A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM GRANTING VARIANCE NO. 1439.
WHEREAS, the City Planning Commission of the City of
Anaheim did receive a petition for zoning variance from M. 0. and
Esther C, Wangensteen, owners, of certain real property situated
in the City of Anaheim, County of Orange, State of California,
described as follows:
That portion of Lot 27 of Anaheim Extension, in the
city of Anaheim, county of Orange, state of California,
as shown on a map of Survey made by William Hamel and
filed in the office of the county recorder of Los
Angeles County, California, a copy of which is shown
in book 3 page 163 et seq., entitled "Los Angeles
County Maps," records of said Orange County, California,
described as follows:
Beginning at the intersection of the northerly pro-
longation of the westerly line of the land described
as Parcel 1 in Certificate of Title No. 10356, with
the center line of Vermont Avenue, said point being
North 75 28 00" East 612.09 feet from the inter-
section of said center line of Vermont Avenue with
the center line of Palm Street as shown on a map
filed in book 11 page )1)1 of Record of Surveys; thence
North 75 28t 00" East 58,00 feet to the northerly
prolongation of the westerly line of the land described
in Certificate of Title No, 13618; thence South 14° 26=
00" East 177.00 feet along said westerly line; thence
North 75 28 00" East 52,00 feet parallel with said
center line of Palm Avenue; thence N 14 26! 00"
West 20.00 feet parallel with said westerly line;
thence North 75 28t 00" East 110.00 feet parallel
with said center line; thence South 14 26 00" East
100,00 feet parallel with said westerly line to the
easterly prolongation of the southerly line of the land
described in said Parcel 1 of Certificate No. 10356;
thence South 75 28 00" West 150,00 feet to the south»
west corner of the land described in said Parcel 1;
thence North 14 261 00" West 257.00 feet to the point
of beginning.
EXCEPT that portion within Vermont Avenue.
AND WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim upon said
petition on January 22, 1962, notice of which said public hearing
was duly given as required by law and the provisions of Title 18,
Chapter 18,76 of the Anaheim Municipal Code; and
WHEREAS, said City Planning Commission, after due
inspection, investigation and studies made by itself and in its
behalf, and after due consideration of all evidence and reports
offered at said hearing, did adopt Resolution No. 215, Series
1961-62, recommending that Variance No. 1439 be denied; and

WHEREAS, thereafter, within twenty-two (22) days from
the date of the adoption of said resolution, the City Council
did elect, upon its own motion, to review the action taken by
the City Planning Commission in denying said variance and did
set a public hearing thereon to be held on the 20th day of
February, 1962, at 7:00 o'clock P.M. in the City Hall in the
City of Anaheim and notice of such public hearing was duly
given as required by law and the provisions of Title 18,
Chapter 18.76 of the Anaheim Municipal Code; and
WHEREAS, after due investigation and studies made by
itself and in its behalf, and after due consideration of all
the evidence and reports offered at said hearing, the City
Council does find and determine that:
1. There are exceptional or extraordinary circum-
stances cr conditions applicable to the property
involved or to the intended use of the property
that do not apply generally to the property or
class of use in the same vicinity and zone,
2, That such a variance is necessary for the preserva-
tion and enjoyment of a substantial property right
possessed by other property in the same vicinity
and zone and denied to the property in question.
3. That the granting of such variance will not be
materially detrimental to the public welfare or
injurious to the property or improvements in such
vicinity and zone in which the property is located.
4. That the granting of such variance will not adversely
affect the comprehensive general zoning plan.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the action of the City Planning Commission
denying the petition for a variance permitting a waiver of the
single -story height limitations, the wall and minimum floor area
requirements for R-3, Multiple Family Residential Zones, as
required by the Anaheim Municipal Code, be, and the same is
hereby, disapproved, and that Variance No, 139 be, and the same
is hereby, granted, in part, as follows:
1. That a waiver of the wall requirement along the
south boundary line, where subject property abuts
the Orange County agricultural property, is granted,
2, That single -story height limitations shall be
observed within 150 feet of the R -1, One-Family
Residential Zone, property to the North; but,
that the single -story height limitations shall
be waived where subject property abuts R•►A,
Residential Agricultural Zone property to the
East, West and South.
3, That the frontage requirements for R -3, Multiple
Family Residential Zone lots shall be waived.
4. That plans for the development of subject property
shall be reviewed and approved by the Architectural
Review Board.
The City Council hereby reserves the right to revoke
such variance permit for good cause or failure of said owners,
their heirs, successors or assigns, to comply with the Anaheim
Municipal Code and regulations and the conditions herein. Said
variance is granted for the term prescribed by the Anaheim
Municipal Code unless otherwise specified herein.
THE FOREGOING RESOLUTION is approved and signed by me
this 20th day of February, 1962,

February, 1962.
