RESOLUTION NO. 3335
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM FINDING AND DETERMINING THAT A
CHANGE OF ZONE IS NECESSARY IN CERTAIN AREAS
OF THE CITY AND THAT ARTICLE IX, CHAPTER 2,01
THE ANAHEIM MUNICIPAL CODE SHOULD BE .AMENDED
TO ACCOMPLISH SAID CHANGE OF ZONE.
WHEREAS, the City Planning Commission of the Oity of Anaheim
has heretofore duly passed and adopted a resolution declaring its
intention to change the boundaries of the zone or zones hereinafter
mentioned and described and did fix a time and place for the holding
of a public hearing thereon in the manner and as presoribed in
Article IX, Chapter 2 of the Anaheim Municipal Code, and did dUly
hold and conduct two public hearings to consider suoh proposed ohange
of zone or zones and did reoeive evidence and reports from persons '
interested therein; and
WHEREAS, within a period of forty (40) days following the
final hearing thereon, the Planning Commission did duly announce
by formal resolution its findings of facts and,declare its opinions
and reasons for recommending an amendment to said Article IX,
Chapter 2 of the Anaheim Municipal Code to effect the proposed ohanges
of the boundaries of the zone hereinafter mentioned and described; and
WHEREAS, upon receipt of the report and recommendation of the
City Planning Commission, the City Council did thereupon fix the
19th day of June, 195~, as the ti~e and the Council
Chambers in the City Hall of the City of Anaheim as the place for
a public hearing upon said proposed change of zone and did give
notice thereof in the manner and as prOVided in said Article IX,
Chapter 2 of the Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said public hearing,
the City Council did duly hold and conduct such public hearing and
did give all persons interested therein an opuortunity to be heard
and did receive evidence and reports and did thereupon consider the
recommendations of the City Planning Commission; and
WHEREAS, the City Council does find and determine that the
property and area proposed to be changed from the zone in whioh it
is now situated to a different zone as hereinafter set forth, is more
suitable for the zone or zones to which it is proposed to change
said property and area and that the inclusion of said property and
area in such new zone or zones will increase the value of said
property and area and will not depreciate the values of property in
adjoining zones.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim that all of the property and area situated in the
Oity of Anaheim, County of Orange, State of California, desoribed
as follows, to wit:

That portion of the Wi of the SEt of the SWi of Section
12, T4S, R1IW, S.B.E.& M. consisting of )0).59 feet
frontage on Lincoln Avenue and 301.1 feet frontage on
Bel-Air Road. Said property is located at the Southwest
corner of Tract No. 2780,
be changed from R-A, RESIDENTIAL-AGRICULTURAL ZONE to the following
zones_ upon the conditions hereinafter set forth:
(1) That the West 200 feet of subject property along

Lincoln Avenue be changed to 0-3, HEAVY-OO}fi{EROIAL
ZONE;
(2) That the balance of said property to the East, con-
sisting of approximately 100 feet, be changed to
0-1, NEIGHBORHOOD-COMMERCIAL ZONEt
upon the following conditions:
(1) That all engineering requirements of the City of
Anaheim be complied with as required by the City
Engineer.
(2) That the following restrictions shall be plaoed
of reoord and shall apply to that portion of
subject property reclassified C-l NEIGHBORHOOD-
COMMERCIAL ZONE:
a. All plans and speoifications for buildings to
be ereoted on the property shall be subject to
approval of an Architectural Committee consisting
of the following:
One representative of the owners, their heirs
or assigns.
One representative of the City appointed by the
City Counoil.
A neutral party to be selected by the owner and
the City of Anaheim,
This committee shall review the plans and speci-
fications for structural requirements, architec-
tural design, building locations, parking faci-
lities, and other matters included within these
deed restriotions. One set of plans shall be
signed by each of the Arohitectural Committee
and filed with the Building Inspector of the City
of Anaheim.
b. All buildings shall be masonry or similar fire
resistant materials.
c. Architectural design must be suoh that the build-
ings will retain a definite character in keeping

d. No building shall be used for residential purposes
unless rezoned.

e. A minimum of this property, exolusive of streets,
shall be maintained for oustomer and service park-
ing as required by the Anaheim Munioipal Code.
f. No wall or fenoe shall enolose any portion of the
oustomer parking area to the exclusion of adjaoent
parking areas.
g. Nothing herein contained shall prevent said property
or the buildings ereoted or maintained thereon, from
being used for a purpose whioh shall oomply with any
future zoning which may be plaoed in effect upon said
property by the City of Anaheim, subject, however, to

the provisions of this Declaration of Restric-
tions, and any other provisions which may be
applicable thereto and whioh are not in conflict
with such future zoning.
h. These restrictions shall expire twenty-five (25)
years from the date of signing.
BE IT FURTHER RESOLVED that the City Attorney be, and he is
hereby authorized and directed to prepare and submit to the City
Council an amendment to Article IX, Chapter 2 of the Anaheim Muni-
cipal Code to amend said Anaheim Municipal Code to aocomplish the
object herein found and determined to be necessary and proper.
THE FOREGOING RESOLUTION is signed and approved by me this
19th day of June, 1956.
