A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM ACCEPTING A SEALED PROPOSAL
AND AWARDING A CONTRACT TO THE LOWEST RES-
PONSIBLE BIDDER FOR THE FURNISHING OF ALL
PLANT, LABOR, SERVICES, MATERIALS AND EQUIP-
MENT AND ALL UTILITIES AND TRANSPORTATION,
INCLUDING POWER, FUEL AND WATER, AND PER-
FORMING ALL WORK NECESSARY TO CONSTRUOT AND
COMPLETE THE FOLLOWING PUBLIC IMPROVEMENT:

WHEREAS, the Oity Oouncil of the City of Anaheim did
oauee to be published in a newspaper of general circulation,
printed, published and circulated in the City of Anaheim, to
wit: The Anaheim Bulletin, on the 19th day." and 25th da7 of July.
19 56 ,a notioe inviting sealed proposals for furnishing
tht following:
All plant, labor. services. materials and equipment,
and all utilities and transportation. including power.
fuel and water. and performing all work necessary to
construct and complete. in a good and workmanlike
manner. in strict accordance with the speCifications,
plans and drawings therefor on file in the Office of
the City Clerk of the City of Anaheim, the following
public improvement, to wit: Construction of the
Haster Street sewer laterals, from Ka tella Avenue
to Midway Drivel consisting of a l2-inoh V.C.P.
lateral and an ~-inch V.C.p. lateral. construction
of standard manholes, resurfacing and remodeling.
and aP2urtenant work, as indicated on the plans, Job
Noo 1070,
in aocordance with the designs, plans, profiles and specifications
of said public improvement on file in the Office of the City Clerk
of the City of Anaheim; and
WHEREAS, said notice inviting sealed proposals for said
pUblic improvement did provide that sealed proposals would be reoeived
by the City Council of the City of Anaheim at the Office of the Oity
Olerk of the City of Anaheim up to the hour of 7:00 o'clock P.M. on
the 31st day of Julv , 195J..for the furnishing of all
plant, labor, services, materials and equipment, all utilities and
transportation, including power, fuel and water, and performing all
work necessary to construct and complete, in a good and workmanlike
manner, the pUblic improvement hereinabove more particularly mentioned
and described and Which notice did state and declare that pursuant
to the provisions of Seotion 1770 of the Labor Code, the City Counoil
of the City of Anaheim had ascertained the prevailing rate of wages
in the locality in which this type of labor is to be performed for
each craft or type of workman or mechanic needed to execute the oon-
traot and did set forth the prevailing hourly wage scale so ascertained;
and
,~ WHEREAS, the City Council of the City of Anaheim did receive
the following eealed proposals prior to 7:00 o'clock P. M. on the

WHEREAS, the Oity Oouncil did thereupon refer said bids to
tht City En21neer _for examination, tabulation
and report to the City Counoil, and said City Eniineer
did examine and tabulate said sealed proposals and did report to the
Co~noll the result of his examination and tabulation; and
WHEREAS, the Oity Oounoil finds that the sealed proposal sub-
mitted by EDWIN L. RA~.RV, 20~9 Newoort Avenue, Costa Mesa,

1s the lowest responsible proposal submitted for the furnishing of all
plant, labor, services, materials and equipment, all utilities and
transportation, including power, fuel and water ana performing all work
neoessary to construct and complete in a good and workmanlike manner
in striot accordanoe with the specifications, plans and drawinge
therefor on file in the office of the Ci ty Olerk of the City of Ana-
heim of the public improvement hereinabove mentioned and desoribed,
together with the appurtenances thereto, and as specified in the
notice inviting sealed proposals, and that said proposal of said
above named bidder should be accepted and a contract awarded to said
bidder in accordance therewith; and
WHEREAS, the City Counoil finds that the above mentioned
sealed proposal is the lowest responsible proposal reoeived and that
the person, firm or corporation submitting said proposal is a
responsible person, firm or oorporation and that the proposal sub-
mitted is the best suited and fitted for the public improvement to
be constructed.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ANAHEIM, that the sealed proposal submitted by EDWIN L.
BA~, 2059 Newport Avenue, Costa Mesa, California.
for the furnishing of all plant, labor, services, materials and
equipment, all utili ties and transportation, inoluding power, fuel
and water and performing all work necessary to oonstruct and complete
in a good and workmanlike manner, in strict aocordance with the
specifications, plans, and drawings therefor on file in the office
of the City Clerk of the City of Anaheim and the notice inviting
sealed proposals, the public works and improvements hereinabove more
particularly mentioned and desoribed, together with the appurtenances
thereto, be, and the same is hereby, accepted, and that a contraot
for the oonstruction and oompletion of said public improvement be,
and the same is hereby, awarded to the said above named bidder.
AND BE IT FURTHER RESOLVED that the successful bidder or
bidders upon eaoh contraot awarded as hereinabove set forth shall
be, and they are hereby required to execute a contract in the required

form with the City of Ana.heim upon the terms and oonditions speoified
in the notioe inviting sealed proposals and the proposal submitted
by said successful bidder or bidders and in accordanoe with the plans
c- and specifications for said public improvemGnt hereinabove described
and in accordance with the terms, conditions and provisions of this
resolution, and that said successful bidder or bidders to whom each
contract is awarded shall be required to furnish a surety bond in an
amount equal to one hundred per cent (100%) of the contraot price for
all labor, materials and equipment to be furnished and performed as
set forth in the sealed proposals submitted by said bidder for the
construction of said public improvement together with the appurtenances
thereto or such portion thereof as is covered by said oontract as
seouri ty for the faithful performanoe of said contract and a separate
surety bond in an amount equal to one hundred per cent (100%) of the
construc1aon oost of said public improvement oovered by said oontract
as security for the payment of all persons performing labor and furn-
ishing material for said project.
AND BE IT FURTHER RESOLVED that said suocessful bidder or
bidders be, and they are hereby required to furnish to the Oity of
Anaheim in companies satisfactory to the Oity ot Anaheim publio
liability, property damage, compensation, and other insuranoe in
the amounts and for the purposes as set forth and speoified in the
notioe inviting sealed proposals and subJeot to the approval ot the
City Attorney as to form and sufficienoy.
AND BE IT FURTHER RESOLVED that the Mayor and the City Olerk
of the City of Anaheim be, and they are hereby, auti~rized and direoted
to make, exeoute and enter into for and on behalf of the Oity of Ana-
haim >> written contraot with said successful bidder or bidders for the
furnishing of all plant, labor, materials, and equipment and performing
8,11 work as hereinabove more particularly desoribed for the construc-
tion, installation and oompletion of said public improvement herein-
above described upon the terms and conditions as speoified in the
notice inviting sealed proposals, the detailed design, plans, profiles,
drawings and general specifications and detailed speoifications and
drawings and all a.ddenda thereto and all modifications incorporated
therein prior to the date of the opening of bids, on file in the office
of the Oity Clerk of the City of Anaheim and in strict accordance with
the terms, conditions and provisions of this Resolution, and in accord-
anoe with all the contract documents herein specified.
THE FOREGOING RESOLUTION 1s signed and approved by me this
