1961-7440RESOLUTION NO. 2_4112_ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING VARIANCE NO. 119 WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition for zoning variance from SOUTHERN PACIFIC COMPA owner of certain real pr s tua a ir tie ity of Ana elm ounty of Orange, State of California, described as follows: That portion of Vineyard Lot G -3, in the city of Anaheim, County of Orange, State of California, as per map recorded in book 4, pages 629 and 630 of Deeds, in the office of the county recorder of Los Angeles County, California, described as follows: Beginning at the northeast corner of lot 22 of Tract No. 497, as per map recorded in book 17 page 38 of Miscellaneous Maps, in the office of the county recorder of said Orange County; thence South 15° 31t 30" East along the easterly line of said Tract No. 497 to the most southerly corner of the land described in the deed to the Southern Pacific Railroad Company, recorded March 13, 1899, in book 41 page 372 of Deeds of said Orange County; thence northeasterly 150.00 feet to the southwesterly line of Olive Street 49.50 feet wide as per said map; thence North 15° 31' 30" West along said southwesterly line to the easterly pro- longation of the southerly line of Ellsworth Avenue, as shown on said map of Tract No. 497; thence South 7L° 24' West 150.12 feet to the point of beginning. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said petition on ove ber 13, 1 6 1 notice of which said public hearing was u y given as reequred by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal- Code; and WHEREAS, said City Planning Commission, after due inspection, investigation and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did adopt Resolution No, 138 Series 19 1 -62 recommending that Variance No. 1419 .1aa, d en i qc1 and WHEREAS, thereafter, within twenty -twc (22) days from the date of the adoption of said resolution, a written appeal was filed with the City Council of the City of Anaheim protesting the action of the City Planning Commission dualag said variance, and said appeal was set for public hearing on December 12 1 9 61 at 7:00 o'clock P.M. at the City a n t e ty o Anaheim, and notice of such public hearing was duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, after due investigation and studies made by itself and in its behalf, and after due consideration of all the evidence and reports offered at said hearing, the City Council does find and determine that: -1- 1. There are exceptional or extraordinary circum- stances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zone. 2. That such a variance is necessary for the preserva- tion and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property in question. 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. 4. That the granting of such variance will not adversely affect the comprehensive general zoning plan. NOM, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning variance be and the same is hereby granted permitting the establishment of a bulk storage and wholesale distribution outlet for petroleum products, and offices for sales personnel, on the property hereinabove described, subject to the following conditions: 1. That subject property shall be developed in accordance with plans marked "Exhibits 1, 2 and 3," on file with the City of Anaheim, and by reference made a part hereof; and that all landscaping shown on said plans shall be installed prior to final building inspection. 2. That sidewalks shall be installed, along Ellsworth Avenue, as required by the City Engineer and in ac- cordance with standard plans and specifications on file in the Office of the City Engineer. 3. That the sidewalks and curbs along Olive Street shall be repaired as required by the City Engineer. 4. That the owner of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot, along Olive Street, for street lighting purposes. 5. That Coriditions Nos. 2, 3 and 4, above mentioned, shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. The City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owner, its heirs, successors, or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein. Said variance is granted for the term prescribed by the Anaheim Municipal Code unless otherwise specified herein. NOES: COUNCILMEN: Chandler. ABSENT: COUNCILMEN: None. AND I FURTHER CERTIFY that the Mayor of the City of Anaheim approved and signed said Resolution No. 7440 on the 12th day of December, 1961.
