1961-7217RESOLUTION NO. 7217 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING Ti-LT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of_the C"ity'of Anaheim did hold a public hearing in Reclassification Proceed- ings No. 61 -62 -17 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning and to consider a change in the boundaries of the zone or zone; hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days fo iowing said hearing thereon, the Planning Commission did duly adopt a resolu- tion containing a report of its findings, a summary of the evi- dence presented at said hearing and a recommendation that the proposed amendment be adopted by the. City Council and that cer- tain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Plan- ning Commission, the City Council did fix the 26th day of September 1961 as the time, and the qty Counc i 1 .ham bers in the City Hein the City of Anaheim as the place fur a public, hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, here- inafter described, from the zone in which it is now situated and the incorporation thereof in the zone hereinafter s:t forth; and did give notice thereof in the manner and form as provided in said Title 18 of said Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did there- upon consider the summary of evidence presented at said public hearing before the Planning Commission, its repo, t of findings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code•shouid be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated, and incorporated In the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that T_.ie 18 of the Anaheim Municipal Code be, and the same is hereby amended, and that the following des cribed property, situated in the City of Anaheim, County of Orange, State of California, to wit: -1- 61 -62 -17 The North 90 feet of the North 160 feet, measured from the North line of said Lot 20, as shown on a map of survey, recorded in book 6, page Record of Surveys, in the office of the County Recorder of said Orange County of the West 250 feet, measured from the center line of Euclid Avenue, as established by the County Surveyor of said county, and shown in the County Surveyor's Transit Book 108, page 15 of Lot 20 of Helen and Lynch's Subdivision, in the city of Anaheim, as shown on a map thereof recorded in book )iJi2, page 158, Deeds, records of said Orange County; EXCEPT the East 80 feet; be excluded from the R -A, RESIDENTIAL- AGRICULTURAL ZONE, and incorporated In the following zone of zones C -1, NEIGHBORHOOD- COMMERCIAL ZONE, upon the following conditions: 1. That subject property shall be developed substantially in accordance with plans marked "Exhibits 1 and 2" on file with the City of Anaheim, and by reference made a part hereof. 2. That a 6 -foot building setback area shall be established abutting the planned highway right of way line; that said setback area and the parkway portion of the dedicated streets shall be landscaped and said landscaping maintained; that plans for said landscaping shall be sub- mitted to and approved by the Superintendent of Parkway Maintenance of the City of Anaheim; and that said landscaping shall be installed prior to final inspection of the buildings on subject property. 3. That the owners o f subject property shall place of record City of Anaheim C -1 Deed Restrictions, approved by the City Attorney, which restrictions shall limit the usescf subject property to business and professional offices only. 4. (a) That a masonry wall, six feet in height, shall be constructed along the east and north boundaries of subject property, the wall along the east boundary to be constructed at the time the property is developed, and the wall along the north boundary line to be constructed within a period of two years from date hereof, or such further time as the City Council may grant; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be -2- posted with the City to guarantee the construction of the wall along the north boundary within said period of two years, or such further time as the City Council may grant. 5. That the owners of subject property shall deed to the City of Anaheim a strip of land 53 feet in width, from the center line of the street, along Euclid Avenue for street widening purposes. 6.(a)That all engineering requirements of the City of Anaheim, along Euclid Avenue, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of said engineering requirements. That the owners of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot, along Euclid Avenue, for street lighting purposes. 8. That the owners of subject property shall deed to the City of Anaheim easements for public utility purposes along the exterior boundaries of subject property, as determined and required by the Utilities Director of the City of Anaheim. 9. That Conditions Nos. 3, t(b), 5, 6(b), 7 and 8, above mentioned, shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
