, and subject to the approval of the City Attorney as to form and sufficiency. AND BE IT FURTHER RESOLVED that the Mayor and the.0 ity Clerk of the City of Anaheim be, and they are hereby authorized. and directed to make, execute and enter _int for and on behalf of the City_ of Anaheim,. a..writt.en.. contract with said successful bidder ..o.r. bidders for the furnishing of all plant, labor, materials, and equip- ment and performing all work, as hereinabove more particularly des- cribed, for the construction, installation and completion of said public improvement hereinabove described upon the terms. and conditions as specified in the notice inviting sealed proposals, the detailed.... design, plans, profiles, drawings and general specifications and de- tailed specifications and drawings, and all addenda thereto, and all modifications incorporated therein prior to the date of ths opening of bids, on file in the office of the City Clerk of the City of Ana- heim and in strict accordance with the terms, conditions and provisions of this resolution, and in accordance with all of :the. contract docu- ments herein specified.
