1961-7126RESOLUTION NO. 7126 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No. 61 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon, the Planning Commission did duly adopt a resolu- tion containing a report of its findings, a summary of the evi- dence presented at said hearing and a recommendation that the proposed amendment be adopted by the City Council and that cer- tain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Plan- ning Commission, the City Council did fix the 15th day of August 19 61 as the time, and the City Council Cham- bers in the City Hall in the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, here- inafter described, from the zone in which it is now situated and the incorporation thereof in the zone hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of said Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did there- upon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated, and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby amended, and that the following des- cribed property, situated in the City of Anaheim, County of Orange, State of California, to wit: -1- 61 -62 -5 PARCEL 1: The Easterly 75 feet of the Southerly 160 feet of Lot 4 in Tract 153, in the City of Anaheim, County of Orange, State of California, as per map recorded in Book 11, Page 46, Miscellaneous Maps, in the office of the County Recorder of said Orange County. PARCEL 2: That portion of Lot 4 in Tract 153, in the City of Anaheim, County of Orange, State of California, as per map recorded in Book 11, Page 46, Miscellaneous Maps, in the office of the County Recorder of said Orange County, described as follows: Beginning at the Northeasterly corner of the land conveyed to Florence McIntyre and others, by deed recorded April 19, 1955, in Book 3035, Page 83, Official Records, in the office of the County Recorder of said Orange County; and running thence Northerly along the Easterly line of said lot to the Southeast corner of the land conveyed to Glenn G. Fry and others, by deed recorded March 29, 1955, in Book 3012, Page 442, Official Records, in the office of the County Recorder of said Orange County; thence Westerly along the Southerly line of said land, 125 feet more or less, to the Northerly prolongation of the Westerly line of the land conveyed to L. D. Steers and wife, by deed recorded April 4, 1955, in Book 3018, Page 547, Official Records, in the office of the County Recorder of said Orange County; thence Southerly along the Northerly prolongation of said Westerly line to the Northwesterly corner of said land conveyed to L. D. Steers; thence Easterly along said Northerly line, 50 feet to the Westerly line of the land conveyed to Florence McIntyre and others, by deed above mentioned; thence Northerly along said Westerly line, 10 feet to the Northwesterly corner thereof; thence Easterly along the Northerly line thereof, 75 feet to the point of beginning; be excluded from the R -A, RESIDENTIAL- AGRICULTURAL ZONE, and incorporated in R -3, MULTIPLE FAMILY RESIDENTIAL ZONE upon the following conditions: 1. That subject property be developed substantially in accordance with the plans presented to the City Council and on file with the City of Anaheim, indicating one -story construction. 2. That the owner of subject property deed to the City of Anaheim a strip of land 32 feet in width, from the center line of the street, along Sycamore Street for street widening purposes. ATTEST: 3. That the owner of subject property pay to the City of Anaheim the sum of $2.00 per front foot, along Sycamore Street, for street lighting purposes. 4. (a) That sidewalks and driveways be installed as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim be posted with the City to guarantee the installation of said sidewalks and driveways. 5. That the owner of subject property pay to the City of Anaheim the sum of $25.00 per dwelling unit, to be used for park and recreation purposes, said amount to be paid at the time the building permit is issued. 6. That landscaping be provided and maintained in the front setback area of the duplex presently located on subject property, and that plans for said landscaping be submitted to and approved by the Superintendent of Parkway Maintenance of the City of Anaheim. 7. That off street parking facilities be provided in accordance with the plans presented to the City Council and on file with the City of Anaheim, and that parking be prohibited in the front yard setback area. 8. That Conditions Nos. 2, 3, and 4 (b) above mentioned be complied with within a period of 90 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
