A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM FINDING AND DETERMINING THAT THE
PUBLIC INTEREST AND NECESSITY REQUIRE THE
ACQUISITION, CONSTRUCTION AND COMPLETION OF
A PUBLIC UTILITY EXTENSION AND PUBLIC IMPROVE
MENT CONSISTING OF WATER MAINS, LATERALS,
SERVICE CONNECTIONS AND WORKS IN CERTAIN
PORTIONS OF THE CITY OF ANAHEIM AND IN
PORTIONS OF UNINCORPORATED TERRITORY CONTIGUOUS
TO THE CITY OF ANAHEIM, AND THE ACQUISITION
THEREOF BY THE CITY OF ANAHEIM BY EMINENT
DOMAIN PROCEEDINGS OF CERTAIN PROPERTY OF
DYKE WATER COMPANY AND ELECTING TO SUBMIT
THE MATTER OF DETERMINATION OF JUST COMPENSA-
TION TO THE PUBLIC UTILITIES COMMISSION OF
THE STATE OF CALIFORNIA.

SECTION 1. It is hereby found and determined that
the public interest and necessity require the acquisition,
construction and completion of a public utility extension and
public improvement consisting of water mains, laterals, service
connections and works in certain portions of the City of Anaheim
and in portions of unincorporated territory contiguous to the
City of Anaheim, to be used for and necessary for:
(1) The transmission and distribution of domestic
water and water for fire fighting purposes and supplying
domestic water to the City of Anaheim and certain of the
inhabitants thereof; and
(2) The proper development and control of such use
of such domestic water, at this time, and the future
proper development and control thereof,
as a part of the domestic water system owned and operated by
the City of Anaheim for furnishing and supplying domestic water
to said City and certain of the inhabitants thereof.
SECTION 2. The public interest and necessity require
the taking and acquisition by the City of Anaheim for said public
utility extension and public improvement and use of the domestic
water transmission and distribution system of the Dyke Water
Company located within certain portions of the City of Anaheim
and certain portions of unincorporated territory contiguous
to the City of Anaheim described as follows:
(a) All the parcels of real property and the other
property and assets described in Exhibit A" attached
hereto and made a part hereof, subject only to matters
or exceptions set forth in said Exhibit "A';

(b) All other real property and all easements,
rights of way, franchises, certificates of public
convenience and necessity, permits, licenses, and
similar rights and privileges owned by said Dyke
Water Company included within the area hereinafter
set forth;
(c) All water rights, both surface and subsurface,
owned or claimed by Dyke Water Company in the following
described area;
(d) All records and maps of Dyke Water Company
relating to the operation or ownership of the property
included within this proceeding, including customer
accounts, operating and title records of every nature,
including engineering records and billing records;
said general area being described as follows:
All of the area within the City of Anaheim served by
Dyke Water Company and all of the area served by the
Dyke Water Company in the unincorporated area which
is north of Katella Avenue, east of Gilbert Street,
and bounded, except for such southwesterly boundaries
of Gilbert Street and Katella Avenue, by the southerly
boundaries of the City. of Anaheim in this general area.
SECTION 3. Said public improvement is planned and
located in the manner which will be most compatible with the
greatest public good and the least private injury.
SECTION 4. The City of Anaheim does elect to submit
the matter of determination of just compensation of the above
described facilities and property of the Dyke Water Company, a
public utility under the jurisdiction of the Public Utilities
Commission of the State of California, to said Commission.
SECTION 5. The City Attorney of the City of Anaheim
is hereby directed to file a petition of the First Class
with the Public Utilities Commission of the State of California
setting forth its intention to acquire under eminent domain
proceedings, or otherwise, the lands, property and rights
heretofore set forth for the purpose of having said Public
Utilities Commission find and determine the just compensation
to be paid for such property and the City Attorney is forthwith
directed to bring such proceedings as are necessary in accordance
with Sections 1401 through 1421 of the Public Utilities Code of
the State of California and applicable provisions of law to
acquire said above described property in the name of the City
of Anaheim.
SECTION 6. For the purpose of bringing such action,
the City Attorney is hereby empowered to incur, in the name and
on behalf of said City, all obligations and expenses incidental
thereto.

PARCEL 1.
Lot 73 of T ract Noe 1820, in the city of Anaheim, county of
Orange, tate of California, as per map recorded in book 51
pages 31 and 32 of Maps, in the office of the county recorder
of said county.
EXCEPTING therefrom an undivided one -half interest in all oil,
gas and other hydrocarbon substances now and hereafter in and
under said above described land, including the same interest in
all rentals, royalties and bonuses under any and all oil leases
and oil contracts hereafter made regarding development, but with
out the right of entry upon the surface of said land above a depth
of 500 feet from the surface of said land for the purpose of drilling
for, exploring for or extracting any of said substances, provided,
however, said interest hereby reserved shall ipso facto terminate
twenty years from date hereof, unless oil, gas and other hydrocarbon
substances are, or any of them is, being produced from said land
at the end of said twenty years, and that if oil, gas and other
hydrocarbon substances are, a- any of them is, being produced from
said land at the end of said twenty years, then said interest
hereby reserved shall continue as long as such production continues,
then shall ipso facto terminate, it being agreed that the word
end mans a period beginning 6 months before and ending 6 months
after July 1st, 1973; and that the words "as long as such production
continues," shall exclude any period not exceed inc 6 months for
work for restoration of production.
SUBJECT TO
1. The reservation of the use and control of cienegas
and natural streams of water if any, naturally upon,
flowing across, into or by said granted tract and the
right to construct irrigation and drainage ditches
through said tract to irrigate or drain the adjacent
land, as reserved by Stearns Ranchots Company in deed
recorded in book 87 page 56 of Deeds.
2. An easement over said land for pole lines, as granted
to Southern California Edison Company by deed recorded
in book 218 page 84 of Deeds.
3. An easement over the south 5 feet of said land for
public utility purposes as shown on the map of said
tract.
4. An easement over the south 6 feet of said land for
pole lines and incidental purposes, as granted to
Southern California Edison Company, a corporation, by
deed recorded June 29, 1953, in book 2529 page 2L7,
Cf icial Fecords.
5. An easement over the southerly 5 feet of said land
for pole lines, conduits and incidental purposes, as
granted to the Pacific Telephone and Telegraph Company,
a corporation, by deed recorded July 30, 1953, in
book 2548 page 62, Official Records. Said deed provides
that no building or structure shall be erected on said
easement.
6. An easement over the westerly 6 feet of the southerly
60 feet of said land for pole and incidental purposes,
as granted to Southern California Edison Company, a
corporation, by deed recorded November 2, 1953, in
book 2605 page 632, Official Records.

7. An unrecorded "Agreement to Supply Irrigation" dated
May 26, 19539 by9 between and among Genevieve C. Fernald,
referred to in said agreement as "Seller," The Volk- McLain
Co., a partnership, and Vomac Homes, Inc., a corporation,
referred to in said agreement as the "Purchasers," and
Dyke Water Company, a corporation, referred to in said
agreement as the "Water Company," the terms and provisions
of which agreement are as follows:
"WHEREAS the Seller is selling and the Purchasers are
buying that certain real property located and situated in
the County of Orange, State of California, and more parti-
cularly described as follows:
The Southwest Quarter of the Southwest Quarter of
Section 11 Township 4 South, Range 11 West, S.B.B. M.
SUBJECT however, to certain taxes, exceptions of oil,
gas and other hydrocarbon substances and covenants, conditions,
restrictions, reservations and rights of way of record;
"AND WHEREAS the Seller has been supplying from a water
well on said property, irrigation water to the owners of
approximately sixteen acres of land lying northerly of the
hereinbefore described property and collecting an annual fee

"WHEREAS the Purchasers intend to subdivide said tract
of land, erect residences thereon and sell the same, and in
connection therewith have arranged with the Water Company to
supply water to the prospective purchasers thereof;
"NOW, THEREFORE, IT IS HEREBY MUTUALLY UNDERSTOOD AND
AGREED BY, BETWEEN AND 4MONG THE RESPECTIVE PARTIES HERETO
AS FOLLOWS:
"1. That providing the said sale is consummated,
the purchasers shall pay to the Water Company immediately
after the close of the escrow therefor, the sum of $2,000.0
and Sellers agree to pay an additional $500.00 at the same
time.
That the Water Company shall drill an additional
water well and use such well, including the one now in use
thereon, to supply such irrigation water and water for the
use of future lot owners in said subdivision No. 1820.
Said well or wells, together with the real property upon
Which they are situated to be the sole and exclusive prop-
erty of the Water Company at all times.
"30 That the Water Company hereby assumes and agrees
to perform and discharge whatever obligation and duty the
Seller may have to supply such irrigation water and does
hereby agree to indemnify and hold Seller and Purchasers
harmless from any and all claims whatsoever in connection
with supplying irrigation water only on said approximately
16 acres on the part of the owners thereof."

which provides among other things, that the water from
pumping plant and the interest of each of the parties thereto

irrigation or drainage ditches through said tract to
irrigate or drain the adjacent land, as reserved by th

also the intersection of the center line of Orange Avenue and
Western Avenue; thence South 00 16' 25" East 1349.18 feet to

EXCEPT all minerals, oil, gas and other hydrocarbon substances
as granted in deed from Mitsuo Kawaguchi, et ux., to Ralph W.
Maas, dated May 23, 1957 in and under or that may be produced
from a depth below 500 feet from the surface of the hereinabove
described property, as granted to Ralph W. Maas, in deed recorded
June 21, 1957 in book 3950 page 297, Official Records, which
deed provides as follows:
"And provided that said grant shall not entitle Ralph W. Maas,
his successors or assigns to any right of entry ipon the surface
of the hereinabove described property for the purpose of
mining, drilling, exploring or extracting such oil, gas and
other hydrocarbon substances or other use or rights in or to
any portion of the surface of said land to a depth of 500
feet below the surface thereof, provided, however, Ralph W.
Maas, his successors or assigns shall have the right to drill
into, locate wells in and produce oil, gas and other hydro-
carbon substances from any portion of said premises which be
at a depth below 500 feet from the surface thereof and not
less than 100 feet from the exterior boundaries of the here-
inabove described property."

within a 10 foot strip of land, the center line of which
is more particularly described as follows
Beginning at a point in the west side of Nutwood Avenue

in book 3114 page 251, Official Records.
SUBJECT TO:
1. The use and control of cienegas and natural streams
of water, if any, naturally upon, flowing across, into or
by said described tract and the right of way for and to
construct irrigation or drainage ditches through said
tract to irrigate, drain the adjacent land, as reserved
in the deed from The Stearns Company, recorded March 11, 1893
in book 81 page 1 of Deeds. The interest of The Stearns
Ranchos Company has passed to the County of Orange by
