1961-7181RESOLUTION NO. 7181 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DENYING VARIANCE NO. 1390 WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition for zoning variance from HERMAN E. MILBRAT and LEILANI MILBRAT, owners, of certain real property situated in the City of Anaheim, County of Orange, State of California, described as follows: That portion of the northeast quarter of the southwest quarter of section 12, Township 4 South, Range 11 West, in the Rancho Los Coyotes, city of Anaheim, county of Orange, state of California, as said northeast quarter of the southwest quarter of section 12 is shown on a Record of Survey Map filed in book 25 page 34 of Record of Surveys, of said county, described as follows: Beginning at a point on the east line of said southwest quarter North 0 11 30" West 751.27 feet from the south- east corner of said northeast quarter of the southwest quarter of section 12; thence North 0 11 30" West along said east line 100.00 feet; thence South 89° 401 30" West 264.00 feet; thence South 0 11 30" East 100.00 feet; thence North 89 40 30" East 264.00 feet to the point of beginning. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on August 7 19 61 notice of which said public hearing was duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said City Planning Commission, after due inspection, investigation and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did adopt Resolution No. 33 Series 19 61 -62 denying Variance No. 1390 and WHEREAS, thereafter, within twenty (20) days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action taken by the City Planning Commission in denying said variance and did set a public hearing thereon to be held o n the 12th day of September, 1961 at 7:00 o'clock P.M. in the City Hall in the City of Anaheim, and notice of such public hearing was duly given as required by law and the provi- sions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, the City Council does find that: 1. There is no substantial property right possessed by other property in the same vicinity and zone and denied the subject property. 2. It appears that the subject property can be adequately developed and used under the present zone. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commission denying -1- Variance No. 1390 be, and the same is hereby, sustained and that the request of Herman E. Milbrat and Leilani Milbrat for a variance permitting the continued operation of a beauty shop on the property hereinabove described be, and the same is hereby, denied.
