1961-7287RESOLUTION NO. 7287 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ACCEPTING A GRANT FROM NORTHWESTERN PACIFIC RAILROAD COMPANY OF THE RIGHT TO CONSTRUCT, RECONSTRUCT, MAINTAIN AND USE A STREET OR HIGHWAY ACROSS PROPERTY OF THE GRANTOR, AND AUTHORIZING THE EXECUTION OF AN INDENTURE COVERING THE CONSTRUCTION, USE AND MAIN- TENANCE OF SAID STREET OR HIGHWAY. -1- R/W Attorney WHEREAS, the Northwestern Pacific Railroad Company, a corporation of the State of California, has tendered to the City of Anaheim an indenture granting to the City of Anaheim the right to construct, reconstruct, maintain and use a street or highway upon and across the following described real property, subject to the reservations, covenants and conditions therein contained: That certain piece or parcel of land, situate in the City of Anaheim, County of Orange, State of California, in the East half (E. 1/2) of Section 23, Township 4 South, Range 10 West, S. B. B. M., being a portion of the San Juan Cajon de Santa Ana, as per map recorded in Book 2, Pages 256 and 257 of Patents, in the Office of the Recorder of said County, described as follows: A strip of land, 5 feet in width, lying in the North- west quarter (N.W. 1/4) of the Southeast quarter (S.E. 1/4) of aforesaid Section 23, bounded and described as follows: Bounded northeasterly by the southwesterly line of Atchison, Topeka and Santa Fe Right of Way, 100 feet wide, described in deed recorded August 19, 1884, in Book 593, Page 109, of Deeds, in the Office of the Recorder of said County; bounded northerly by the center line of Cerritos Avenue, 40 feet wide; bounded southwesterly by a line parallel with and distant southwesterly 5 feet, measured at right angles, from the southwesterly line of said 100 foot wide Right of Way; bounded southerly by a line parallel with and distant southerly 45 feet, measured at right angles, from said center line of Cerritos Avenue. Containing an area of 300 square feet, more or less. AND WHEREAS, said grantor has tendered to the City said above mentioned indenture to be executed by the Northwestern Pacific Railroad Company and the City of Anaheim, which indenture the City Council finds would be for the benefit and best interest of the City of Anaheim and should be approved. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the street or highway indenture above mentioned tendered to the City by Northwestern Pacific Railroad Company, a corporation of the State of California, granting to the City, but subject to the reservations, covenants and conditions therein contained, the right to construct, re- construct, maintain and use a street or highway upon and across the real property hereinabove mentioned and described be, and the same is hereby approved and accepted. BE IT FURTHER RESOLVED that the Mayor and the City Clerk be, and they are hereby, authorized to execute said indenture above mentioned for and on behalf of the City of Anaheim.
