RESOLUTION NO. 62R -14
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM AMENDING RESOLUTION NO.
7446 GRANTING CONDITIONAL USE PERMIT
NO. 175.
WHEREAS, the City Council of the City of Anaheim did
heretofore, to wit, on December 12, 1961, adopt Resolution No.
7446 granting Conditional Use Permit No 175, permitting the
establishment of a de luxe garden -type multiple- family resi-
dential development on the property described in said resolu-
tion, subject to certain conditions set forth therein; and
WHEREAS, one of the provisions of Condition No. 2
of said Conditional Use Permit requires the owner of subject
property to develop the same in accordance with Exhibits 1, 2
3, 4, 5 and 6, as amended, on file with the City of Anaheim,
which plans or exhibits provide for the construction of a
fence along the front property line; and
WHEREAS, the City Council finds that under the pro-
visions of the Anaheim Municipal Code a 15 -foot minimum front
yard building setback is required along Magnolia Avenue, and
that Conditional Use Permit No. 175 should, therefore, be
amended by waiving the minimum front yard building setback
requirement along Magnolia Avenue to permit the construction
of a solid wall or fence, of a maximum height of 6 feet, along
the front property line.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that Resolution No. 7446 granting Conditional
Use Permit No. 175 be, and the same is hereby amended by waiv-
ing the 15 -foot minimum front yard building setback requirement
along Magnolia Avenue solely to permit the construction of a
solid wall or fence, of a maximum height of 6 feet, along the
front property line.
BE IT FURTHER RESOLVED that in all other respects
said Resolution No. 7446 be, and remain in full force and
effect.
THE FOREGOING RESOLUTION is approved and signed by
me this 2nd day of January, 1962.
