A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM URGING THE CALIFORNIA. ASSEMBLY
INTERIM COMMITTEE TO NOT RECOMMEND THE PASSAGE
AND ADOPTION OF ASSEMBLY BILL NO. 77.
WHEREAS, on January 4, 1961, there was introduced
into the California Legislature, 1961 regular general session,
Assembly Bill No. 77 providing that every local public agency
owning any tax- exempt property which is used in connection
with its operation of a business of producing, distributing
or selling gas or electricity shall, for the privilege of
engaging in such business, each year make payment equal to
the aggregate annual taxes that would be payable by it to
any school district in which its property is located if such
property were taxable; and
WHEREAS, after careful consideration, the City
Council does find that any law taxing one public agency for
the benefit of another public agency under the same state
or local government would be highly detrimental to the public
welfare and would increase the cost of governmental operation
to the taxpayers because of added personnel, bookkeeping and
auditing facilities necessary to collect and account for such
funds; and
WHEREAS, the City Council does further find that
such funds would be collected from the taxpayers and that
the laws now in existence permit the levy and collection of
taxes by school districts necessary and required for all
public school purposes which taxes are collected directly
from the taxpayers and paid to the district or to the state;
and
WHEREAS, the City Council does further find that the
taxation of one public agency for the benefit of another public
agency would be discriminatory and would result eventually in
many public agencies taxing each other with great confusion and
added cost to the taxpayers who would be required to pay such
taxes; and
WHEREAS, the California Assembly Interim Committee has
scheduled hearings for the said Assembly Bill No. ?7 to be held
on September 21st and 22nd, 1961, at 10 :00 A.M. at the Stardust
Motor Hotel, Highway 80, Mission Valley, San Diego, California.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that said Assembly Interim Committee be,
and it is hereby, urged to recommend to the California Legisla-
ture that Assembly Bill 77 do not pass.
AND BE IT FURTHER RESOLVED that a copy of this reso-
lution be certified by the City Clerk and such certified copy
be delivered to said Assembly Interim Committee prior to the
date of its hearings.
THE FOREGOING RESOLUTION is approved and signed by
me this 19th day of September, 1961.

day of September, 1961.
