1961-7305RESOLUTION NO. 7305 A RESOLUTION OF THE CITY COUNCIL OF THE CITY, OF ANAHEIM FINDING AND DETERMINING Ti-iLT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No. 61- 62-23 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from p :rsons interested therein and from, its staff; and WHEREAS, within a period of forty days following said hearing thereon, the Planning Commission did duly adopt a r esolu- tion containing a report of its findings, a. summary of the evi- dence presented at said hearing and a recommendation that the proposed amendment be adopted by the.City Council and that twin zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Plan- ning Commission, the City Council did fix the 31st day of October 19 61 as the time, and the MY Council hem bers in the City SETT the City of Anaheim as the place fur a public hearing upon said proposed amendment to Title i8 of the Anaheim Municipal Code, and the exclusion of said property, here- inafter described, from the zone in which it is now situated and the incorporation thereof in the zone hereinafter° t forth; and did give notice thereof in the manner and form as provided in said Title 18 of said Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hear ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did there- upon consider the summary of evidence presented at ,aid public hearing before the Planning Commission, its.repo,t of fi ndings, and recommendation; and WHEREAS, the City. Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code.shouid be adopted and that the property hereinafter described should be excluded from the zone or zones in Which it is now situated, and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that T,le 18 of the Anaheim Municipal Code be, and the same is hereby amended, and that the following des- cribed property, situated in the City of Anaheim, County of Orange, State of California, to wit: 61 -62 -23 That portion of the southeast quarter of section 7, Township 4 South, Range 10 West, in the Rancho Los Coyotes, city of Anaheim, county of Orange, state of California, as per map recorded in book 51 page 10 of Miscellaneous Maps, in the office of the county recorder of said county, described as follows: Beginning at the southwest corner of lot 54 of Tract No. 2625, as per map recorded in book 94 pages 9, 10 and 11 of said Miscellaneous Maps; thence North 89° Olt 59" East 265.02 feet along the southerly line of said Tract No. 2625; thence South O" 16? 57" East 246.00 feet to the northerly line of Lincoln. Avenue, as shown on said map of Tract No. 2625; thence South 89 Olt 59" West 239.63 feet along said northerly line to a point North 89° Olt 59" East 53.39 feet from the inter- section of said northerly line with the center line of Monterey Street, as shown on said map of Tract No. 2625; thence North 0 58' 01" West 7.00 feet to the beginning of a non tangent curve concave northeasterly having a radius of 25.00 feet, a radial line through said point bears South 0 58' 01" East; thence northerly 39.57 feet along said curve through a central angle of 90° 41t 04 thence North 0° 16t 57" West 213.70 feet to the point of beginning; be excluded from the R -A, RESIDENTIAL- AGRICULTURAL, ZONE and incorporated in the C -1, NEIGHBORHOOD COMMERCIAL, ZONE, upon the following conditions: 1. That subject property shall be developed sub- stantially in accordance with plans marked "Exhibits 1, 2 and 3," signed by G. G. Fry, and on file with the City of Anaheim, with the exception that said plans shall be amended to provide for a four -foot planting area against the north wall, and that thick shrubbery, which will grow to a height above said wall, shall be planted and maintained in said four foot area. That said plans shall be further amended to include two openings on Monterey Street for ingress and egress, but prohibiting any openings within the north 88 feet of subject property. That no buildings shall be placed within 120 feet of the northerly property line. That final plans of development shall be sub- mitted to and approved by the Building and Planning Departments of the City. 2. That the owners of subject property shall place of record City of Anaheim C -1 Deed Restrictions, approved by the City Attorney, which restrictions shall provide that only two openings shall be permitted on Monterey Street for ingress and egress and shall prohibit any openings within the north 88 feet of subject property. 3. That 6 -foot landscaped areas shall be provided and said landscaping maintained, along Monterey Street and Lincoln Avenue, with the installation of tree wells either in said landscaped strips or in the parkway portion of the planned highway right of way lines of Monterey Street and Lincoln Avenue, said tree wells to be placed at 40 -foot intervals; that plans for said landscaping shall be submitted to and approved by the Superintendent of Parkway Maintenance; and that said landscaping shall be installed prior to final building inspection. 4. That a 6 -foot masonry wall shall be constructed along the northerly property line where subject property abuts the R -1, ONE- FAMILY RESIDENTIAL, Zone property, and that said wall shall be con- structed prior to final building inspection. 5. That parking area shall be provided in accordance with the requirements of the Anaheim Municipal Code and the open -air parking space standards heretofore adopted by the City Planning Commission and on file in the Office of the City Planning Department. 6. That the owners of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot along Lincoln Avenue, for street lighting purposes. 7. (a) That sidewalks shall be constructed along Monterey Street and Lincoln Avenue, as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the construction of said sidewalks. 8. (a) That commercial driveways shall be constructed on Monterey Street and Lincoln Avenue, in accord- ance with approved City of Anaheim standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the construction of said driveways. 9. That the owners of subject property shall deed to the City of Anaheim easements for public utility purposes along the exterior boundaries of said property as determined and required by the Utilities Director of the City of Anaheim. hereof 10. That Conditions Nos. 2, 6, 7(b)', 8(b) and 9 /shall be complied with within a period of 90 days from date hereof, or such further time as the City Council may grant. -3- BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and de- termined to be necessary and proper.
