1961-7127RESOLUTION NO. 7127 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No. 61 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon, the Planning Commission did duly adopt a resolu- tion containing a report of its findings, a summary of the evi- dence presented at said hearing and a recommendation that the proposed amendment be adopted by the City Council and that cer- tain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Plan- ning Commission, the City Council did fix the 15th day of August 1961 as the time, and the City Council Cham- bers in the City Hall in the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, here- inafter described, from the zone in which it is now situated and the incorporation thereof in the zone hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of said Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did there- upon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated, and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby amended, and that the following des cribed property, situated in the City of Anaheim, County of Orange, State of California, to wit: -1- 61 -62 -6 That portion of the Southeast quarter of the Southeast quarter of the Northwest quarter of Section 27, Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, City of Anaheim, County of Orange, State of California, as said section is shown on a map recorded in Book 51, Page 10 of Miscellaneous Maps, in the office of the County Recorder of said county, described as follows: Beginning at the southeast corner of said Northwest quarter, said point being the intersection of the center line of Harbor Boulevard and Orangewood Avenue; thence along the Southerly line of said Northwest quarter and the center line of said Orangewood Avenue, South 89 43' 23" West 666.85 feet to the Westerly line of said Southeast quarter of the Southeast quarter of the Northwest quarter; thence along said westerly line, North 1 13 08" West 353.05 feet, more or less, to a line parallel with and distant 353.00 feet northerly, measured at right angles from said center line of Orangewood Avenue, said point being the true point of be inning; thence along said parallel line North 89 43' 23" East 265.04 feet more or less, to a line parallel with and distant 265.00 feet; Easterly, measured at right angles from said Westerly line; thence along said parallel line North 1 13' 08" West 106.00 feet; thence parallel with said center line of Orangewood Avenue; North 89 43' 23" East 400.72 feet, more or less, to said center line of Harbor Boulevard; thence along said center line North 1 21' 07" West 200.93 feet to the north line of said Southeast quarter of the Southeast quarter of the Northwest quarter; thence South 89 43' 37" West 665.32 feet along the North line of said Southeast quarter of the Southeast quarter of the Northwest quarter to the Northwest corner thereof; thence along said westerly line, South 1 13' 08" East 306.97 feet, more or less, to the point of beginning. EXCEPT any portion thereof which is not included within the Southeast quarter of the Southeast quarter of the Northwest quarter of Section 27, Township 4 South, Range 10 West, as said section would be developed from a center as described in Case No. 40910 in the Superior Court of Orange County, California a certified copy of the decree was recorded August 1, 1943 in Book 1208, Page 287, Official Records, and in Case No. 41055 in the Superior Court of Orange County, California, a certified copy of the decree was recorded February 14, 1951 in Book 2144, Page 174, Official Records. Said center being shown on a map filed in Book 24, Page 22 of Records of Surveys, in the office of the County Recorder of said county. ALSO EXCEPT that portion of the North 175.00 feet thereof, measured from the northerly line of the last described exception, lying Easterly of a line parallel with said Harbor Boulevard, and distant westerly 470.32 feet measured at right angles from the center line of said Harbor Boulevard; -2- be excluded from R -A, RESIDENTIAL- AGRICULTURAL ZONE to C -1, NEIGHBORHOOD COMMERCIAL ZONE, upon the following conditions: 1. That subject property be landscaped, and that plans for said landscaping and the water supply system for such landscaping, be presented to and approved by the Superintendent of Parkway Main- tenance of the City of Anaheim. 2. That the owners of subject property pay to the City of Anaheim the sum of $2.00 per front foot, along Harbor Boulevard, for street lighting purposes. 3. (a) That sidewalks and driveways be installed as required by the City Engineer and in accordance with standard plans and specifications on file in the office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim be posted with the City to guarantee the installation of said sidewalks and driveways. 4. That Conditions Nos. 2 and 3, above mentioned, be complied with within a period of 90 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal• Code to accomplish the objects herein found and de- termined to be necessary and proper.
