1961-7013RESOLUTION NO. 7013 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ACCEPTING A GRANT DEED CONVEYING TO THE CITY OF ANAHEIM CERTAIN REAL PROPERTY FOR AN EASEMENT FOR PUBLIC UTILITY PURPOSES. WHEREAS, the City Council of the City of Anaheim is desirous of purchasing the hereinafter described real property for municipal purposes, to wit: An easement for public utility purposes; and WHEREAS, the owner of said property has offered to sell and convey the same to the City; and WHEREAS, the City Council of the City of Anaheim finds that it is for the benefit and best interest of the City of Anaheim to accept said offer and purchase said real property. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the offer of SUNKIST HOMES, a Limited Partnership, to sell to the City of Anaheim the following described real property situated in the City of Anaheim, County of Orange, State of California, to be used for an easement for public utility purposes, and more particularly described as follows: An easement for public utility purposes over, under and across a twenty -eight (28) foot wide strip of land to install, construct, inspect, maintain, repair, replace, improve, relocate and remove a domestic water main, a drainage channel, and a sanitary sewer with incidental appurtenances and connections, together with reasonable rights of entry to said strip of land for the exercise of the rights herein granted. That portion of the Northeast quarter of Section 12, Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, as shown on a Map recorded in Book 51, Page 10 of Miscellaneous Maps, records of Orange County, California, which lies within a strip of land twenty -eight (28) feet wide, lying four- teen (11) feet, measured at right angles, on each side of the following described center line: Beginning at a point in the Northerly extension of the East line of Tract No. 2767, lying North 0° 10' 21" East, 6.04 feet from the Northeasterly corner of said Tract No. 2767, as shown on a Map recorded in Book 136, Pages 21, 22 and 23 of Miscellaneous Maps, records of said Orange County, and running thence South 85 30+ 56" East 211.1.49 feet, more or less, to a point in the West line of Tract No. 3390, lying South 0 08' 27" West 5.96 feet from the Northwesterly corner of Lot Sixty -one (61) of said Tract No. 3390, as shown on a Map recorded in Book 1111.1., Pages 3, 4, 5 and 6 of Miscellaneous Maps, records of said Orange County. The side lines of said described twenty -eight (28) foot wide strip of land shall be shortened or lengthened at the beginning thereof to terminate in the East line of said Tract No. 2767, or the Northerly extension thereof -1- and shall be lengthened or shortened at the end thereof to terminate in the West line of said Tract No. 3390. EXCEPTING THEREFROM all that portion of the above described twenty -eight (28) foot wide strip of land lying within the Northwest quarter of said Northeast quarter of said Section 12. BE IT FURTHER RESOLVED that the City Auditor of the City of Anaheim be, and he is hereby, authorized to pay to the owners of said real property, out of General Funds of the City of Anaheim, the sum of One Dollar ($1.00).
