A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM FINDING AND DETERMINING
TILT TITLE 18 OF THE ANAHEIM MUNICIPAL
CODE RELATING TO ZONING SHOULD BE AMENDED
AND THAT THE BOUNDARIES OF CERTAIN ZONES
SHOULD BE CHANGED.
WHEREAS, the City Planning Commission of. the City of
Anaheim did hold a public hearing in Reclassification Proceed-
ings No, 61 -62 4 to consider an amendment to
Title 18 of the Anaheim Municipal Code relating to zoning and
to consider a change in the boundaries of the zone or zones
hereinafter mentioned and described, and at said hearing did
receive evidence and reports from iirsons interested therein
and from its staff; and
WHEREAS, within a period of forty days following said
hearing thereon, the Planning Commission did duly adopt a resolu-
tion containing a report of its findings, a.. summary of the evi-
dence presented at said hearing and a recommendation that the
proposed amendment be adopted by the City Council and that ,e--
tain. zone or zones be changed as hereinafter set forth; and
WHEREAS, upon receipt of said resolution, summary of
evidence, report of findings and recommendation of the City Plan-
ning Commission, the City Council did fix the 12th day of
December 19 61 as the time, and the qty Council 'ham-
bers in the City Ha I In the City of Anaheim as the place fur a
public hearing upon said proposed amendment to Title 18 of the
Anaheim Municipal Code, and the exclusion of said property, here-
inafter described, from the zone in which it is now situated and
the incorporation thereof in the zone hereinafter set forth;
and did give notice thereof in the manner and form as provided
in said Title 18 of said Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said public
hearing, the City Council did hold and conduct such public hear-
ing and did give all persons interested therein an opportunity
to be heard and did receive evidence and reports and did there-
upon consider the summary of evidence presented at ,aid public:
hearing before the Planning Commission, its report of C ndings,
and recommendation; and
WHEREAS, the City Council does find and determine that
the amendment to Title i8 of the Anaheim Municipal Code should
be adopted and that the property hereinafter described should
be excluded from the zone or zones in which it is now situated,
and incorporated in the zone or zones as hereinafter set forth;
NOW, THEREFORE, BE IT RESOLVED by the City Council.of
the City of Anaheim that Tile 18 of the Anaheim Municipal Code
be, and the same is hereby amended, and that the following des-
cribed property, situated in the. City of Anaheim, County of
Orange, State of California, to wit:
61 -62
That portion of lot 14 of Anaheim Extention,
in the city of Anaheim, county of Orange,
state of California, as shown on a survey
by William Hamel, a copy of which is filed
in the office of the County Recorder of
Orange County, California, in book 3 pages
163 and following entitled "Los Angeles
County Maps" shown as not a part of this
subdivision" on a map of Tract No. 1697
recorded in book 59 pages 43, 44 and 45 of
Miscellaneous Maps, records of Orange County,
California, bounded by East Santa Ana Street,
Placentia Avenue and Lots 104 through 116,
as shown on said map of Tract No. 1697.
EXCEPT therefrom one -half of Santa Ana Street,
75 links wide.
be changed from R -A, RESIDENTIAL AGRICULTURAL ZONE to the fol-
lowing zones, upon the conditions hereinafter set forth:
That that portion of the above described property
described as follows, be changed to C -3, HEAVY
COMMERCIAL ZONE:
Beginning at the northeast corner of said lot 14
as shown on said map of Tract No. 1697; thence
westerly 135.00 feet along the southerly line
of said East Santa Ana Street; thence southerly
at right angles with said East Santa Ana Street
to a line parallel with said southerly line of
East Santa Ana Street and 130.00 feet southerly
measured along the westerly line of said Placentia
Avenue from said Northeast corner of lot 14;
thence Easterly along said parallel line to said
westerly line of Placentia Avenue; thence northerly
130.00 feet to the point of beginning.
EXCEPT therefrom one -half of Santa Ana Street,
75 links wide.
and that the remainder of subject property be
changed to C -1, NEIGHBORHOOD COMMERCIAL ZONE,
upon the following conditions:
1. That subject property shall be developed substantially
in accordance with plans marked "Exhibit 1," as
amended to provide parking area in accordance with
Anaheim Municipal Code requirements, said plans being
on file with the City of Anaheim.
2. That landscaping shall be provided and maintained
in the parkway portion of Placentia Avenue and
Santa Ana Street abutting subject property; that
plans for said landscaping shall be submitted to
and approved by the Superintendent of Parkway
Maintenance; and that said landscaping shall be
installed prior to final building inspection; pro-
vided, however, that said landscaping shall not be
applicable to the existing service station area.
3. That the owners of subject property shall deed to
the City of Anaheim a strip of land 53 feet in

width, from the center line of the street,
along Placentia Avenue for street widening
purposes, and a strip of land 30 feet in
width from the center line of the street,
along Santa Ana Street for street widening
purposes.
L. (a) That all engineeringrequirements of the
City of Anaheim, along Placentia Avenue and
Santa Ana Street, such as curbs and gutters,
sidewalks, street grading and paving, drainage
facilities, or other appurtenant work shall be
complied with as required by the City Engineer
and in accordance with standard plans and speci-
fications on file in the Office of the City
Engineer; and (b) that a bond in an amount and
form satisfactory to the City of Anaheim shall
be posted with the City to guarantee the instal-
lation of said engineering requirements.
5. That the owners of subject property shall pay
to the City of Anaheim the sum of $2.00 per
front foot along Placentia Avenue and Santa
Ana Street, for street lighting purposes.
6. That 6 -foot masonry walls shall be constructed
along the southerly and westerly boundary lines
of subject property where said property abuts
R -1, ONE FAMILY RESIDENTIAL ZONE, property,
and that said walls shall be constructed prior
to final building inspection.
7. That the owners of subject property shall place
of record City of Anaheim C -1 Deed Restrictions,
approved by the City Attorney, covering the C -1
portion of subject property, which restrictions
shall limit the uses of the C -1 property to the
following:
a. Offices (Business, Professional and Real
Estate Agencies)
b. Telephone Answering Services
c. Banks
d. Exhibit Halls (No retail sales from floor)
e. Barber shops or beauty parlors
f. Book and stationery stores
g. Confectionery stores
h. Flower shops
i. Pharmacies and prescriptions
j. Specialty gift shops
k. Tobacco shops
1. Photo shops
m. Laundry agencies or clothes cleaning agencies
n. Medical and dental offices
o. Newsstands
p. Coffee shops not to exceed seating capacity
for 50 persons (No drive -in, or walk -ups,
and no liquor)
q. Shoe repairing shops
r. Medical centers
s. Tailor, clothing or wearing apparel shops
t. Diagnostic laboratories
u. Bakeries
v. Confectionery stores with ice cream
w. Men's, woments and children's apparel shops
x. Studios related to permitted uses in area.
y. Interior decorator studios
z. Neighborhood grocery stores (with limited
floor space of L.!,000 square feet; no
off -sale liquor)
aa. Toy and hobby shops
8. That the reclassification of subject property
under these proceedings is contingent upon the
granting of Conditional Use Permit No. 174.
9. That Conditions Nos. 3, L (h), 5 and 7, above
mentioned, shall be complied with within a
period of 180 days from date hereof, or such
further time as the City Council may grant.
BE IT FURTHER RESOLVED that the City Attorney be,
and he is hereby authorized and directed to prepare and submit
to the City Council an ordinance amending Title 18 of the
Anaheim Municipal Code to accomplish the objects herein found
and determined to be necessary and proper.
THE FOREGOING. RESOLUTION is approved and signed by
me this 12th day of December, 1961.
