1961-7284RESOLUTION NO. 7284 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING VARIANCE NO. 1383. WHEREAS, the City Planning Commission of the City of Anaheim did rnceive a petition for zoning variance from PAUL LEITER, owner of certain real property situated in the City of Anaheim, County of Orange, State of California, described as follows: Lots A, X, Y and 14 to 19 inclusive and 21 to 23 inclusive in Tract No. 190, in the city of Anaheim, county of Orange, state of California, as per map recorded in book 23 page 50 of Miscellaneous Maps, in the office of the county recorder of said county. EXCEPT that portion of lots 14, 21, 22, 23, X and Y lying easterly of the following described line: Beginning at a point on the northerly line of said Lot X, distant South 89 59 25" West 76.00 feet from the intersection of said northerly line with a line which is parallel with and 140.00 feet westerly, measured at right angles from the westerly line of the State Highway, 60.00 feet wide, as said Highway is shown on said map; thence South 6° 401 00" West 179.65 feet to a point which bears North 6° 40' 00" East 227.65 feet from the most westerly corner of the land described in Certificate of Title No. 9112 on file in the office of said county recorder; thence South 28 24 50" West 179.55 feet to a point on the westerly line of said lot Y, distant North 40 52 20" West 90.18 feet from said most westerly corner. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said petition on August 7, 1961, notices of which said public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said City Planning Commission, after due inspection, investigation and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did adopt Resolution No. 28, Series 1961 -62, recommending that Variance No. 1383 be granted upon certain conditions set forth therein; and WHEREAS, thereafter, within twenty (20) days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action taken by the City Planning Commission in granting said variance and did set a public hearing thereon to be held on the 12th day of September, 1961, at 7 :00 o'clock P.M. in the City Hall in the City of Anaheim, and notice of such public hearing was duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, after due investigation and studies made by itself and in its behalf, and after due consideration of all the evidence and reports offered at said hearing, the City Council does find and determine that: 1. There are exceptional or extraordinary circumstances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zone. 2. That such a variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property in question. 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in Which the property is located. 4. That the granting of such variance w i l l not adversely affect the comprehensive general zoning plan. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning Variance be, and the same is hereby granted permitting a waiver of the maximum height limitations for buildings, the construction of an office building, and a waiver of the minimum parking space requirements, as provided by the Anaheim Municipal Code, on the property hereinabove described, subject to the following conditions: 1. That 323 parking spaces shall be provided, with a full -time parking attendant on duty during business hours. 2. That landscaping shall be provided as indicated on the revised plot plan on file with the City of Anaheim, approved and signed by Councilman Coons on October 17, 1961, prior to final inspection of the building to be constructed on subject property, and that the plans for said landscaping shall be subject to approval of the Superintendent of Parkway Maintenance. 3. That subject property shall be developed substantially in accordance with the revised plot plan this day submitted to the City Council, approved and signed by Councilman Coons on October 17, 1961, and on file with the City of Anaheim. 4. That the uses of subject property shall be limited to: (a) Medical and dental offices. (b) Business and professional offices and real estate agencies. (c) Incidental or accessory uses as follows: (1) Book or stationery stores. (2) Confectionery stores. SIM (3) Dress or millinery shops. (4) Drug stores. (5) Newsstands. (6) Notions stores. (7) Restaurants and coffee shops (developed in accordance with floor plans submitted to and approved by the City Council). (8) Tailor, clothing or wearing apparel shops. (9) Blue printing or photostating stores. (10) Bars, cafes and restaurants (including dancing and enter- tainment). (Development plans to be submitted to and approved by the City Council.) (11) Interior decorating stores. (12) Baths Turkish and similar. (13) Newspaper or printing establishments. (14) Radio or television broadcasting studios or stations. (15) Medical, industrial clinics. 5. That the owner of subject property shall deed to the City of Anaheim easements for public utility purposes along the exterior boundaries of said property as determined and required by the Utilities Director of the City of Anaheim. 6. That the owner of subject property shall deed to the City of Anaheim easements for sewer purposes along the exterior boundaries of said property as determined and required by the City Engineer of the City of Anaheim. 7. That adequate access to subject property from the Frontage Road shall be provided as required by the City Engineer. 8. That the owner of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot, along the Frontage Road, for street lighting purposes. 9. That Conditions Nos. 5, 6 and 8 above mentioned shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. The City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owner, his heirs, successors or assigns, to comply with the Anaheim Municipal Code and regulations and the conditions herein. Said variance is granted for the term prescribed by the Anaheim Municipal Code unless otherwise specified herein. 3- THE FOREGOING RESOLUTION is approved and signed by me this 17th day of October, 1961.
