1962-0033RESOLUTION NO, 62R-33 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUND- ARIES OF CERTAIN ZONES SHOULD BE CHANGED WHEREAS, the City Planning Commission of the City of Anaheim has heretofore duly passed and adopted a resolution recommending denial of a change in the boundaries of the zone or zones hereinafter mentioned and described, after having fixed a time and place for the holding of a public hearing thereon in the manner and as prescribed in Title 18 of the Anaheim Municipal Code, and after having duly held and conducted such public hearing to consider said proposed change of zone or zones, and after having received evidence and reports from persons interested therein; and WHEREAS, within a period of forty (40) days following the hearing thereon, the Planning Commission did duly announce by formal resolution its.findings of facts and declare its opinions and reasons for recommending denial of said proposed change in the boundaries of the zone or zones hereinafter mentioned and described; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Plan- ning Commission the City Council did fix the 2nd day of January 1q62, as the time, and the City Council Chambers in T177117THall in the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone in which It is now situated and the incorporation thereof in the zones hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of said Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did there- upon consider the summary of evidence presented at said public hearing before the Planning CoMmission, its report of findings and recommendations; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated, and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby amended, and that all of the property and area situated in the City of Anaheim, County of Orange, State of California, described as follows -1- 61-62-49 Lot 100 of Tract No. 1453, as shown on a Map recorded in Book 42, pages 41 and 42 of Mis- cellaneous Maps, records of Orange County, California. be excluded from the R -1, ONE FAMILY RESIDENTIAL ZONE, and in- corporated in the C.1, NEIGHBORHOOD COMMERCIAL ZONE, upon the following conditions: 1. That subject property shall be developed sub- stantially in accordance with the plans filed with the application for said change of zone, and on file with the City of Anaheim. 2. That the existing residential structures on subject property shall either be removed or developed to commercial standards, and, in the latter case, final building or remodeling plans shall be submitted to, and approved by, the City Council. 3. That a landscaped strip of a minimum width of six feet shall be provided abutting the front property line; that plans for landscaping said strip shall be submitted to and approved by the Superintendent of Parkway Maintenance of the City of Anaheim; and that said landscaping shall be installed prior to final building in- spection. 4. (a) That 6 -foot masonry walls shall be constructed along the northerly and southerly boundaries of subject property where said property abuts R-1, One Family Residential Zone property; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the construction of said walls when required by the City Engineer, but, in any event, within a period of 2 years from date hereof. 5. That a 50 -foot minimum building setback, from the westerly boundary of the alley at the rear of sub- ject property, shall be established and maintained for any two -story structures erected on subject property, and no windows shall be permitted in the rear of the second story of any such two -story buildings. 6. That any signs proposed to be installed on subject property, other than unlighted signs having a max- imum area of eight square feet, shall be submitted to and approved by the City Council. 7. That the owner of subject property shall place of record City of Anaheim C -1 Deed Restrictions, ap- proved by the City Attorney, which restrictions shall limit the uses of subject property to business and professional offices only. 8. That off-street parking facilities shall be pro- vided as required by the Anaheim Municipal Code prior to final building inspection. ATTEST: 9. That the owner of subject property shall deed to the City of Anaheim a strip of land 45 feet in width, from the center line of the street, along Harbor Boulevard for street widening purposes. 10. That any residential structures located on subject property shall not be used for commercial nor com- bined commercial and residential purposes unless remodeled to commercial standards. 11. That'the owner of subject property shall deed to the City ofAnaheim a strip Of land 7' feet in width along" the-rear or West `side of subject property for alley wideninglpurposes. 12. That the owner of subject property shall dedicate to the City of Anaheim all vehicular access rights to Harbor Boulevard. 13. That the owner of subject property shall: (a) Improve the alley along the rear or west side of subject property to com- mercial standards as required by the City Engineer, and in accordance with standard plans and specifications on file in the Office of the City Engineer, or (b) Deposit with the City of Anaheim, in lawful money of the United States or in negotiable securities endorsed payable to the City of Anaheim, the amount estimated by the City Engineer to cover the cost of improving said alley. 14. That Conditions Nos. 4(b), 7, 9, 11, 12 and 13(b), above mentioned, shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby, authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
