1961-7167RESOLUTION 'NO. 7167 .A `RESOLUT I ON OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT PUBLIC CONVENIENCE AND MLCESSITY REQUIRE THE CONSTRUCTION AND COMPLETION OF A PUBLIC IMPROVEMENT, TO 'WIT:: THE WESTERN LINCOLN AVENUE SEWER IMPROVEMENT IN WESTERN AmENIJEFRallunTormormr 158 FEET SOUTH OF LINCOLN AVENUE TO L INCOLN •AVEI t TE AKIN LINCOLN AVENUE FROM APPROXIMATELY FEET WEST OF 'G STERN AVENUE TO APPROXIMATEL EET WES A JOB NO. 1231; AND APPROVING THE DESIGNS, PLANS, PROFILES, DRAWINGS AND SPECIFICATIONS FOR THE CONSTRUCTION THEREOF; AUTHORIZING`? THE CONSTRUCTION OF SAID PUBLIC IMPROVEMENT IN ACCORDANCE WITH SAID PLANS, SPECIFICATIONS, ETC.; AND AUTHORIZING AND DIRECTING THE CITY CLERK TO PUBLISH A NOTICE INVITING SEALED PROPOSALS FOR THE CONSTRUCTION THEREOF. WHEREAS, public convenience and necessity require the cdxistruC- tion and completion of a public improvement in the City of Anaheim, to wit: The Western- Lincoln Avenue Sewer Improvement, consisting of the construction of an 8 -inch V.C.P. Sewer Line in Western Avenue from approximately 358 feet south of Lincoln Avenue to Lincoln Avenue and in Lincoln Avenue from approximately 5L5 feet west of Western Avenue to approximately 970 feet west of Western Avenue, in the City of Anaheim, including jacking of a 22 -inch steel casing under Lincoln Avenue, excavation, backfill and flooding, construction of manholes and laterals, and appurtenant work as more particularly set forth in the plans and specifications on file in the Office of the City Clerk or City Engineer, Job. No. 1231; AND WHEREAS., the City Council instructed the Public Works De artment to-prepare detailed designs, plans, pro'i 1es, raw ngs an specs i"cations, and estimates of quantities and costs and make necessary survey:. for the conetruc.tion of said public improvements and WHEREAS, said Public Works Department has prepared said de. tailed designs, plans, profiles, drawfngs and :.s.pecifications for the construction of said public improvement and has submitted the same to the City Council; and WHEREAS, the City Council finds that the detailed designs, plans, profiles, drawings and specifications for said public improvement abov'e- Mentioned are in accordance with good engineering practice and are ad- equate to serve the needs and requirements of the City of Anaheim and the citizens and residents in said area for the purposes for which they are intended, and that they are adequate for the construction of said public improvement and should be approved. NOW, THEREFORE, 1E IT RESOLVED by the City.Counci1 of the City Of Anaheim that the detailed designs, plans, profiles, drawings and Specifications' for sa id. pubs is improvement herelnabove mentioned and described be, and the same are hereby, approved and adopted as prepared by said Public Works Department -1- AND BE IT FURTHER RESOLVED that said public improvement shall be constructed in accordance with said detailed designs, plans, profiles, drawings and specifications as prepared by said t'ublic Works Department and hereby approved, and such addenda or modifications thereto as may be approved prior to, the awarding of bids therefor BE IT FURTHER RESOLVED that the City Clerk of the City of Anaheim be, and she is hereby, authorized and directed to pub- lish a notice according to law, inviting sealed proposals for the furnishing of all plant, labor, services, materials and equipment, and all utilities and transportation, including power, fuel and water, and performing all work necessary to construct and complete, in a good and workmanlike manner, in strict accordance with said detailed designs, plans, profiles, drawings and specifications as prepared by said Public Works Department the public improvement hereinabove mentioned and described, and fixing the 28th day of September 19 61 at the hour of 2 :00 °°'clock P°M as the date and hour for the opening of said bids at the City Council Chamber in the City Hall in the City of Anaheim, and that said notice shall be published twice, the first of which publications shall be at least ten (10) days prior to the date fixed for the open- ing of bids, and that said publications shall be at least five (5) days apart, AND BE IT FURTHER RESOLVED that the successful bidder or bidders shall be required to enter into a contract with the City of Anaheim in the manner and form approved by the City Attorney of the City of Anaheim for the construction, installation and completion of said public improvement hereinabove mentioned and described, in accordance with the plans and specifications prepared by said Public Works Department the notice inviting sealed proposals, this resolution and all applicable City Ordinances or Code Sections and the laws of the State of California, and shall be required to post bonds and insurance in the amounts and within the time required by law, as specified in the notice inviting sealed proposals, and in a form approved by the City Attorney, THE FOREGOING RESOLUTION was approved and signed by me this 5th day of Sept ember 19 61 ATTEST: C IA CLERK OF TH OF AAEIN� 77 5" HE C TY OF ANAHEIM STATE OF CALIFORNIA) COUNTY OF ORANGE ss. NOES: COUNCILMEN: None. ABSENT: COUNCILMEN: None. AND I FURTHER CERTIFY, that the Mayor of the City of Anaheim approved and signed said Resolution No. 7167 on the 5th day of September, 1961. (SEAL) CITY CLERK OF THE CITY OF ANAHEIM BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and de- termined to be necessary and proper. That the owners of subject property pay to the City of Anaheim the sum of $2.00 per front foot, along Katella Avenue, for street lighting purposes. 8. That Conditions Nos. 1, 2(b) and 7, above mentioned, be complied with within a period of 90 days from date hereof, or such further time as the City Council may grant.
