1961-6874RESOLUTION NO. 6874 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No. F- 60 -61 -85 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon, the Planning Commission did duly adopt a resolu- tion containing a report of its findings, a summary of the evi- dence presented at said hearing and a recommendation that the proposed amendment be adopted by the City Council and that cer- tain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Plan- ning Commission, the City Council did fix the 9th day of May 19 61 as the time, and the City Council Cham- bers in the City Hall in the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, here- inafter described, from the zone in which it is now situated and the incorporation thereof in the zone hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of said Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did there- upon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated, and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby amended, and that the following des- cribed property, situated in the City of Anaheim, County of Orange, State of California, to wit: -1- F- 60 -61 -85 PARCEL 1. The following described portion of Tract No. 613, as shown on a map thereof recorded in book 19, page 19, Miscellaneous Maps, records of said Orange County: Beginning at a point in the Easterly line of said Tract No. 613, said point being 891.38 feet South 7° 15 East from the Northeast corner of said Tract 613 (said corner being in the center line of Placentia -Yorba Boulevard); running thence South 7° 15 East 355.62 feet to the Southeast corner of said Tract 613; thence South 73 12' West 684.56 feet along the Southerly line of said Tract 613 to the Southern terminus of a line described as follows: Beginning at a point located 685.30 feet North 87° 19' West and 278.34 feet South 7° 15 East from the Northeast corner of said Tract 613, running thence South 7° 15 East parallel to the Easterly line of said Tract 613, to a point in the Southerly line thereof; thence North 7° 15' West 587.40 feet along said described line; thence South 87° 19' East 685.30 feet to point of beginning; EXCEPTING THEREFROM the Southerly 210 feet, measured along the Easterly line of the tract, of the Easterly 203 feet, measured along the Southerly line of the tract, of Tract No. 613, in the County of Orange, State of California, as shown on a map thereof re- corded in book 19, page 19 of Miscellaneous Maps, records of said Orange County. ALSO EXCEPTING THEREFROM the Southerly 20 feet as granted to the County of Orange for road purposes, by deed recorded February 24, 1926, in book 626, page 387, Deeds, records of said Orange County. PARCEL 2. The Southerly 210 feet, measured along the Easterly line of the tract, of the Easterly 203 feet, measured along the Southerly line of the tract, of Tract No. 613, in the County of Orange, State of California, as shown on a map thereof recorded in book 19, page 19 of Miscellaneous Maps, records of said Orange County. PARCEL). The portion of the following described portion of Tract No. 613, as shown on a map thereof recorded in Book 19, Page 19, Miscellaneous Maps, records of said Orange County, lying southerly of a line de- scribed as follows: Beginning at a point in the Easterly line of said parcel of land which is distant thereon North 7° 15 West 475 feet from the Southeasterly corner of said land, and running thence Westerly at right angles to said Easterly line, to the Westerly line of said parcel of land. -2- Said portion of Tract No. 613 is described as follows: Beginning at a point in the South line of said Tract 613, said point being 827.04 feet North 73° 12' East from the Southwest corner of said Tract 613; running thence North 7° 15' West 12.08.11 feet to a point in a line described as follows: Beginning at a point located 685.30 feet North 87° 19' West and 278.34 feet South 7° 15' East from the North- east corner of said Tract 613, Running thence South 75° 20' West to a point in the Westerly line of said Tract 613, said point being 570.00 feet South 18° 11' West from the most Northwest corner of said Tract 613; thence North 75° 20' East 202.19 feet along the said described line to its Eastern terminus; thence South 7° 15' East 1200.44 feet along a line described as follows: Beginning at a point located 685.30 feet North 87° 19' West and 278.34 feet South 7° 15 East from the Northeast corner of said Tract 613, running thence South 7° 15' East parallel to the Easterly line of said Tract 613, to a point in the Southerly line thereof; thence South 73° 12' West 203.72 feet to the point of beginning; EXCEPTING THEREFROM the Southerly 20 feet as granted to the County of Orange for road purposes, by deed re- corded February 24, 1926, in book 626, page 387, Deeds, records of said Orange County. PARCEL 4. The portion of the following described portion of Tract No. 613, as shown on a map thereof recorded in Book 19, Page 19, Miscellaneous Maps, records of said Orange County, lying southerly of a line described as follows: Beginning at a point in the Easterly line of the land distributed to Lucy Kraemer Brunet, now known as Lucy Kraemer Coniglio, in the Decree of Distribution above referred to, which point is distant thereon North 7° 15' West 475 feet from the Southeasterly corner of said land and running thence Westerly at right angles to said Easterly line, to the Westerly line of said land distributed to touite:Kraemer Heffner referred to above; Said portion of Tract No. 613 is described as follows: Beginning at a point in the South line of said Tract 613, said point being 624.54 feet North 73° 12' East from the Southwest corner of said Tract 613; running thence North 7° 15' West 1215.70 feet to a point in a line described as follows: Beginning at a point located 685.30 feet North 87° 19' West and 278.34 feet South 7 15' East from the Northeast corner of said Tract 613, running thence South 75 20 West to a point in the Westerly line of said Tract 613, said point being 570.00 feet South 18° 11 West from the most Northwest corner of said Tract 613; thence North 75° 20 East 201.38 feet, along the said described line; thence South 7° 15' East 1208.11 feet to a point in the South line of said Tract 613; thence South 73° 12 West 202.50 feet to the point of beginning; EXCEPTING THEREFROM the Southerly 20 feet, as granted to the County of Orange, for road purposes, by deed recorded February 24, 1926, in book 626, page 387, Deeds, records of said Orange County; be excluded from the R -A, RESIDENTIAL AGRICULTURAL ZONE, and incorporated in the following zones, upon the conditions hereinafter set forth': That Parcels Nos. 1, 3 and 4, above described, be changed to C -1, NEIGHBORHOOD COMMERCIAL ZONE; and That Parcel No. 2, above described, be changed to C -3, HEAVY- OOMMERCIAL ZONE, upon the following conditions: 1. That subject property be developed substantially in accordance with the plans presented to the City Council and on file with the City of Anaheim, it being understood that approval of the development of this property in accordance with the plans pre- sented, includes only the colored portion of the map presented to the City Council and does not in any way indicate approval or disapproval of any other adjacent area considered for development. 2. That the owners of subject property deed to the City of Anaheim a strip of land 53 feet in width, from the center line of the street, along Orangethorpe Avenue, and a strip of land 53 feet in width, from the center line of the street, along Dowling Avenue for street widening purposes. 3. (a) That all engineering requirements of the City of Anaheim along Orangethorpe and Dowling Avenues, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work be complied with as required by the City En- gineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim be posted with the City of Anaheim to guarantee the installation of said engineering requirements at the time the property is developed, but, in any event, within two years from date hereof, or such further time as the City Council may grant. 4. That the owners of subject property pay to the City of Anaheim the sum of $2.00 per front foot along both Orangethorpe and Dowling Avenues, for street lighting purposes, said sum to be paid at the time the building permit is issued. -4- That the owners of subject property deed to the City of Anaheim easements for public utility purposes along the exterior boundaries of said property as determined and required by the Utilities Director of the City of Anaheim. 6. That landscaping shall be provided as follows: (a) That a strip of land 6 feet in width abutting the easterly and southerly planned highway right of way lines of subject property, excepting therefrom Parcel No. 2, shall be landscaped and said landscaping maintained. (b) That 5 ft. x 5 ft. tree wells shall be pro vided at 40 -foot intervals adjacent to the planned highway right of way lines; and that street trees shall be installed therein. (c) That all portions of the parkway not filled in with concrete shall be properly landscaped and said landscaping maintained. That plans for said landscaping and water supply, including the spacing of the street trees and shrubs, shall be- subject to approval of the Superintendent of Parkway Maintenance of the City of Anaheim. That Conditions Nos. 2, 3(b) and 5, above mentioned, shall be complied with within a period of 90 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he Is hereby authorized and directed to prepare and submit to the City Council en ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and de- termined to be necessary and proper.
