A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ANAHEIM GRANTI~G VARIANCE
NO. 5.51.
WHEREAS, the Oity Planning Commission of the City of
Anaheim did reoeive a petition from the owner of oertain real
property situated in the City of Anah~im, Oounty of Orange,
state of California, described as follows:
The property located at the Southwest
corner of North Palm street and West
La Palma Avenue, extending 200 feet
along North Palm Street and 200 teet
al.ong West La Palma 4venue trom the
centerline of both of these streets.
AND WHEREAS. the City Planning Commission did hold
a pUblio hearing at the City Hall in the City of Anaheim on
May 21, 1956, notices of which said p~blic hearing were duly
given as required by law and the provisions of Seotion 9200.17
of the Anaheim Munioipal Code; and
WHEREAS, said City Planning Commission, after due in-
speotion, investigation and studies made by itself and in its
behalf. and after due consideration of all evidenoe and reports
offered at said hearing, did adopt Resolution No. 192 -- Series
1955-56. denying Variance No. 5.51 requesting permission to
ereot a service station on the above ~soribed property, for
the reasons set forth in said resolutlon:;and
WHEREAS, thereafter, within twenty (20) days from the
date of the adoption of said resolution, a written appeal was
filed with the City Counoil of the City of Anaheim requesting
a review of the aotion taken by said Planning Commission, and
said appeal was set for public hearing on the 12th day ot June,
1956 at 7:00 o'clock P.M. at the Oity Hall, in the City of
Anaheim, and notioe of suoh public hearing was duly given as
required by law and the provisions of Section 9200.17 of the
Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said pUblic
hearing, the City Council did duly hold and oonduct such public
hearing and did give all persons interested therein an opportun-
ity to be heard, and did reoeive evidenoe and reports, and did
withhold its decision until June 26th; and
WHEREAS, after due investigation and studiea made by
itself and in its behalf, and after due oonsideration of all the
evidence and reports offered at said hearing, the City Council
does find that :

1. There are exoeptional or extraordinary circum-
stanoes or conditions applioable to the property
involved or to the intended use of the property
that do not apply generally to the property or
class of use in the same vioinity and zone.
2. That such variance is necessary for the preserva-
tion and enjoyment of a substantial. property right
possessed by other property in the same vicinity
and zone and denied to the property in question.

3. That the granting of such variance will
not be materially detrimental to the public
welfare or injurious to the prpperty or
improvements in suoh vioinity and zone in
which the property is located.\
4. That the granting of such variance" will not
adversely affect the comprehensive general
zoning plan.
NOW, THEREFORE I BE IT RESOLVED by the Oi ty Council of
the City of Anaheim that a oonditional zoning variance be, and
the same is hereby, granted to DR. E. ~. KERSTEN, 200 North
Palm Street, Anaheim, California, to ereot a servioe station on
the property hereinabove described, upon the following oonditions:
1. That the owner or owners of subje~t property
dedioate a strip 0 f land 20 feet in depth
along La Palma Avenue for future street widen-
ing purposes, and improve the same.
2. That all engineering requirements of the City of
Anahe~m be oomplied with as required by the City
Engineer.
The City Counoil hereby reserves the right to revoke
suoh variance permit for good oause or failure of said owners
or their heirs, sucoessors or assigns, to oomply with the
.Anaheim Municipal Code and regulations, and the conditions herein.
Said varianoe is granted for the term prescribed by the Anahe1m
Municipal Code un1es. otherwise speoified herein.
THE FOREGOING RESOLUTION is signed and approved by me
this 26th day of June, 1956.
