1961-7453RESOLUTION NO. 7453 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ACKNOWLEDGING RECEIPT OF A PETITION FOR THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY TO THE CITY OF ANAHEIM, DESIGNATING THE TERRITORY AS THE PERALTA HILLS ANNEXATION DESCRIBING THE BOUNDARIES OF THE TERRITORY PROPOSED TO BE ANNEXED AND GIVING NOTICE OF THE DAY, HOUR AND PLACE WHERE AND WHEN ANY PERSON OWNING REAL PROPERTY WITHIN SUCH TERRITORY SO PROPOSED TO BE ANNEXED MAY APPEAR BEFORE THE CITY COUNCIL AND SHOW CAUSE WHY SUCH TERRITORY SHOULD NOT BE ANNEXED TO THE CITY OF ANAHEIM, WHEREAS, the City Council of the City of Anaheim did on the 12th day of Derem1 .r 19 (1 receive a written petition asking that certain new territory described in said petition be annexed to the City of Anaheim; and WHEREAS, before the filing of said petition, the proposal for the annexation of the territory hereinafter described to the City of Anaheim was submitted to the Boundary Commission of the County of Orange, State of California, and reported upon by said Boundary Commission with respect to the definiteness and certainty of the proposed boundaries; and WHEREAS, said territory proposed to be annexed to said City of Anaheim is situated in the County of Orange, State of California, and is contiguous to the City of Anaheim and is uninhabited territory, and said petition contained a description of said territory in words and figures as hereinafter in this Resolution described; and WHEREAS, the City Council finds from evidence and reports received that at the time of the filing and receipt of said petition, it was and now is signed by owners of not less than one fourth of the land in the territory by area and by assessed value in the territory proposed to be annexed, according to the last preceding equalized county assessment roll; and WHEREAS, the City Council finds from evidence and reports received and from said petition that at the time of the filing and presentation of said petition that said new territory proposed to be annexed to said City of Anaheim did not form a part of any municipal corporation and that said territory was uninhabited and is contiguous to the City of Anaheim; and WHEREAS, the City Council finds from said petition and evidence and reports received that the boundaries of the territory so proposed to be annexed to the City of Anaheim are as follows, to wit: PERALTA HILLS ANNEXATION That parcel of land located within the County of Orange, State pf Cell- fornia, described as follows: Beginning at a point in the existing City Limit line of the City of Anaheim, as established by the Northeast Annexation #2-A to the City of Anaheim, passed by Ordinance No. 1269, August 12, 1958 and filed with the Secretary of State September 12, 1958, said point of beginning being the Northwest corner of Lot One of Tract No. 58, as shown on Man recorded in Book 10, page 6 of Miscellaneous Naps, records of Orange County, Cali- fornia; thence North 51° 06' West 130 feet, more or less, along said existing City Limit line of the City of Anaheim to the intersection with a line 26.00 feet Northerly of the center line of the Santa Ana Valley Irrigation Company Canal, as said center line is shown on Record of Survey Map filed in Book 4, page 45 of Record of Surveys in the office of the County Recorder of Orange County, California; thence 2, Leaving said existing City Limit line of the City of Anahein as estab- lished by the aforementioned Northeast Annexation #2-A, North 40 14' East 25.67 feet, along a line parallel with and 26.00 feet Northerly of the center line of said Santa Ana Valley Irrigation Company Canal, to the beginning of a tangent curve concave Southeasterly having a radius of 501.00 feet; thence 3. Northeasterly along said curve through a central angle of 11 02' an are distance of 96.50 feet to the intersection with a line parallel with and 147.67 feet Westerly of the East line of Lot 21 and Lot 20 of the J. D. Taylor Tract, as said J. D. Following along the Easterly and Northerly line of the above mentioned parcel of land conveyed to said Warren J. Kraft and Carrell B. Kraft, husband and wife, the following courses and distances: North 20 53' 40" West 153.52 feet; thence North 45 43' 30" Vest 80.54 feet; thence South 48 27' 30" West 304.98 feet to an angle point in the Southwesterly line of said Lot Two of the aforementioned Tract No. 58, said Southwesterly line also being the existing City Limit line of the City of Anaheia, as established by the aforementioned Northeast Annexation #2 -A; thence 13. Following along a portion of the Westerly line of said Lot Two and the Westerly line of Lot One of said Tract No. 58, and the existing City Limit line of the City of Anaheim, the following courses and distances: North 44 37' West 272.40 feet; thence North 25 22' West 240.85 feet to the Southwest corner of Lot One of said Tract No. 58; thence North 25 22' West 8.45 feet; thence North 52 05' West 376.29 feet; thence North 39 54' West 259 feet, more or less, to the point of beginning. lintitxxxftmximaringsmasymiximxtlumarnfnmemzpxlimedsxrafxtimximplixgbasErippt±lam forxt x ximmmximaxxxiMm ndx xx rx*axtimm haxsxm -5- NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that such proposed annexation be designated as PERALTA HILLS ANNEXATION and that notice of such proposed annexation be hereby given as hereinafter provided, BE IT FURTHER RESOLVED that a public hearing shall be had upon the date set, not less than forty (40) nor more than sixty (60) days after the passage of this resolution, unless the owner or owners of all of the territory to be annexed have petitioned for annexation or filed their consents to such annexation, in writing, with the City Council in which event the hearing shall be set at any time after compliance with Section 35311 of the Government Code. AND BE IT FURTHER RESOLVED that `the City Council does find that the owner or owners of all of the territory proposed to be annexed have not petitioned for annexation or filed their con- sents to such annexation, in writing, with the City Council. BE IT FURTHER RESOLVED that the 6th day of February 196 2 at the hour of 7:00 Oclock the City Council Chamber in the City Hall of the City of Anaheim be, and the same is hereby, fixed as the day, hour and place when and where the City Council will hear protests made by any owner or owners of real pro- perty within the territory proposed to be annexed; and that at any time before the hour set for hearing objections, any owner of pro- perty within said territory may file with the City Clerk a written protest against the annexation. Said protest shall be in writing and shall state the name of the owner of the property affected and the description and area of the property in general terms. BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby, authorized and directed to publish or cause to be published a copy of this resolution pursuant to Section 6066 of the Government Code of the State of California, in a newspaper of general circulation published in the territory proposed to be annexed to the City of Anaheim, or if there is none, in a newspaper of general circulation published in the City; and that such publication shall be made once a week for two successive weeks with at least five days intervening between the respective publication dates, not counting such publication dates, and that said period of notice shall commence upon the first day of publication and terminate at the end of the fourteenth day, including therein the first day. AND BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby, authorized end directed to cause written notice of such proposed annexation to be mailed to each owner of an equitable or legal interest in land, other than an easement or right of way, in the territory proposed to be annexed, who has filed his or her name and address and the general description of such land sufficient to identify it on the last equalized assessment roll, with said Clerk, and that said notice shall be mailed not less than twenty (20) days before the first public hearing on the proposed annexation; and in the event that land within the territory proposed to be annexed to the City of Anaheim is owned by a county, the City Clerk shall cause written notice of such proposed annexation to be mailed to the Board of Supervisors of such county, and such notice shall be given not less than twenty (20) days before the first public hearing on the proposed annexation.
