1961-7105RESOLUTION NO. 7105 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING CONDITIONAL USE PERMIT NO. 139. WHEREAS, the City Planning Commission of the City of Anaheim did receive an application from Robert P. Ralls, M.D., for a Conditional Use Permit to construct and operate a hospital in conjunction with a medical center on the following described property situated in the City of Anaheim, County of Orange, State of California, to wit: The west half of the northeast quarter of the southwest quarter of the northwest quarter of Section 16, Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, City of Anaheim, County of Orange, State of California, being the west half of Lot 11 of Helen and Lynch's Subdivision of the west half of Section 16, Township 4 South, Range 10 West, as per map recorded in Book 442, Page 158 of Deeds of Los Angeles County, in the office of the County Recorder of said Los Angeles County, the east line of the above described land being the same as the west line of the land con- veyed by Charles Schindler and wife, to Nettie Eygabroad by deed recorded March 15, 1909, in Book 163, Page 387 of Deeds. EXCEPT that portion thereof described as follows: Beginning at the northeast corner of said land; thence west 170.00 feet along the north line of said land; thence South 350.00 feet; thence east 170.00 feet to the east line of said land; thence north 350.00 feet to the point of beginning. ALSO EXCEPT from the remainder of said land the most northerly 250.00 feet thereof. AND WHEREAS, the =City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said application on July 10, 1961, notices of which said pub- lic hearing were duly given as required by law and the pro- visions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, investigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. 8 Series 1961 -62, granting Conditional Use Permit No. 139 upon the conditions therein set forth; and WHEREAS, thereafter, within twenty (20) days from the date of the adoption of said resolution, a written appeal was filed with the City Council protesting the action of the City Planning Commission in granting said Conditional Use Permit, and said appeal was set for public hearing on August 8, 1961, at the City Hall, in the City of Anaheim, and notices of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council finds, after careful con- sideration of the recommendations of the City Planning Commis- sion and all evidence and reports offered at said hearing, that: 1. The proposed use is properly one for which a Conditional Use Permit is authorized by the Anaheim Municipal Code. 2. The proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 3. The size and shape of the site proposed for the use is adequate to allow the full develop- ment of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare. 4. The traffic generated by the proposed use will not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area. 5. The granting of the Conditional Use Permit under the conditions imposed herein will not be detrimental to the peace, health, safety, and general welfare of the citizens of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commission granting said Conditional Use Permit be, and the same is, hereby sustained; and that said Conditional Use Permit No. 139 be, and the same is, hereby granted permitting the con- struction and operation of a hospital in conjunction with a medical center on the property hereinabove described subject to the following conditions: 1. That subject property shall be developed sub- stantially in accordance with the plans presented to the City Council and on file with the City of Anaheim for the immediate development only, with the exception that the building shall be set back ten (10) feet in order to provide a 30 -foot The City Council hereby reserves the right to revoke such Conditional Use Permit for good cause or failure of said owner, his heirs, successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein. THE FOREGOING RESOLUTION is approved and signed by me this 8th day of August, 1961. ATTEST: clearance between the northeast corner of the building and the property line; and that any future development of subject property shall be subject to the filing with the City of a petition, outlining said future expansion, in accordance with the requirements of the Anaheim Municipal Code. 2. That a 6 -foot masonry wall shall be constructed along the south side of subject property. That 6 -foot masonry walls shall be constructed along the west and east sides of said property in the event the adjacent properties are developed for other than commercial purposes; and that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the construction of said walls along said east and west sides of subject property when and if the adjacent properties are developed for other than commercial purposes, but, in any event, within a period of two (2) years from date hereof, or such further time as the City Council may grant.
