A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM GRANTING VARIANCE NO. 1_496
WHEREAS, the City Planning Commission of the City of
Anaheim did receive a petition for zoning variance from WILLIAM D.
GRINDROD and LLOYD R. PETTENGILL owners
of certaTH property sffria in the CTty of TFiFeim,
of Orange, State of California, described as follows
PARCEL 1: Lot 1 of Tract No. 3303, in the
City of Anaheim, as shown on a map thereof
recorded in book 110, pages 33 and 34, Miscel-
laneous Maps, records of said Orange County.
PARCEL 2: The North 100.00 feet of the East
182 feet of the West 435.60 feet of the North
10 acres of the South 20 acres of the South-
west quarter of the Northwest quarter of
Section 21, in Township 4 South, Range 10
West, in the Rancho Las Bolsas, City of Anaheim,
as shown on a map thereof recorded in book 51,
page 10, Miscellaneous Maps, records of said
Orange County.
AND WHEREAS, the City Planning Commissi.n did hold a
public hearing at the City Hall in the City of Anaheim upon said
petition on September 18 notice of which said public

hearing was duly given as reqiTred by law and the provisions
of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and
WHEREAS, said City Planning Commission, after due
inspection, investigation and studies made by itself and in its
behalf, and after due consideration of all evidence and reports
offered at said hearing, did adopt Resolution No. 84 Series
1961-62 9 recommending that Variance No. 147776

WHEREAS, thereafter, within twenty=twc (22) days from the
date of the adoption of said resolution, a written appeal was
filed with the City Council of the City of Anaheim protesting
the action of the City Planning Commission granting said
variance, and said appeal was set for publi hearilg om
tober 1 1961 at 700 ocIck P.M. at the City
a n t e ty o AnahTTE7 and notice of such public hearing
was duly given as required by law and the provisions of Title 18,
Chapter 18.76 of the Anaheim Municipal Code; and
WHEREAS, after due investigation and studies made by
itself and in its behalf, and after due consideration of all the
evidence and reports offered at said hearing, the City Council
does find and determine that:
1. There are exceptional or extraordinary circum-
stances or conditions applicable to the property
involved or to the intended use of the property
that do not apply generally to the property or
class of use in the same vicinity and zone.
2. That such a variance is necessary for the preserva-
tion and enjoyment of a substantial property right
possessed by other property in the same vicinity
and zone and denied to the property in question.
3. That the granting of such variance will not be
materially detrimental to the public welfare or
injurious to the property or improvements in such
vicinity and zone in which the property is located.
4. That the granting of such variance will not adversely
affect the comprehensive general zoning plan.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim that a conditional zoning variance be and the same
is hereby granted permitting a waiver of the Anaheim Municipal Code
minimum lot size and width requirements in the division of the
property hereinabove described, subject to the following conditions:
1. That the owners of subject property shall
deed to the City of Anaheim easements for
public utility purposes along the exterior
boundaries of said property as determined
and required by the Utilities Director of
the City of Anaheim.
2. That a Record of Survey of subject property
shall be recorded in the Office of the County
Recorder of Orange County.
3. That this variance is contingent upon the
completion of Reclassification Proceedings
No. 61-62-26 now pending.
14.. That the owners of subject property shall
place of record City of Anaheim deed re-
strictions, approved by the City Attorney,
which restrictions shall provide that the
minimum livable floor area per residence,
for all residences constructed on subject
property, shall be 1,500 square feet.
5. That plans for the development of subject
property shall be submitted to and approved
by the Architectural Committee.
6. That the following stipulations made by
Mr. Rothman, authorized agent of the
petitioners for said variance, with
reference to the development of subject
property and the abutting property on
the west, which area is covered by Re-
classification Proceedings No. 61-62-26

now pending, shall be considered as
conditions of this variance and shall
be complied with:
(a) That said property is being sold
as evidenced by Escrow No. 1701906
at United California Bank, dated
October 27, 1961, Lloyd R. Pettengill,
Seller, and Ronald D. Doan, Buyer.
(b) That the plans for the development
of subject property, reviewed by the
owners of adjacent property and this
day submitted to the City Council,
shall be, by reference, made a part
hereof.
That Conditions Nos. 1, 2 and 4 above
mentioned shall be complied with ,within
a period of 180 days from date hereof, or
such further time as the City Council may
grant.
The City Council hereby reserves the right to revoke
such variance permit for good cause or failure of said owners,
their heirs, successors or assigns, to comply with the Anaheim
Municipal Code and regulations and the conditions herein. Said
variance is granted for the term prescribed by the Anaheim
Municipal Code unless otherwise specified herein.
THE FOREGOING RESOLUTION is approved and signed by
me this 31st day of October, 1961.

do hereby certify that the foregoing Resolution No. 7309 was
introduced and adopted at a regular meeting provided by law, of
the City Council of the City of Anaheim, held on the 31st day of
October, 1961, by the following vote of the members thereof:
AYES: COUNCILMEN: Chandler, Fry, Thompson and
Schutte.
NOES: COUNCILMEN: None.
ABSENT: COUNCILMEN: Coons.
AND I FURTHER CERTIFY THAT the Mayor of the City of
Anaheim approved and signed said Resolution No. 7309 on the 31st
day of October, 1961.
