12/17/2024ANAHEIM CITY COUNCIL REGULAR MEETING OF DECEMBER 17, 2024 The regular meeting of December 17, 2024 was called to order at 5:02 p.m. in the Council Chamber of Anaheim City Hall, located at 200 South Anaheim Boulevard. The meeting notice, agenda, and related material were duly posted on December 12, 2024. MEMBERS PRESENT: Mayor Pro Tem Norma Campos Kurtz and Council Members Ryan Balius, Carlos A. Leon, Natalie Rubalcava, Kristen M. Maahs, and Natalie Meeks. Mayor Ashleigh E. Aitken joined the meeting at 5:48 p.m. STAFF PRESENT: City Manager Jim Vanderpool, City Attorney Robert Fabela, and City Clerk Theresa Bass INVOCATION: Pastor Dale Moreland, Ball Road Church of Christ Council Member Leon requested to keep first responders and health care workers in mind during the festive season. FLAG SALUTE: Council Member Carlos A. Leon PRESENTATIONS: Recognizing the 50th Anniversary of West Anaheim Senior/Ambassador Girl Scout Troop 1325 Mayor Pro Tem Kurtz shared that Mayor Aitken is a Girl Scout mom and a former Girl Scout. -She announced the 50th Anniversary of the West Anaheim Senior/Ambassador Girl Scout Troop 1325, also known as the Horizons, and their dedication and community spirit. She shared that for half a century, Troop 1325 has demonstrated the values of courage, confidence, and character. She added that the Girl Scouts have earned badges, achieved goals, and made a lasting impact through service and leadership. She highlighted how the organization teaches teamwork, resilience, and compassion skills that build leadership in all areas of life. She shared that the recognition celebrates the past 50 years and the future of Troop 1325. She recognized the leaders, parents, and volunteers who have supported the group. She noted that the anniversary is proof of the commitment of every member, past and present, to the current Troop members. She added that the contributions of the former members have paved the way for future generations to make the City a better place and for continuing to inspire and making a difference. Recognizing the 401 Anniversary of GBS Linens Mayor Pro Tem Kurtz announced that Anaheim businesses are part of the community and represent the community's spirit. She recognized GBS Linens, a provider of upscale tablecloths, napkins, and other linens for weddings and other events, for their 40th Anniversary. She shared that the family company is now in its second generation of leadership with the founder's daughter Sujata Kamdar, leading the woman -run company. She reported that Ms. Kamdar has worked at GBS since she was 16 years old. She shared that GBS has always been environmentally conscious by recycling linen and minimizing its carbon footprint. She added that GBS has been an invaluable sponsor of the Anaheim Health Fair, which provides free eye, dental, and other medical care to the community. On behalf of the City Council, Mayor Pro Tem Kurtz thanked GBS for its unwavering commitment to the community and congratulated them on 40 years of business. City Council Minutes of December 17, 2024 Page 2of18 Ashesh and Sujata Kamdar accepted the recognition. Sujata Kamdar thanked the City Council for the recognition. She shared that the company is thrilled to have been part of a wonderful community for the last 40 years. At 5:15 p.m., Mayor Pro Tem Kurtz called to order the Anaheim Housing Authority (in joint session with the City Council). ADDITIONS/DELETIONS TO THE AGENDAS: City Clerk Theresa Bass announced that for Item No. 21, an update to "Attachment A" was provided to Council regarding the Scope of Work, which separates the renewal terms for the software to an annual basis to provide for any software upgrades as needed. The contract with Evolvemedia that was posted and distributed to Council remains the same. PUBLIC COMMENTS (all agenda items): Prior to receipt of public comments, City Clerk Theresa Bass provided an outline of procedures for public comments, notice of translation services, and a brief decorum statement. City Clerk Bass reported that a total of seven (7) public comments were received electronically prior to 3:00 p.m. [A final total of seven (7) public comments were received electronically, distributed to the City Council, and made part of the official records]. — See Appendix. R. Joshua Collins shared his efforts in helping various homeless individuals and families. He explained that shelters lack availability and requested that the City expand shelter space or provide a walk-in shelter. He mentioned that the situation is especially difficult for mothers with children. He encouraged the City Council to help families and individuals experiencing homelessness. Girlie Bloomquist shared that she is a mother with four children seeking shelter for the past eight months. She mentioned that she had contacted City Net, Illumination Foundation, and Thomas House, but has not received any assistance. She explained that she has visited every shelter and explored all housing opportunities, but has not received any help. She requested assistance to provide stability for her family. Mayor Pro Tem Kurtz referred Ms. Bloomquist to Deputy Director of Housing and Community Development Sandra Lozeau. Paul Hyek shared that the City needs walk-in shelters. He requested assistance for homeless individuals and recommended providing jobs in shelters. Cecil Jordan Corkern cautioned against subliminal messages in Disney films. He spoke on current events and expressed hope that the situation would improve. Ruben Greg Soto criticized churches for peddling for financial gain. He shared his struggles with addiction. Pastor Joan E. Molina inquired if the City Council had received a letter she provided requesting permission for her nonprofit, One Accord Crusades International, to continue to use Manzanita Park to gather and for the future use of La Palma Park. She shared that One Accord is a faith -based group of concerned volunteers from different churches that desire to help people in Anaheim at no cost. She shared an incident with park rangers regarding parking and permitting. She reiterated her request to use the parks. Jada Young, a Disney Ambassador with the Disneyland Resort, highlighted various community events, beginning with workforce development. She noted that in collaboration with Big Brothers Big City Council Minutes of December 17, 2024 Page 3of18 Sisters of Orange County, Disneyland Resort implemented a workplace mentoring program with students from Loara High School to develop career skills. She highlighted a business etiquette workshop that was provided to junior high and high school girls at the first Girls in Government Day and the two sessions of interview skills for OCAPICA's ROOTED Program at Savanna and Magnolia High Schools. She shared that in November, in collaboration with OC United Way's Youth Career Connections program, workforce development sessions will be facilitated monthly at Anaheim, Western, and Katella High Schools. She highlighted the grand opening of Tiana's Bayou Adventure at Disneyland Resort with children from local nonprofits in attendance. She reported that Disney collaborated with Northgate Markets to package and distribute food to over 125 families at James Madison Elementary School and thanked Council Member Leon for attending. She highlighted Disney Volunteers' participation in National Family Volunteer Day at Community Action Partnership at Orange County's Food Banks and the organization's continued work with Northgate to provide holiday food vouchers to three community nonprofits. She shared that they are continuing their partnership with Marine Toys for Tots, with over 17,000 toys collected, and highlighted Run Disney at the Disneyland Resort and the $15,000 contribution to the YMCA. Carrie Guerrero expressed concern about the increased crime in District 2. She noted sideshows, gunshots, and a recent homicide in the area. She shared that the neighborhood is occupied by elderly people who are unable to leave their homes. She requested that speed bumps be installed at the intersection of Orangewood and Ninth Street to prevent sideshows. Council Member Leon requested that a representative from the City Manager's Office and the Chief of Police speak with Ms. Guerrero. Mary Roades echoed Ms. Guerrero's comments. She noted that there is a limited police presence in the neighborhood. She shared that street racing has increased in the area, causing public safety issues. Mark Richard Daniels shared that Miriam Kaywood, the first woman elected to the Anaheim City Council, was elected in 1974. He highlighted the supermajority of women serving on the current City Council and the significant progress made since that time. Matthew Duncan welcomed the new Council Members. He expressed concerns regarding the City's Coyote Management Plan. He noted that, with the exception of Council Member Leon, City Council Members have not responded to his concerns. Bryan Kaye provided plaques to the new City Council Members and congratulated them. He shared his interactions with Anaheim Police Officers. He commented that the City still requires progress and expressed hope that the newly elected Council Members will make changes. Marc Herbert welcomed the new Council Members. He shared that a previous issue he raised about the Mayor's public calendar had been corrected. He expressed concern with the public calendars of other Council Members, including a potential Brown Act violation. He encouraged public engagement. At 5:48 p.m., Mayor Aitken joined the meeting. COUNCIL COMMUNICATIONS: Mayor Pro Tern Kurtz highlighted the Christmas Tree Lighting Ceremony at Ponderosa Park. The event was organized by local mothers and grandmothers, with support from the City Manager, Public Works, and Community Services. Close to 400 residents attended the event, including children with decorated bikes and strollers, and Santa Claus and Mrs. Claus were present. Mayor Pro Tern Kurtz emphasized the community's effort and thanked staff and residents for their participation. City Council Minutes of December 17, 2024 Page 4of18 Council Member Rubalcava highlighted and shared photographs of events in District 3. K & A Cafe will be hosting their 16th Annual Holiday Brunch on Christmas Eve from 9:00 a.m. to noon. The brunch will host 800 people, including those in need, and will feature toys and a hot breakfast. She thanked the Fire Department, Police Department, and Public Utilities for their participation. Council Member Rubalcava shared that a gift -wrapping party will also take place, and she noted that unwrapped toy donations are also being accepted. On Friday, December 20th, Mondragon Family Market will be hosting their 2"d Annual Holiday Toy Drive & Giveaway. Council Member Rubalcava thanked the Community Services Department for hosting Posadas which are holiday celebrations at the City's Mobile Family Resource Centers in lower -income communities. She thanked Veterans of Foreign Wars, Post 3173 for hosting a food and gift giveaway event last Sunday. Council Member Balius thanked District 1 residents for their participation in the voting process. He thanked Community Services Director Sjany Larson -Cash and her staff for their holiday celebration efforts. Council Member Balius expressed appreciation for the clean-up efforts on Beach Boulevard by the Anaheim Police Department and Public Works Director Rudy Emami and his staff. He thanked the West Anaheim Organization for their work in organizing the tree lighting event at Twila Reid Park. Council Member Leon thanked residents who spoke during Public Comments and noted that he will work with the Police Chief to follow up on some of the concerns addressed. He thanked all the organizations who donated toys to the various holiday events throughout the City. Council Member shared photographs of Pepz Pizza and Eatery, the November Restaurant of the Month, highlighting its contributions to the community and its resilience during the pandemic. He shared that the pizza is very good and the wings are amazing. Council Member Leon shared photographs of Dunarea Restaurant, the December Restaurant of the Month. He shared that they serve authentic Romanian cuisine including traditional favorites like stuffed cabbage rolls and grilled sausages. He noted their long-standing presence in Anaheim. Council Member Leon shared photographs of Knafeh Cafe, the December Business of the Month. He shared that they are dedicated to preserving culinary traditions and community hospitality, are in Little Arabia, and serve authentic handmade Middle Eastern pastries. Council Member Leon welcomed his new colleagues onto the Council and thanked City staff for their hard work throughout the year. Mayor Aitken highlighted the toy drive at the Anaheim Convention Center, with thousands of families receiving toys. She thanked United Across Borders and staff for their efforts in making the event successful and Disney for the toy donations. She welcomed the new Council Members, and she wished everyone a happy holiday season and a happy new year. CITY MANAGER'S UPDATE: City Manager Vanderpool acknowledged and thanked all City of Anaheim employees who will not be with their family members this holiday season because they will be working to ensure essential City services are maintained At 6:13 p.m., Mayor Aitken recessed the Anaheim City Council to address the Anaheim Housing Authority agenda and reconvened at 6:15 p.m. CONSENT CALENDAR: The Consent Calendar was considered with Council Member Meeks pulling Item No. 30, Mayor Pro Tem Kurtz pulling Item Nos. 8 and 15, and Council Member Maahs pulling Item Nos. 5 and 7 for separate consideration. Council Member Balius and Council Member Maahs requested to record an abstention for Item No. 31 City Council Minutes of December 17, 2024 Page 5 of 18 MOTION: Council Member Meeks moved to waive reading of all ordinances and resolutions and adopt the balance of the consent calendar as presented in accordance with reports, certifications, and recommendations furnished each City Council Member, seconded by Mayor Pro Tern Kurtz. Receive and file the list of Professional Services agreements authorized by the City Manager in November 2024 and the list of Visit Anaheim Subcontractor Agreements approved by the Executive Director of Convention, Sports, and Entertainment in November 2024. AGR-4957 9. Determine, on the basis of the evidence submitted by Kaiser Foundation Hospitals, that the property owner has complied in good faith with the terms and conditions of Development Agreement No. 2007-00003 for the 2024 review period for the Kaiser Hospital Campus Project, located at 3400-3450 East La Palma Avenue and 959-1001 North Grove Street. 10. Approve the Second Amendment to Restated and Amended Master Services and Purchasing AGR-13841.2 Agreement with Axon Enterprise, Inc., to increase the not to exceed amount from $10,137,642.92 to $11,124,953.93 over the seven year term for the purchase of seventy (70) additional Axon Fleet 3 systems to be installed in patrol vehicles. D180 11. Authorize a month -to -month extension of the current master agreement with Brightview Landscape Services, Inc. for landscape maintenance at various Public Works, Police, and Community Services sites, limited to a maximum duration of five months and a total amount not to exceed $57,920.20. D180 12. Accept the bid from All American Asphalt, in the amount of $99,442.50 plus applicable sales tax and a 25% contingency, to provide SC 800 asphalt cold mix on an as -needed basis for Anaheim Public Utilities for a one year period, with four one-year optional renewals; and authorize the Purchasing Agent to exercise the renewal options, in accordance with Bid #9830. D180 13. Authorize an increase to the master agreement with Autozone, in the amount of $50,000, for a new total not to exceed amount of $150,000, to accommodate the increased need for automotive parts and supplies, for Public Works, Fleet Services Division. D180 14. Accept the bid from Wayne Perry, Inc., in the amount of $99,035.80 plus applicable sales tax and a 20% contingency, to perform repair and maintenance services for the City of Anaheim's CNG compressor equipment, for a one year period, with four one-year optional renewals; and authorize the Purchasing Agent to exercise the renewal options, in accordance with Bid #9826. Waive the sealed bid requirement of Council Policy 4.0 and authorize the Purchasing Agent to issue Addendum #1 to the Service Agreement with Multimedia Integrated Technology, Inc., dba Integrated Technology, in an not to exceed amount of $108,000 plus applicable taxes, for telephone system maintenance and repair services for a one-year period; and authorize the extension of the agreement on a month to month basis for up to an additional twelve months at a monthly amount not to exceed $8,995 plus applicable taxes. AGR-15154 17. Award the contract to the lowest responsible bidder, Crosstown Electrical & Data, Inc., in the amount of $478,987 plus a 10% contingency, for the traffic signal modifications at the Ball Road and Disneyland Drive intersection; authorize the Director of Public Works to execute the contract and any other related documents, and to take the necessary actions to implement and administer the contract; authorize the Finance Director to execute the Escrow Agreement pertaining to contract retentions; and determine the project is categorically exempt from the California Environmental Quality Act pursuant to Class 1, Section 15301(c) (Existing Facilities) and Class 2, Section 15302 (Replacement or Reconstruction) of Title 14 of the California Code of Regulations. AGR-15155 18. Award the contract to the lowest responsible bidder, All American Asphalt, in the amount of $4,192,546, for the Serrano Avenue Rehabilitation from the West City Limit to Weir Canyon Road Project; authorize the Director of Public Works to execute the contract and any other related documents, and to take the necessary actions to implement and administer the contract; authorize Finance Director to execute the Escrow Agreement pertaining to contract retentions; and determine that the project is categorically exempt under the California Environmental Quality Act pursuant to Class 1, Section 15301 (Existing Facilities) of Title 14 of the California Code of Regulations. AGR-15156 19. Award the contract to the lowest responsible bidder, All American Asphalt, in the amount of $2,169,464.80, for the Harbor Boulevard Rehabilitation from Ball Road to South Street Project; authorize the Director of Public Works to execute the contract and any other related documents, and to take the necessary actions to implement and administer the contract; and authorize the Finance Director to execute the Escrow Agreement pertaining to contract retentions; and determine that the Project is categorically exempt under the California Environmental Quality Act pursuant to Class 1, Section 15301 (Existing Facilities) of Title 14 of the California Code of Regulations. AGR-15157 20. Approve the Agreement for Grant of Easement with Parkview Healthcare Center Real Estate Operating Company, LLC, for a Street and Public Utility Easement and Right of Entry, in exchange for additional on -site work to rehabilitate the front parking lot, parking stalls, and relocate an existing fire line backflow assembly device, for the property located at 1514 East Lincoln Avenue for the Lincoln Avenue Widening Project from East Street to Evergreen Street. AGR-15158 21 Approve Contract Number MA# 106-498265 agreement with Envolvemedia, LLC, in an not to exceed amount of $318,000 with a 5% contingency each year, for a Learning Management System for a three year period with two one-year optional renewals, and authorize the Purchasing Agent to execute the agreement and authorize the Human Resources Director, or designee, to execute the renewal options, and any other related documents necessary to implement and administer the Agreement. Ratify the submission of the Better Careers Grant application to The James Irvine Foundation; increase the Housing and Community Development Department's FY 2024/25 budget by $520,000; and authorize the Director of the Housing and Community Development Department, or designee, to execute all agreements and other documents necessary to implement and administer the grant activities. D125 23. RESOLUTION NO. __2024-128._ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM declaring certain properties along Manchester Avenue to be "Surplus Land" pursuant to California Government Code Section 54221(b)(1) [east side of Manchester Avenue, between West Lincoln Avenue and West Broadway (APN 250-131-07 and APNs 250-132-07, -09, -10, -15)] [includes determination that the action will not result in a direct or indirect physical change in the environment and does not constitute an "approval" of a "project" pursuant to California Environmental Quality Act Guidelines Sections 15004 and 15352]. Authorize the Director of Economic Development, or designee, to issue a Notice of Availability (NOA) in accordance with the Surplus Land Act (SLA); and authorize the Director of Economic Development to review each Notice of Interest received, if any, during the 60-day NOA period and enter into negotiations with responsive bidder(s) for a period of 90 days, in accordance with the SLA. D150 24. RESOLUTION NO. 2-024-129 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM authorizing the Director of Community Services, or designee, to submit an application for grant funds for the Water Quality, Supply and Infrastructure Improvement Act of 2014 (Proposition 1), for the River Park Project and if awarded, authorizing the acceptance of such funding on behalf of the City and increasing the budget accordingly [grant funds in the amount of $750,000]. Determine that this action is categorically exempt from the California Environmental Quality Act pursuant to Section 15306 of Title 14 of the California Code of Regulations (Information Collection). 25. RESOLUTION NO. 2024-130 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM authorizing the Public Works Director or his designee to submit a grant application on behalf of the City of Anaheim to the Orange County Transportation Authority for funding under the M2 Regional Traffic Signal Synchronization Program for State College Boulevard/The City Drive Regional Traffic Signal Synchronization Program (RTSSP) Project, and if awarded, authorizing the acceptance of such grant funds on behalf of the City and amending the budget accordingly, and determine the action is exempt from the California Environmental Quality Act (CEQA) pursuant to Regulation No. 15301(b) Class 1. D175 26. RESOLUTION NO. _...... 2024-131 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM adopting the Measure M2 expenditure report and authorizing the City of Anaheim Finance Director to sign and submit the expenditure report to the Orange County Transportation Authority on behalf of the City of Anaheim. RESOLUTION NO. 2024-132 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ratifying the submission of a grant application and the acceptance of a grant on behalf of the City of Anaheim for the Fiscal Year 2024 Safer Outcomes: Enhancing De-escalation and Crisis Response Training for Law Enforcement Grant Program, authorizing the City Manager and Police Chief, or their designees, to execute all required grant documents, and increasing the budget for the Fiscal Year 2024-25 accordingly [grant funds in the amount of $350,000]. D129 28. RESOLUTION NO. 2024-133 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM authorizing the Fire Chief or his designee to submit a grant application on behalf of the City of Anaheim to the Federal Emergency Management Agency of the U.S. Department of Homeland Security for the Fiscal Year 2024 Assistance to Firefighters Grant Program (AFG). Increase the Fire & Rescue Department budget accordingly, in an amount not to exceed $3,988,000 for the fiscal year in which grant funds are awarded, if the application is successful. M142 29. ORDINANCE NO. 6600 (INTRODUCTION) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ANAHEIM amending Chapter 6.30 (Smoking in Public Places) of Title 6 (Public Health and Safety) of the Anaheim Municipal Code Nunc Pro Tunc to include provisions inadvertently omitted from recently -adopted Ordinance No. 6591 D114 31 Approve minutes of the City Council meetings of April 16, 2024 and May 7, 2024. Item No. 31: Council Members Balius and Maahs recorded an abstention for Item No. 31. MOTION: Council Member Meeks moved to approve the Consent Calendar, seconded by Mayor Pro Tern Kurtz. Approve the list of recurring annual recognitions for calendar year 2025. DISCUSSION: Council Member Maahs requested to include National Caregiver Month in November to the list of annual recognitions. In response to Mayor Aitken, City Attorney Fabela confirmed that the Council can vote on the staff recommendation with the included recognition. MOTION: Council Member Maahs moved to approve the list of recurring annual recognitions for calendar year 2025, as amended to include National Caregiver Month in November, seconded by Council Member Meeks. Determine on the basis of the evidence submitted by PT Metro, LLC, that the property owner has complied in good faith with the terms and conditions of the Amended and Restated Development Agreement No. 2005-00008 for the 2024 review period for the A -Town mixed - use project located in the Platinum Triangle (1404 East Katella Avenue). Acting Planning and Building Director Heather Allen reported that the item is an annual report on the City's Development Agreement for the Platinum Triangle A -Town project. She shared that the project is a multi -year, multi -phased term of the Development Agreement. She noted that the Lennar team is working toward the next milestone in 2025, which includes the construction of additional residential units. She added that if they complete the milestone, an additional five years would be unlocked. DISCUSSION: Council Member Maahs inquired if a grocery store will be built in the area. Acting Director Allen reported that the final milestone includes a commercial component of up to 38,000 square feet. She noted that a grocery store is currently included in the plans, but permits have not been pulled for construction. Michael Titus, Attorney for Lennar, shared that he is working with staff on Project Area B to develop. He explained that Planning Area B is a podium -style project, which is not favorable in capital markets. He noted that Lennar will work with the City Council and staff to develop a solution within 60 to 90 days. MOTION: Council Member Maahs moved to determine on the basis of the evidence submitted by PT Metro, LLC, that the property owner has complied in good faith with the terms and conditions of the Amended and Restated Development Agreement No. 2005-00008 for the 2024 review period for the A -Town mixed -use project located in the Platinum Triangle (1404 East Katella Avenue), seconded by Council Member Meeks. ROLL CALL VOTE: AYES — 7 (Mayor Aitken and Council Members Kurtz, Balius, Leon, Rubalcava, Maahs, and Meeks); NOES — 0. Motion carried. AGR-1463 8. Determine on the basis of the evidence submitted by STC GardenWalk LLC, GardenWalk Hotel I, LLC, and Westgate Resorts Anaheim, LLC, that the property owners have complied in good faith with the terms and conditions of each of their respective portions of Development Agreement No. 99-01 for the 2024 review period for the Anaheim GardenWalk Project located in The Anaheim Resort (located between Katella Avenue and Disney Way, west of Clementine Street). Acting Director Allen reported that the item is an annual review of the Development Agreement for the GardenWalk. She explained that the GardenWalk project is unique due to the Development Agreement and Disposition and Development Agreement (DDA). She reported that the Development Agreement covers three different areas: STC GardenWalk is responsible for the constructed retail, dining, entertainment portion, and parking structure; JW Marriott is responsible for one hotel and the development of another; and the Westgate Resorts is responsible for future vacation ownership. She added that they are all in compliance with the 2024 annual review period. She added that the JW Marriott and Westgate have reported market challenges, with future discussions expected in the upcoming months. DISCUSSION: Mayor Pro Tern Kurtz expressed concern with the retail, dining, and entertainment area. She reported complaints from businesses and residents who expressed concern about empty businesses and inconsistencies with retail and dining. Director of Economic Development Sergio Ramirez acknowledged the concerns and reported that the current owner of GardenWalk retail purchased the portion of the property in 2018. He explained that City Council Minutes of December 17, 2024 Page 10 of 18 the DDA allows the City to review the tenants who will occupy the shopping center. He reported that the applicant has made several requests for different tenants that declined. He acknowledged STC's difficulties with the GardenWalk since the pandemic, noting that staff encouraged STC to develop a marketing plan for the area, which has been met with resistance. He added that at the Council's direction, staff will work with the City Attorney's Office to review for any further violations of the agreement. Mayor Pro Tern Kurtz confirmed her interest in the additional review. She shared that residents no longer refer visitors to the GardenWalk and highlighted the property and its location. She requested that staff review the DDA and Development Agreement to explore additional options. She explained that the Building Code requires engineering or plans for some fences over seven feet. Discussion with President and CEO of Visit Anaheim regarding his views of the Anaheim Tourism Improvement District Advisory Board. DISCUSSION: Council Member Rubalcava requested information on Visit Anaheim and the organization's purpose and mission. President and CEO of Visit Anaheim, Mike Waterman, reported that the City is contracted with Visit Anaheim for the official sales, marketing, and promotions of the City. He shared that Visit Anaheim promotes the City domestically and internationally to sell group, transient, leisure, business transient, and all segments of the market. In response to Council Member Rubalcava, Mr. Waterman confirmed that Visit Anaheim operations impact the City's General Fund. In response to Council Member Rubalcava, Mr. Waterman acknowledged the errors of his predecessor, which resulted in his predecessor's dismissal. He shared that he promises to be more transparent and communicate more with the community. Council Member Rubalcava reported that Assembly Member Avelino Valencia requested an audit from the State to review the Anaheim Tourism Improvement District (ATID), which resulted in the creation of an Oversight Committee. She shared that the audit found that ATID funds were self - assessed by over 90 hotels in the City, and the funds were deemed public funds, which required additional oversight. She shared that the ATID Advisory Board was created in 2024 to make recommendations to the City Council and Visit Anaheim on expenditures to market the City's tourism. She inquired about the funds generated through ATID. Mr. Waterman explained that the economic impact is hundreds of millions of dollars per week. He added that Visit Anaheim ensures that the 65,000 hospitality workers in the City receive adequate hours for their income. In response to Council Member Rubalcava, Mr. Waterman explained that the ATID Advisory Board consists of four City representatives and three representatives from the hotels. Council Member Rubalcava quoted his comment regarding disbanding the ATID Advisory Board. In response to Council Member Rubalcava, Mr. Waterman expressed regret over his comments. He explained that his comments referred to the fact that many TID boards across the state have disbanded, as cities found them to be redundant. He explained that, similar to Anaheim, cities participate in executive committees and boards and have access to the information. He apologized for his comments. In response to Council Member Rubalcava, Mr. Waterman shared that he would not disband the Advisory Board. He explained that over time, other cities have found the advisory boards redundant, City Council Minutes of December 17, 2024 Page 14 of 18 which, resulted in them being eliminated. He added that he has no ability to disband the Advisory Board or make suggestions to disband it. He shared that the Advisory Board was recommended by the State and expressed Visit Anaheim's commitment and participation in the Board. Council Member Rubalcava inquired if Mr. Waterman was aware of the reason for the State audit. Mr. Waterman explained that there were questions about Visit Anaheim's expenses. In response to Council Member Rubalcava, Mr. Waterman explained that the intention of the ATID Advisory Board is to understand how the funds are being spent and share the information with the City Council. Council Member Rubalcava requested additional information on how Mr. Waterman prepares for the ATID Advisory Board meeting. Mr. Waterman reported that the ATID Advisory Board is required to meet four times a year, with the second meeting taking place in Quarter 1. He shared that Visit Anaheim will be prepared to present anything the City Board Members request. Council Member Rubalcava requested that Mr. Waterman engage in the process and return to the City Council to explain where the funds are being spent. She requested additional information on how Visit Anaheim will generate additional visitors to help the City's revenue. Mr. Waterman explained that Visit Anaheim is adding resources, including salespeople, agencies, and has signed a Request for Proposal for an agency to bring in international business. He explained that Visit Anaheim is aware that the more money generated through ATID will result in more money generated for the City through Transient Occupancy Taxes (TOT). Council Member Rubalcava shared that the TOT funds public safety, infrastructure improvements, improved lighting, and maintenance. She requested additional metrics for Return on Investment (ROI) and where the funds are spent. She emphasized the need to help smaller businesses and generate more conventions at the Convention Center. She inquired about the $1.5 million that the City requested back from Visit Anaheim. Mr. Waterman shared that Visit Anaheim is engaged in discussions with the City on how to rectify the situation. City Attorney Fabela advised that inquiries should be associated with the Advisory Board. Council Member Rubalcava inquired if the return would be reviewed by the Advisory Board. She requested to include an agenda item for the next Council meeting to discuss. She inquired how Visit Anaheim's investments in Workforce Development Initiatives will generate revenue. Mr. Waterman explained that the initiatives do not generate revenue and are funded differently. He shared that the year prior, Visit Anaheim created Workforce Development, which has expanded to educate students. He noted that Visit Anaheim brings key stakeholders, including the Anaheim Ducks and Angels, to bring them to different schools to educate students about working in Anaheim and pursuing degrees in hospitality. Council Member Rubalcava explained that the majority of the revenue stream is from taxpayer dollars, which were deemed public funds, and recommended that the Advisory Board review the Workforce Development Initiative. Council Member Leon echoed Council Member Rubalcava's concerns. He wanted to ensure that Mr. Waterman understood the gravity of his comments and the City Council's work to facilitate trust and transparency in local government. He explained that the City Council aims to ensure both the City and businesses succeed, doing so ethically and with the public's trust. We currently fellowship weekly at Manzanita Skatepark,1260 N. Riviera St., Anaheim, with twenty-five orless people. Since 2017 we have met at La Palma Park without any issue/s until the recent new construction project that started in mid -October 2024. 1 spoke with the project manager, Jody Rios, about an approximate completion date which may be mid -February 2025. We are a faith -based group of concerned volunteers from different churches that have the heart's desire to help those in need at, "No Cost," to the People and the City of Anaheim. One Accord Crusades, Intl. is effective in communication both in English and Spanish. We have a Mission and Vision to encourage those seeking a productive law-abiding new life by applying basic Biblical principles. Our petition is for the City Council to officially grant One Accord Crusades International permission to continue this fellowship at Manzanita Skatepark and allow permission upon our return to La Palma Park when the La Palma Park improvement project is completed. I am concerned about some alleged rules that were brought to my attention on Nov. 24, 2024, by a Park Ranger at approx. 3pm and another Park Ranger at 5pm. At 3pm a Park Ranger interrupted the meeting, while I was speaking to the people. He asked whose Van was parked next to the skatepark. I shared that it was my Van with Handicap plates. He said the Van needs to be moved. I shared that I could as soon as I ended my portion of the meeting. I shared it had HDCP plates, and I could not walk that fast for his request. Then he stated that he wanted the Van moved immediately. So, I gave my keys to another volunteer to move it. Included in this letter are attached pictures of the area where the Van was parked. There are: No curb markings and no signs of, "No Parking." A (Cont. pg. 1 of 2) (Cont. pg. 2 or 2) At approx. 5pm another Park Ranger pulled up as we were packing up. He said we were an Organized Religious Group and had been at the park too long. He said he understood that we had 15t Amendment Rights but had to go. He also asked me to contact: Community Services. I explained I had contacted Community Services over the years, and that I was told by (CS), that if we had 25 or less people that no permit was required. I showed him the phone number in my cell phone as it correlated to the phone number he wanted to give me. On Tuesday Nov. 26, 2024, 1 went to the Community Service Dept as suggested by the 5pm Park Ranger and spoke with the Coordinator. I explained the interactions with both Park Rangers. I shared why my Handicap Van was parked by the unmarked curb & that there wasn't a "No Parking Sign". I also asked if there was a time limit? The coordinator confirmed with me that no permit is required for 25 or less people, that there is no time limit, and the park closes at 10:30pm. Any audio should be only loud enough for the fellowship to hear. I asked if there were any complaints? The coordinator said they have not had any complaints. The Coordinator asked us to connect with, "Love Anaheim," for any food approval. I have not received any information as the Coordinator had promised to email me the contact info to: "Love Anaheim." The Coordinator said that the Park Rangers will be contacted. (Note: We set up at 2pm and leave approx.5-5:30pm as we make ourselves available to individuals that want personal prayer). Late on Saturday, Nov. 30, 2024, 1 received a Courtesy Letter from Code Enforcement to Cease and Desist from conducting unpermitted activity within public parks. A.M.C. 13.08.040. However, in the letter the Senior Code Enforcement Officer missed the accuracy of the cited code. The missed wording is: Or a permit from the Director of Community Services. I went to Community Services and spoke with the Coordinator, who I believe to be an acting official for the Director. Regardless of any misunderstanding, the Coordinator represented the Community Services Dept. very professionally, understood my need for permission to have the fellowship at the park, and clarified the rules from what the Park Rangers told me. In conclusion, I have some suggestions for the Public to be informed about park rules. 1) Relocate the large green Park Rules signage to the Entrance Planter Circle instead of behind the circle so that it is viewable before the parking entrance to the lot. 2) Post a "No Parking Sign," where the curbing is unpainted in front of the skatepark. 3) Paint the curbing in front of the skatepark area where the vertical posts are. 4) Make another ADA parking spot for the East end of the parking lot. 5) Post another green Park Regulation sign at the East end of cul-de-sac park driveway. With a heart and a prayer, 1 believe that the City Councils observation through this letter is that One Accord Crusades International only has good intentions to bring free benefits and encouragement to those in need.
