RES-2025-039RESOLUTION NO. 2025 - 039 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING A LETTER OF UNDERSTANDING BETWEEN THE ANAHEIM POLICE ASSOCIATION AND THE CITY OF ANAHEIM ADDRESSING HOLIDAY PAY WHEREAS, the Memorandum of Understanding ("MOU") between the City of Anaheim ("City") and the Anaheim Police Association ("APA"), adopted by Resolution No. 2020-023, and extended by Resolution No. 2024-101, sets forth the compensation, benefits, and other terms and conditions of employment for employees represented by the Anaheim Police Association; and WHEREAS, the California Public Employees' Retirement System ("Ca1PERS") have advised that the provisions of Article 35 — Holidays, requires revision to comply with Government Code Sections 20636 and 7522.34 and California Code of Regulations Sections 571 and 571.1, et seq., as applicable; and WHEREAS, the City's Holiday Pay, provides compensation for employees who are normally required to work on an approved holiday because they work in positions that require scheduled staffing without regard to holidays; and WHEREAS, the City and APA have met and conferred in good faith on the terms of the Letter of Understanding ("LOU") to correct the issue; and WHEREAS, as a result thereof, the PARTIES have signed a LOU dated May 7, 2025, setting forth proposed amendments to Article 35, Holidays; and WHEREAS, the City Council of the City of Anaheim finds that it is in the best interest of the City of Anaheim to approve said Letter of Understanding. NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Anaheim that the Letter of Understanding dated May 7, 2025, between APA and the City, a copy of which is attached hereto and incorporated by reference herein, is hereby approved. THE FOREGOING RESOLUTION is approved and adopted by the City Council of the City of Anaheim this 131h day of May 2025, by the following roll call vote: AYES: Mayor Aitken and Council Members Meeks, Balius, Leon, Rubalcava, Kurtz and Maahs NOES: None ABSENT: None ABSTAIN: None CITY OF ANAHEIM By: MAYOR OF Tl ITY OF ANAHEIM 0 CITY IrLERK OF THE CITY OF AN, AHEIM LETTER OF UNDERSTANDING between the ANAHEIM POLICE ASSOCIATION and the CITY OF ANAHEIM The Anaheim Police Association ("APA") and the City of Anaheim ("ANAHEIM" or "City"), herein referred to as the "PARTIES," have met and conferred and reached an agreement to amend Article 35, Holidays, of the June 28, 2019 extended through June 30, 2026 Memorandum of Understanding ("MOU") between the APA and the City of Anaheim. The PARTIES agree to the following terms and conditions: WHEREAS amendments to Article 35, HOLIDAYS, are necessary to comply with the applicable provisions of the California Public Employees' Retirement System ("Ca1PERS") and Government Code Sections 20636 and 7522.34; and WHERAS, the City's Holiday Pay, provides compensation for employees who are normally required to work on an approved holiday because they work in positions that require scheduled staffing without regard to holidays; and WHEREAS, the PARTIES agree to memorialize their agreement to ensure that holiday compensation provisions are applied in compliance with Ca1PERS rules and regulations and will continue to extend to those employees covered by the MOU of June 28, 2019 through June 30, 2026, which is historically consistent with prior payments. NOW, THEREFORE, the PARTIES agree to the following addition and amendments, as set forth in the Articles below: 35.2 When a Federal or State -recognized holiday, as outlined in Article 35.1, falls on the employee's regularly assigned work day, employees assigned as i) helicopter pilots, ii) traffic/motors, iii) patrol, iv) canine, v) Disney, and the vi) jail, shall have the option to either (1) receive additional compensation in accordance with 35.2.1, and shall include a reduction of eight (8) hours to their Paid Leave account balance in the payroll period in which the holiday falls, or (2) receive no additional compensation and no reduction to their Paid Leave account balance in the payroll period in which the holiday falls. 35.2.1 Additional compensation shall be calculated based on the employee's regular rate of pay for purposes of holiday pay. This includes the hourly base pay plus the hourly equivalent of specialty assignments provided in Articles 16 - Salary Relationships and 17 - Educational Incentive for the term of the MOU or any extension thereof. Example: if an employee earns a base hourly rate of $20.00 and is eligible for a 2.5% canine assignment pay, the hourly equivalent the employee is entitled to is an additional. 50 cents per hour in specialty pay, for a total hourly rate of $20.50. Page 1 of 2 35.3 Employees in assignments other than those specified in 35.2, when a holiday falls on the employee's regularly assigned workday, the employee shall have the option of observing the City recognized Federal or State holidays listed in Section 35.1 by drawing against their Paid Leave account or working the holiday. There shall be no additional compensations when an employee elects to work a holiday. 35.5 To the extent legally permitted, as determined by Ca1PERS, additional compensation for the purposes of holiday pay paid to employees under Sections 35.2 and 35.2.1, shall be reported to Ca1PERS as compensation earnable pursuant to Title 2, CCR. Section 571(a)(5) for Classic members, and pensionable compensation pursuant to Section 571.1(b)(4) for PEPRA members subject to the provisions and limitations under the Public Employees' Retirement Law. The remainder of the MOU not specifically amended by this LOU between the APA and ANAHEIM shall not be affected hereby and shall remain in full force and effect.
