1961-7001RESOLUTION NO 7001 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUND- ARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim has heretofore duly passed and adopted a resolution recommending denial of a change in the boundaries of the zone or zones hereinafter mentioned and described, after having fixed a time and place for the holding of a public hearing thereon in the manner and as prescribed in Title 18 of the Anaheim Municipal Code, and after having duly held and conducted such public hearing to consider said proposed change of zone or zones, and after having received evidence and reports from persons interested therein; and WHEREAS, within a period of forty (40) days following the hearing thereon, the Planning Commission did duly announce by formal resolution its.findings of facts and declare its opinions and reasons for recommending denial of said proposed change in the boundaries of the zone or zones hereinafter mentioned and described; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Plan- ning Commission, the City Council did fix the 9th day of May 1961, as the time, and the City Council Chambers in theITTHall in the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone in which it is now situated and the incorporation thereof in the zones hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of said Anaheim Municipal Code and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did there- upon consider the summary of evidence presented at said public hearing before the Planning Cotmission, its report of findings and recommendations; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated, and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby amended, and that all of the property and area situated in the City of Anaheim, County of Orange, State of California, described as follows -1- F-60-61-86 PARCEL A: (1) That portion of the south half of the northwest quarter of section 8, Township South, Range 10 West, in the Rancho Los Coyotes, city of Anaheim, county of Orange, state of California, as per map recorded in book 51 page 10 of Miscellaneous Maps, in the office of the county recorder of said county, described as follows: Beginning at the intersection of the northeasterly right of way line of the Southern Pacific Railroad as it existed October 1, 1933, with the north line of said south half; thence east along the north line of said south half 1490.55 feet to a point distant thereon 325.00 feet west from the northeast corner of said south half; thence south at right angles to said north line to the southeasterly line of the land described in deed to J. T. Zeller et ux., recorded July 2, 1937 in book 900 page 63, Official Records, which said southeasterly line bears South 62° 251 West from the northeast corner of said south half; thence South 62 25" West to the said northeasterly right of way line of the Southern Pacific Railroad; thence North 56 46' West 963.1i. feet to the point of beginning. EXCEPT therefrom that portion lying westerly and southwesterly of the following described line: Beginning at the intersection of the said north line of the south half with a line parallel with and 160 feet northeasterly measured at right angles from the northeasterly right of way line of the Southern Pacific Railroad Company as described in deed recorded in book 44 page 496 of Deeds, in the office of the county recorder of Los Angeles County, California; thence South 12 13 30" East 42.4.3 feet to a line parallel with and 130 feet northeasterly measured at right angles from said northeasterly right of way line; thence South 57 13' 30" East 232.36 feet along said last mentioned parallel line; thence South 32 46' 30" West 5 feet to the northeasterly line of the -land described in Parcel 1 in deed to the State of California, recorded September 26, 1951 in book 2234 page 116, Official Records of said Orange County; tence South 57 13' 30" East along said last mentioned parallel line to the said southeasterly line of the land described in deed to J. T. Zeller, et ux. (2) That portion of the south half of the northwest quarter of Section 8, Township South, Range 10 West, in the Rancho Los Coyotes, city of Anaheim, county of Orange, state of California, as per map recorded in book 51 page 10 of Miscellaneous Maps, in the office of the county recorder of said cn unty, described as follows: -2- Beginning at the northeast corner of said south half of the northwest quarter of section 8; thence West 325 feet along the north line of said south half; thence south at right angles to said north line to the southeasterly line of the land described in deed to J. T. Zeller et ux., recorded July 2, 1937 in book 900 page 63 of Official Records of said Orange County; thence North 62° �5! East along said southeasterly line to the point of beginning. PARCEL B: (1) The West 114. acres of the southwest quarter of the northeast quarter of section 8, Township L. South, Range 10 West, in the Rancho Los Coyotes, in the city of Anaheim, county of Orange, state of California, as said section is shown on a map recorded in book 51 page 10 of Miscellaneous Maps, in the office of the county recorder of said county. EXCEPT the southerly 737.19 feet thereof. (2) That portion of the southeast quarter of the northwest quarter of section 8, Township 4 South, Range 10 West, in the Rancho Los Coyotes, in the city of Anaheim, county of Orange, state of California, as said section is shown on a map recorded in book 51 page 10 of Miscellaneous Maps, in the office of the county recorder of said county, described as follows: Beginning at the point of intersection of the East line of said southeast quarter, with the northeasterly line of the right of way of the Southern Pacific Railroad Company; thence North to the northeast corner of said southeast quarter; icnce South 62 251 West 1139.90 feet to the northeasterly line..of said railroad right of way; thence southeasterly along said northeasterly line to the point of beginning. EXCEPT that portion thereof lying southwesterly of a line which is 125.00 feet northeasterly of and parallel with the northeasterly line of the right of way of the Southern Pacific Railroad Company. ALSO EXCEPT that portion thereof lying southerly of the northerly boundary of the following described parcel: Beginning at a point on the East line of said southeast quarter of the northwest quarter, distant North 0 45 30" West 665.24 feet from the southeast corner thereof; thence South 89 571 10" West 1:91.18 feet; thence South 64 501 47" West 60.95 feet to the northeasterly line of tat certain strip of land 55.00 feet wide, as described in deed to the State of California, recorded in book 1922 page 256 of Official Records; 3) thence North 57 041 43" West 250.20 feet along said northeasterly line;.. thence North 32° 55 17" East 104.30 feet; thence South 57° 041 43" East 26.12 feet to the beginning of a curve, concave northerly, having a radius of 693.00 feet; thence easterly 398.76 feet along said curve through a central angle of 32 58t 07 thence North 89 571 10" East 299.65 feet to the East line of said southeasterly quarter of the north- westerly quarter; thence South 0 451 30" East 72.00 feet to the point of beginning. The southeast quarter of the northeast quarter of section 8, Township 4 South, Range 10 West, in the Rancho Los Coyotes, in the city of Anaheim, county of Orange, state of California, as said northeast quarter is shown on a map filed in book 13 page 27 of Record of Surveys, in the office of the county recorder of said county. EXCEPT the east 25 acres thereof. ALSO EXCEPT the west 14 acres thereof. ALSO EXCEPT the southerly 747.19 feet thereof. PARCEL C: The west 12.5 acres of the east 25 acres of the southwest quarter of the northeast quarter of Section 8, Township 4 South, Range 10 West, in the Rancho Los Coyotes, city of Anaheim, county of Orange, state of California, as said northeast quarter is shown on a map filed in book 13 page 27 of Record of Surveys, in the off ice of the county re- corder of said county. EXCEPT the south 737.19 feet thereof. be excluded from the R -A, RESIDENTIAL AGRICULTURAL ZONE, and incorporated in the R -3, MULTIPLE- FAMILY RESIDENTIAL ZONE, upon the following conditions: 1. That the final map of Tract No. 4107 be recorded in the Office of the County Recorder of Orange County. 2. That the owners of subject property pay to the City of Anaheim the sum of $25 per dwelling unit to be used for park and recreation purposes, said amount to be paid at the time the building permit is issued. (a) That a block wall 6 feet in height, measured from the ground level of the tract to the north, be constructed along the entire northerly boundary of subject property, said wall to be constructed before any grading is commenced, Such grading, however, does not refer to operations necessary for bringing in utilities and the grading for said wall itself; and (b) that a bond in an amount and form satisfactory to the City of Anaheim be posted -4- with the City to guarantee the construction of said wall. L. That plans for the development of subject property shall be subject to review by the City Council, or if subject property is developed as a single unit, standard City of Anaheim R -3 Deed Restrictions, approved by the City Attorney, shall be placed of record in the Office of the County Recorder of Orange County, California, by the owners of sub ject property. 5. That Conditions Nos'. ,1 and 3(b) above mentioned shall be complied rig within a period of 180 days from date hereof, or ch further time as the City Council may graritt. BE IT FURTHER RESOLVE6 THAT the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
