1961-7128RESOLUTION NO. 7128 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING CONDITIONAL USE PERMIT NO. 134. WHEREAS, the City Planning Commission of the City of Anaheim did receive an application from John Krajacic for a Conditional Use Permit to construct and operate a 22 -unit motel on the following described property situated in the City of Anaheim, County of Orange, State of California, to wit: That portion of the Southeast quarter of Section 7, Township 4 South, Range 10 West, S. B. B. M., in the Rancho Los Coyotes, as shown on a Map recorded in Book 51, Page 10 of Miscellaneous Maps, records of Orange County, California, described as follows: Beginning at a point on the Southerly line of Lot 51 of Tract No. 2625, as shown on a Map recorded in Book 94, pages 9 to 11, inclusive of Miscellaneous Maps, records of Orange County, California, distant North 89 Olt 59" East 265.02 feet from the Southwest corner of Lot 54 of said Tract No. 2625; thence South 0 16 57" East 246.00 feet to the Northerly Line of Lincoln Avenue, as shown on said Map of Tract No. 2625; thence North 89 Olt 59" East 91.54 feet along said Northerly line to the Southerly prolongation of the Easterly line of Lot 50 of said Tract No. 2625; thence North 0 16t 20" West 246.01 feet to the Southeast corner of said Lot 51; thence South 89° 01' 59" West 91.57 feet to the point of beginning. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said application on July 10, 1961, notices of which said public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, investigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. 2-- Series 1961 -62, denying Conditional Use Permit No. 1311; and WHEREAS, thereafter, within twenty (20) days from the date of the adoption of said resolution, a written appeal was filed with the City Council protesting the action of the City Planning Commission in denying said Conditional Use Permit, and said appeal was set for public hearing on August 15, 1961, at the City Hall, in the City of Anaheim, and notices of such public hearing were duly given as required by law and the pro visions of Title 16, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said nubile hearing, the City Council did duly hold and conduct such hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and -1- WHEREAS, the City Council finds, after careful con- sideration of the recommendations of the City Planning Commis- sion and all evidence and reports offered at said hearing, that: 1. The proposed use is properly one for which a Conditional Use Permit is authorized by the Anaheim Municipal Code. 2. The proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 3. The size and shape of the site proposed for the use is adequate to allow the full develop- ment of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare. The traffic generated by the proposed use will not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area. 5. The granting of the Conditional Use Permit under the conditions imposed will not be detrimental to the peace, health, safety, and general welfare of the citizens of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by ',he City Council of the City of Anaheim that the action of the City Planning Commis- sion denying said Conditional Use Permit be, and the same is, hereby disapproved, and that Conditional Use Permit No.134 be, and the same is, hereby granted to John Krajacic permitting the construction and operation of a 22 -unit motel on the property hereinabove described subject to the following conditions: 1. That a 35 -foot front yard setback shall be established on Lincoln Avenue. 2. That all buildings erected on subject property shall be limited to one story in height. 3. That landscaping shall be provided and maintained in the front setback area; and that the plans for said landscaping shall be submitted to and approved by the Superintendent of Parkway Maintenance of the City of Anaheim. 4. That plans for the development of subject property shall be submitted to and approved by the City Council. 5. That the owner of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot, along Lincoln Avenue, for street lighting purposes. 6. That sidewalks and driveways shall be installed as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer. 7. That the owner of subject property shall deed to the City of Anaheim easements for public utility purposes along the exterior boundaries of said property as determined and required by the Utilities Director of the City of Anaheim. 8. (a) That a masonry wall, six feet in height, shall be constructed along the northerly and westerly boundaries of subject property, the wall on the westerly boundary to be constructed within a period of two years from date hereof, in the event that the property abutting subject property on the west is developed for residential use, and the wall on the northerly boundary of subject property to be constructed when required by the City Council. (b) That a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the construction of the wall along the westerly boundary of subject property within a period of two years from date hereof, or such further time as the City Council may grant. 9. That Conditions Nos. 5, 7 and 8(b) above mentioned shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. The City Council hereby reserves the right to revoke such Conditional Use Permit for good cause or failure of said owner, his heirs, successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein.
