1961-7308RESOLUTION NO. ?308 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING Ti TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of, the City of Anaheim did hold a public hearing in Reclassification Proceed- ings Noe 61 -62 -26 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from i;rsons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon, the Planning Commission did duly adopt a resolu- tion containing a report of its findings, a summary of the evi- dence presented at said hearing and a recommendation that the proposed amendment be adopted by the. City Council and that ;e-- tain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, psummaru_ o evidence, report of findings and recommendation of the City Plan- ning Commission, the City Councii did fix the )1st day of Octobey 19 61 as the time, and the City Council hem bers in the City H -in the City of Anaheim as the place fur a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, here- inafter described, from the zone in which it is now situated and the incorporation thereof in the zone hereinafter :t forth; and did give notice thereof in the manner and form as provided in said Title 18 of said Anaheim Municipal. Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such publi<i hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did there- upon consider the summary of evidence presented at 3aid public hearing before the Planning Commission, its.repo.fi of C ndlnys, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in Which it is now situated, and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that T.ie 18 of the Anaheim Municipal Code be, and the same is hereby amended, and tha..t the following des cribed property, situated in the, City of Anaheim, County of Orange, State of California, to wit: -1- 61 -62 -26 The North 100.00 feet of the West 253.60 feet of the North 10 acres of the South 20 acres of the Southwest quarter of the Northwest quarter of Section 21, in Township 4 South, Range 10 West, in the Rancho Las Bolsas, city of Anaheim, as shown on a map thereof recorded in book 51, page 10, Miscellaneous Maps, records of said Orange County; be excluded from the R-A, RESIDENTIAL AGRICULTURAL ZONE, and incospo aced in the following zone or zones; C -1, NEIGHBORHOOD-COMMERCIAL ZONE, upon the following conditions: 1. That subject property shall be developed sub- stantially in accordance with plans marked "Exhibit 1" on file with the City of Anaheim, and by reference made a part hereof, with the exception that there shall be no pedestrian nor vehicular ingress or egress on Buena Vista Avenue. 2. That a masonry wall six feet in height shall be constructed along the east and north boundaries of subject property prior to final building inspection. 3. That the owners of subject property shall place of record City of Anaheim C -1 Deed Restrictions, approved by the City Attorney, which restrictions shall limit the uses of said property to business and professional offices only. 4. That the owners of subject property shall deed to the City of Anaheim a strip of land 53 feet in width, from the center line of the street, along Euclid Avenue, for street widening purposes. 5. (a) That all engineering requirements of the City of Anaheim, along Euclid Avenue, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other app work shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in heoOOfficean of the City Engineer, and (b) tha t -2- amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of said engineering requirements. 6. That the owners of subject property shall deed to the City of Anaheim easements for public utility purposes along the exterior boundaries of said property as determined and required by the Utilities Director of the City of Anaheim. 7. That a Record of Survey of subject property shall be recorded in the Office of the County Recorder of Orange County. 8. That the owners of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot, along Euclid Avenue, for street lighting purposes. 9. That the following stipulations made by Mr. Rothman, authorized agent of the petitioner for said change of zone, with reference to the development of subject property and the abutting property on the east, which area is covered by Variance No. 1406 now pending, shall be con- sidered as conditions of this reclassification and shall be complied with: (a) That said property is being sold as evidenced by Escrow No. 1701906 at United California Bank, dated October 27, 1961, Lloyd R. Pettengill, Seller, and Ronald D. Doan, Buyer. (b) That deed restrictions shall be placed on the C -1 property requiring the construction of a concrete block wall at the rear portion of the lot to act as a buffer to the residen- tial development. (c) That no retail sales shall be permitted on the C -1 property. (d) That the plans for the development of the residential property reviewed by the owners of adjacent property and this day submitted to the City Council shall be made a part hereof, by reference. 10. That Conditions Nos. 3, 4, 5(h), 6, 7 and 8 above mentioned shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
