A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM ACCEPTING A GRANT FROM SOUTHERN
PACIFIC COMPANY OF THE RIGHT TO CONSTRUCT,
RECONSTRUCT, MAINTAIN AND USE A STREET OR
HIGHWAY, FOR ROADWAY AND PUBLIC UTILITY
PURPOSES, ACROSS PROPERTY OF THE GRANTOR, AUTHORIZING THE EXECUTION OF AN INDENTURE
COVERING THE CONSTRUCTION, USE AND MAINTENANCE
OF SAID STREET OR HIGHWAY.
WHEREAS, the Southern Pacific Company, a corporation
of the State of Delaware, has tendered to the City of Anaheim
an Indenture granting to the City of Anaheim the right to
construct, reconstruct, maintain and use a street or highway,
for roadway and public utility purposes, upon and across the
following described real property, subject to the reservations,
covenants and conditions therein contained:
In the City of Anaheim, County of Orange, State of
California, being a portion of the South half of the
Northeast quarter of the Southwest quarter of Section 23,
Township 4 South, Range 10 West, San Bernardino Base and
Meridian, in the Rancho San Juan Cajon de Santa Ana, as
shown on a map recorded in Book 51, page 10 of Miscel-
laneous Maps, Records of Orange County, California, more
particularly described as follows:
An easement for road and public utility purposes, over
and across the Easterly 45.00 feet (as measured to the
center line of Lewis Street) of the _following described
parcel of land:
Commencing at a oint in the center line of Lewis Street
(40.00 feet wide, said point being the Southeast corner
of that parcel of land described in deed dated March 7,
1899, to Southern Pacific Company, recorded March 11,
1899, in Book 40, page 214 of Deeds, in the office of the
Recorder of said County; thence Westerly along the South-
erly line of said land a distance of 145.00 feet; thence
Northwesterly 300.00 feet to a point distant 90.00 feet
Northerly, measured at right angles, from said Southerly
line; thence Northeasterly at right angles from last
described course, 245.00 feet to a point in a line con-
centric with and distant 13 feet Southerly, measured
radially, from the center line of Southern Pacific Com-
pany's main track (Tustin Branch), as now constructed;
thence Easterly along said concentric line 70.00 feet
to a point in a line parallel with and distant 260.00
feet Northeasterly, measured at right angles, from the
above described course having a length of 300 feet;
thence Southeasterly along said parallel line and the
easterly prolongation thereof, 300.00 feet to the
center line of said Lewis Street; thence Southerly along
the center line of said Lewis Street 235.00 feet to
the point of beginning.

AND .HEREAS, said grantor has tendered to the City said
above mentioned Indenture to be executed by the Southern Pacific
Company and the City of Anaheim, which Indenture the City Council
finds would be for the benefit and best interest of the City of
Anaheim and should be approved.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the street or highway Indenture above
mentioned tendered to the City by Southern Pacific Company, a
corporation of the State of Delaware, granting to the City, but
subject to the reservations, covenants and conditions therein
contained, the right to construct, reconstruct, maintain and use
a street or highway, for roadway and public utility purposes,
upon and across the real property hereinabove mentioned and
described be, and the same is hereby approved and accepted.
BE IT FURTHER RESOLVED that the Mayor and the City
Clerk be, and they are hereby, authorized to execute said In-
denture above mentioned for and on behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by
me this 5th day of July 1961.

was passed and adopted at a regular meeting of the City Council
