1961-7311RESOLUTION NO. 'Z311 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING TILT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed ings No. 61-62-28 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from p:rsons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon, the Planning Commission did duly adopt a resolu- tion containing a report of its findings, a. summary of the evi- dence presented at said hearing and a recommendation that the proposed amendment be adopted by the. City Council and that oer- tain. zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, surlmary of evidence, report of findings and recommendation of the City Plan- ning Commission, the City Councii did fix the 31st day of October 19 61 as the time, and the i�ty Council .ham- bers in the City Hall in the City of Anaheim as the place fur a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, here- inafter described, from the zone in which it is now situated and the incorporation thereof in the zone hereinafter ,art forth; and did give notice thereof in the manner and form as provided in said Title 18 of said Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did there- upon consider the summary of evidence presented at said public hearing before the Planning Commission, its repo .t of Cindings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in Which it is now situated, and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby amended, and that the following des- cribed property, situated in the. City of Anaheim, County of Orange, State of California, to wit 61 -62 -28 The West half of the Southwest quarter of the Southwest quarter of the Southeast quarter of Section 2, Township L. South, Range 10 West, S. B. B. M. EXCEPTING THEREFROM the North 55.00 feet of the West 198.00 feet. ALSO EXCEPTING THEREFROM the Westerly 110.00 feet of the Southerly 321.00 feet. ALSO EXCEPTING THEREFROM the Southerly 222.00 feet of the Southeast quarter of said Section 2; be excluded from the R -A, RESIDENTIAL- AGRICULTURAL ZONE, and incorporated in the following zone or zone.ss R -3, MULTIPLE FAMILY RESIDENTIAL, ZONE upon the following conditions: 1. That subject property shall be developed sub- stantially in accordance with plans marked ;Exhibits 1, 2, 3 and 4" on file with the City of Anaheim, and by reference made a part hereof. 2. That landscaping shall be provided and maintained in those areas indicated on the plans presented to the City Council and on file with the City; that plans for said landscaping shall be presented to and approved by the Superintendent of Parkway Maintenance; and that said landscaping shall be installed prior to final building inspection. 3. (a) That all engineering requirements of the City of Anaheim, along Acacia Street, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of said engineering requirements. l+.. That the owner of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot, along Acacia Street, for street lighting purposes. 5. That the owner of subject property shall deed to the City of Anaheim easements for public utility -2- ATTEST: purposes along the exterior boundaries of said property as determined and required by the Utilities Director of the City of Anaheim. 6. That the owner of subject property shall pay to the City of Anaheim the sum of $25.00 per dwelling unit, to be used for park and recre- ation purposes, said amount to be paid at the time the building permit is issued. 7. That adequate areas for trash storage and pickup shall be provided as determined by the Director of Public Works and Superintendent of Streets, prior to final building inspection. 8. That the owner of subject property shall place Of record City of Anaheim R -3 Deed Restrictions, approved by the City .Attorney, which restrictions shall limit the height of all buildings to be constructed on subject property_to, one story. 9. That said change of zone is contingent upon the approval of a petition now pending for Conditional Use Permit No. 158. 10. That Conditions Nos. 3(b), 14., 5, and 8 above mentioned, shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Councii an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
