1961-7357RESOLUTION NO. 7357 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THLT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City'of Anaheim did hold a public hearing in Reclassification Proceed- ings No, 61 -62 -36 to consider an amendment to Title 18 of the. Anaheim Municipal Code relating to zoning and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from 1:;rsons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon, the Planning Commission did duly adopt a resolu- tion containing a report of its findings, a summary of the evi- dence presented at said hearing and a recommendation that the proposed amendment be adopted by the. City Council and that cer tain. zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of he City Plan- ning Commission, the City Councii did fix the 14th day of November 19 61 as the time, and the City Council ham bers In the City H'in the City of Anaheim as the place fur a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, here- inafter described, from the zone in which it Is now situated and the incorporation thereof in the zone hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of said Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did there- upon consider the summary of evidence presented at 3a id public hearing before the Planning Commission, its repo ,t of Cindings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in Which it is now situated, and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Tie 18 of the Anaheim _Municipal Code be, and the same is hereby amended, and that the following des- cribed property, situated in the, City of Anaheim, County of Orange, State of California, to wit: -1- 61 -62 -36 Lots 1 to 45, both inclusive, of Tentative Tract No. 1246, as shown on the tentative map of said tract submitted to and approved by the City Council on November 14, 1961. be excluded from the R -A, RESIDENTIAL AGRICULTURAL ZONE, and incorporated in the following zones upon the conditions here- inafter set forth: That Lots 1 to 6, both inclusive, of said Tract be changed to R -3, MULTIPLE FAMILY RESIDENTIAL ZONE; That Lot 7 of said Tract be changed to C -3, HEAVY- COMMERCIAL ZONE; That Lots 8, 9, 10 and 11 of said Tract be changed to Ca-1, NEIGHBORHOOD- COMMERCIAL ZONE; and That the balance of said lots, being Lots 12 to 45, both inclusive, be changed to R -1, ONE FAMILY RESIDENTIAL ZONE, upon the following conditions: 1. Payment to the City of Anaheim of the sum of $25.00 per dwelling unit, for all dwellings erected on the R -3, Multiple Family Residential Zone property to be used for park and recreation purposes, said amount to be paid at the time the building permit is issued. 2. That the Final Map of Tract No. 1246, which shall conform to the Tentative Map of Tract No. 1246 approved by the City Council on November 14, 1961, shall have been recorded in the Office of the County Recorder of Orange County, California, before the ordinance reclassifying subject property is adopted. 3. That the owner of the property shall place of record City of Anaheim C -3 Deed Restrictions, approved by the City Attorney, covering the C -3 lot, which restrictions shall limit the uses of said lot to a service station or any C-1, Neighborhood Commercial Zone uses. That 6 -foot masonry walls shall be constructed along the east side of the alley abutting Lot No. 1, along the north side of Lots Nos. 39, 40, 41, 42 and 43, and along the west side of Lots Nos. 43, WI, 45, 12 and 13, and that said walls shall be constructed prior to final building inspection of the R -1 residences. 5. That a landscaped strip, of a minimum width of six feet, shall be provided and said landscaping maintained, along the C -1 lots, being Lots Nos. 8, 9, 10 and 11, and along Lot No. 7, if said Lot No. 7 is developed for C -1 uses; that plans -2- ATTEST: for said landscaping shall be submitted to and approved by the Superintendent of Parkway Main- tenance of the City of Anaheim; and that said landscaping shall be installed prior to final inspection of the buildings or structures to be erected on the respective lots. 6. That the developer of said Tract shall install all street improvements, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work as required by the City Engineer, on those two parcels on Placentia Avenue, abutting Sycamore Street, which parcels are shown on the Tentative Map of Tract No. 1246 approved by the City Council on November 14, 1961, and are marked "Not a Part of This Tract and that said street improvements shall be installed when required by the City Engineer. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
