A RESOLUTION OF THE OITY OOUNCIL OF THB:
OITY OF ANAHEIM ACOEPTING A SEALED PROPOSAL
AND AWARDING A OONTRAOT TO THE LOWEST RES-
PONSIBLE BIDDER FOR THE FURNISHING OF ALL
PLAHT, LABOR, SERVIOES, MATERIALS AND EQ,UIP-
MElT AND ALL UTILITIES AND TRANSPORTATION,
INOLUDING POWER, FUEL AND WATER, AND PER-
FORMING ALL WORK NEOESSARY TO OONSTRUOT AND
OOMPLETE THE FOLLOWING PUBLIO IMPROVEMENT:
THE MIDWAY SEWER EXTENSION. PROM LOS ANGEL~

WHEREAS, the Oity Council of the City of Anaheim did
aause to be pUblished 1n a newspaper of general oiroulation,
printed, published and oiroulated in the Oity ot Anaheim, to

19 ?6 ,a notioe inviting sealed proposals for furnish1ng
the tollo"ing:
All plant, labor, serVices, materials and eqAipment, and all utilities
and transportation, including power, ruel and water, and performing all
work necessary to oonstruot and oomplete, in a good and workmanlike man-
ner, in strict acoordanoe with the speCifications, plans and drawings
therefor on file in the Offioe of the City Clerk of the City of Anaheim,
the following publio improvement, to wit: The Midway Sewer ExtenSion,
from Los Angeles St. to Harbor Blvd., consisting of the construction
of 15" extra strength V.C.P. mains, including trenChing, backfill and
flooding; also 12" extra strength V.C.P. mains, including trenohing,
backfill and flooding; construction of standard 4' briok manholes, in-
cluding excavation and oastings; jaoking a steel casing under the Santa
Ana Freeway; replaoe existing pavement over sewer, oonstruotion of
15" x 4" extra strength V.C.P. wyes, also 12" x 4 extra strength V.C.p.
wyes, and appurtenant work as indicated on the plans, Job No. 1068.

of the Oity of Anaheim; and
WHEREAS, said notioe inviting sealed proposals for said
pUblio improvement did provide that sealed proposals would be reoeived
bl the Oity Oouncil of the City of Anaheim at the Office of the Oity
Cl.rk of the City of Anaheim up to the hour of 7:00 o'olook P.M. on
the 24th day of July , 19.5-.2....for the furnishing of all
plant, labor, servioes, materials and equipment, all utilities and
transportation, including power, fuel and water, and performing all
work necessary to oonstruct and oomplete, 1n a good and workmanlike
manner, the publio improvement hereinabove more partioularly mentioned
aDd desoribed and which notice did state and declare that pursuant
to the provisions of Seotion l770 of the Labor Code, the City Oounoil
ot the City of Anaheim had ascertained the prevailing rate or wages
im the locality in whioh this type of labor is to be performed for
eaoh oraft or type of workman or mechanic needed to exeoute the con-
tract and did set forth the prevailing hourly wage soale so ascertained;
and

WHEREAS, the City Council of the City of Anaheim did rece1ve
the following pealed proposals prior to 7:00 o'olook P. M. on the

WHEREAS, the Oity Council did thereupon refer said bids to
the City Engineer for examination, tabulation
and report to the City Council, and said City Engineer
did examine and tabulate said sealed proposals and did report to the
Oouncil the result of his examination and tabulation; and
WHEREAS, the Oity Oounoil finds that the sealed proposal sub-

is the lowest responsible proposal submitted for the furnishing of all
plant, labor, services, materials and equipment, all utilities and
transportation, including powe~, fuel and water and performing all work
necessary to oonstruct and complete in a good and workmanlike manner
in strict acoordance with the specifications, plans and drawings
therefor on file in the office of the City Olerk of the City of Ana-
helm of the public improvement hereinabove mentioned and desoribed,
together with the appurtenances thereto, and as speoified in the
notioe inviting sealed proposals, and trmt said proposal of sald
above named bidder should be accepted and a contract awarded to said
bidder in acoordance therewith; and
WHEREAS, the City Council finds that the above mentioned
sealed proposal is the lowest responsible proposal reoeived and that
the person, firm or corporation submitting said proposal is a
responsible person, firm or corporation and that the proposal sub-
mitted is the best suited and fitted for the public improvement to
be oonstructed.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ANAHEIM, that the sealed proposal submitted by
Elmer E. Barnett, 13152 Century Boulevard, Garden Grove, Calif.
for the furnishing of all plant, labor, services, materials and
equipment, all utilities and transportation, including power, fuel
and water and performing all work necessary to oonstruct and complete
in a good and workmanlike manner, in strict accordance with the
specifications, plans, and drawings therefor on file in the office
of the City Clerk of the City of Anaheim and the notice inviting
sealed proposals, the public works and improvements hereinabove more
partioularly mentioned and described, together with the appurtenances
thereto, be, and the same is hereby, accepted, and that a contract
for the oonstruction and completion of said public improvement be,
and the same is hereby, awarded to the said above named bidder.
AND BE IT FURTHER RESOLVED that the successful bidder or
bidders upon each contract awarded as hereinabove set forth shall
be, and they are hereby required to execute a oontract in the required

form with the City of Anaheim upon the terms and oonditions speoified
in the notice inviting sealed proposals and the proposal submitted
by said successful bidder or bidders and in accordance with the plans
,-- and specifications for said public improvement hereinabove described
and in accordance with the terms, conditions and provisions of this
resolution, and that said sucoessful bidder or bidders to whom each
contract is awarded shall be required to furnish a surety bond in an
amount equal to one hundred per cent (IOO%) of the contract price for
all labor, materials and equipment to be furnished and performed as
set forth in the sealed proposals submitted by said bidder for the
cons truction of said public improvement together with the appurtenances
thereto or such portion thereof as is covered by said contract as
security for the faithful performance of said contract and a separate
surety bond in an amount equal to one hundred per cent (100%) of the
construction cost of said public improvement covered by said contraot
as security for the payment of all persons performing labor and furn-
ishing material for sald project.
AND BE IT FURTHER RESOLVED that said successful bidder or
bidders be, and they are hereby required to furnish to the City of
Anaheim in companies satisfactory to the City of Anaheim publio
liability, property damage, compensation, and other insurance in
the amounts and for the purposes as set forth and specified in the
notice inviting sealed proposals and subjeot to the approval of the
City Attorney as to form and sufficiency.
AND BE IT FURTHER RESOLVED that the Mayor and the City Clerk
of the City of Anaheim be, and they are hereby, authorized and direoted
to make, execute and enter into for and on behalf of the City of Ana-
heim 8 written contract with said successful bidder or bidders for the
furnishing of all plant, labor, materials, and equipment and performing
all work as hereinabove more particularly described for the construc-
tion, installation and completion of said pUblic improvement herein-
above described upon the terms and conditions as specified in the
notioe inviting sealed proposals, the detailed design, plans, profiles,
drawings and general specifications and detailed specifications and
drawings and all addenda thereto and all modifications incorporated
therein prior to the date of the opening of bids, on file in the office
of the City Clerk of the City of Anaheim and in strict accordance with
the terms, conditions and provisions of this Resolution, and in accord-
ance with all the contract documents herein specified.
