A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM
DENYING VARIANCE NO. 1370
WHEREAS, the City Planning Commission of the City of Anaheim
did receive a petition for zoning variance from Theresia Kittelberger,
owner of certain real property
situated in the City of Anaheim, County of Orange, State of California,
described as follows:
Lot 15 in Block "B" of Tract No. 372 as per map
recorded in Book 15, Page 18 of Miscellaneous
Maps, Records of Orange County, California
AND WHEREAS, the City Planning Commission did hold a public
hearing at the City Hall in the City of Anaheim on June 12,
1961 notice of which said public hearing was duly given as required
by law and the provisions of Title 18, Chapter 18.76 of the Anaheim
Municipal Code; and
WHEREAS, said City Planning Commission, after due inspection,
investigation and studies made by itself and in its behalf, and after
due consideration of all evidence and reports offered at said hearing,
did adopt Resolution No. 282 Series 1960-61 denying
Variance Nn_ 1170 and
WHEREAS, thereafter, within twenty (20) days from the date of
the adoption of said resolution, a written appeal was filed with the
City Council of the City of Anaheim protesting the at4n of the City
Planning Commission denying said variance, and^`baid appeal was
set for public hearing on August 1 1961 at 7:00
o'clock P.M. at the City Hall in the City of Anaheim, and notice of
such public hearing was duly given as required by law and the provi-
sions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and
WHEREAS, after due investigation and studies made by itself
and in its behalf, and after due consideration of all the evidence and
reports offered at said hearing, the City Council does find and de-
termine that:
1. There is no substantial property right possessed by other
property in the same vicinity and zone and denied the
subject property.
2. It appears that the subject property can be adequately
developed and used under the present zone.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim that the action of the City Planning Commission

denying Variance No. 1370, be and the same is hereby sustained,
and that the petition of Theresia Kittelberger for permission
to expand an existing second unit located on the rear of the
property hereinabove described be, and the same is hereby, denied.
BE IT FURTHER RESOLVED that the City Planning Commission
be and it is hereby requested to make a study of the area from the
westerly boundary of the alley just east of Los Angeles Street to
the easterly boundary of the alley just west of Olive Street, and
from Water Street to South Street in the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by me
