A RESOLUTION OF THE CITY OOUNCIL OF THE
CITY OF ANAHEIM AUTHORIZING THE COMPROMISE
OF CERTAIN EMINENT DOMAIN LITIGATION.
WHEREAS, heretofore, by its Resolution No. 62R -25
the City of Anaheim authorized and directed the initiation
of condemnation proceedings which resulted in the commence-
ment of Orange County Superior Court Case No. 1013)i)i, being
entitled "City of Anaheim vs. Stern Realty Company, a corpo-
ration, et al. and
WHEREAS, the defendant, Stern Realty Company, in
lieu of the City of Anaheim taking the entire parcel set
forth in said Superior Court Case is willing to grant to
said City an easement deed covering the southerly ninety
feet (90) thereof for the sum of $2,000.00; and
WHEREAS, the City Council of the City of Anaheim
finds that the said southerly ninety feet (90') of the
property sought to be condemned is sufficient to fulfill
the needs of the City, and that the sum of $2,000.00 is a
fair and reasonable amount therefor and the acceptance of
the offer to grant said easement deed is in the best inter-
est of the City of Anaheim;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the Finance Director be, and she
is hereby, authorized and directed to deliver to the City
Attorney's office the sum of $2,000.00, payable to Stern
Realty Company, to be paid by the City Attorney to said
Stern Realty Company when, in his opinion, the City Attorney
holds a good and sufficient corporation easement deed of
said Stern Realty Company to the City of Anaheim covering
the following described property:
An easement for road and public utility purposes
over, under and across that portion of Lot 42 of
the Hazard Subdivision, as shown on a Map filed
in Book 1, page 26 of Licensed Surveys, records
of Orange County, California, lying parallel with
and 15.00 feet on each side of the following des-
cribed line:
Beginning at the Southeast corner of that parcel of
land conveyed to B. H. Prentiss and Gladys Fern
Prentiss, husband and wife, by deed recorded April 13,
1943 in Book 1188, page 175 of Official Records of
Orange County, California; thence Easterly along
the Easterly prolongation of the South line of the
land conveyed to said B. H. Prentiss and Gladys
Fern Prentiss, to the intersection with the East
line of said Lot L..2 of the Hazard Subdivision.
EXCEPTING THEREFROM any portion thereof lying
within the Santa Fe Railway Company right of way.
BE IT FURTHER RESOLVED that the City Council of the
City of Anaheim does hereby accept the conveyance of the
aforementioned grant of easement.

AND BE IT FURTHER RESOLVED that the City Attorney
prepare an agreement between the City of Anaheim and Stern
Realty Company embodying the following terms and conditions:
1. The City of Anaheim shall pay, the amount of monies
deemed,necessary to acquire the 90.00 foot easement,
not to exceed the amount of $2,000.00.
2. The easement deed shall be used as a part of the
extension of Anaheim Road.
The City of Anaheim shall bear all costs and
expenses of any kind or nature, of engineering,
grading, excavation and paving of said Anaheim
Road:to a 48 foot travelway.
