RESOLUTION NO. 11Hl
A RESOLUTION OF THE CITY COUNCil OF THE
CITY OF ANAHEIJVJ AUTHORIZING THE SALE OF
A CERTAIN PARCEL OF REAL PROPERTY, AND
GRANTING AN OPl'ION TO PURCHASE CERTAIN
REAL PROPERTY TO DONALD R. BATES: AND
AUTHORIZING THE EXECUTION OF .ALL DOCU-
HENTS NECESSARY FOR SAID TRANSACTIONS.
WHEREAS, the City of Anaheim is the owner of the following de-
scribed real property, to wit:
PARCEL NO.1:
The Easterly 120 feet of the Westerly 250 feet of the
Southerly 346 feet of that parcel of land located in
the City of Anaheim, County of Orange, State of
California, and being a portion of the SEt of Section
3, Township 4 South, Range 10 West, S.B.B. & M. de-
scribed as follows:
Beginning at the Northeast corner of the Schaffer
Oswald Subdivision as shown on a map thereof in Book
7, Page 41 of Miscellaneous Maps of Orange County,
California; thence Westerly along the north line of
said subdivision 785.10 feet to its intersection with
the East line of North 011 ve Street, 40 feet wide;
thence Northerly along said east llne of North 011 ve
Street 667.15 feet to t he south line of the land con-
veyed to Cal-Juices, Inc. by Deed recorded January 26,
1938 and filed in Book 922, page 262 of Official Records
of said Orange County; thence East along said south
line 742.05 feet more or less to the West line of the
right of way of the main line of the Los Angeles and
Salt Lake Railroad Company (now known as the Atchison,
Topeka, and Santa Fe Railroad) in said Section 3;
thence Southerly 251.91 feet along said right of wa;}'"
line which forms a curve, concave easterly with a
radius of 5764.65 feet to its intersection with the
east line of the W! of the SEt of said Section 3;,
thence Southerly along said east line 419.10 feet
to the point of beginning.
PARCEL NO. 2::
The easterly 50 feet of the Westerly .300 feet of the
Southerly 346 feet of that parcel of land located in
the City of J.naheim, County of Orange, State of
California, and being a portion of the SEt of Section
3, Township 4 South, Range 10 West, S.B.B. & M.,
described as follows:

Section 3; thence Southerly 251.91 feet along said
right of way line which forms a curve, concave
easterly with a radius of 5764.65 feet to its
interseotion with the east line of the wt of the
SEt of said Section 3; thenoe Southerly along said
east line 419.10 feet to the point of beginning.
AND WHEREAS, said property is not presently needed for any
immediate public use nor munioipal purposes; and
WHEREAS, Donald R. Bates has offered to purchase Parcel No.1
hereinabove described for the sum 01' $10,320.00 cash, lawful lllOney 01' the
United States, to be deposited in escrow at Bank of .America National Trust
and Savings Association, Fullerton, California, and paid to the City at
the close of escrow, and has requested that he be granted an option, for
a term of one year, to purohase Parcel No.2 hereinabove described for
the sum of $5,160.00 cash, lawful money of the United States; and
WHEREAS, the City Council 1'inds that it is for the benefit and
best interest of the City of Anaheim to accept said offer and sell and
convey Parcel No.1 hereinabove described to Donald R. Bates, upon the
terms and conditions hereinafter specified, and to grant said option" 1'or
a term 01' one year, to said Donald R. Bates to purchase Parcel No. 2
hereinabove described for the sum of $5,160.00.
N<M, THEREFORE, BE IT RESOLVED by the City Council of the City
of Anaheim that the offer of Donald R. Bates to purchase the following
desoribed real property situated in the City of Anaheim, County of Orange,
State of California:

thence Southerly along said east line 419.10 feetto the point of beginning~
for the sum of $10,320.00 cash, lawful money of the United States, be
accepted upon the following terms and conditions:

1. That $10,320.00 cash, laliful money of the United States,
be placed in escrow with Bank of America National Trust
and Savings Association, Fullerton, California, to be
paid to the City at the cl. ose of escrow, said escrow to
be complied with on or before the 1st day of July, 1956,
or as soon thereafter as possible, unless a written de-
mand for the return of the money or instruments by a
party to said escrow is delivered to said escrow holder
subsequent to such date and pr'ior to the reoording of
any instruments provided for in said escrow.
2. That said property shall be sold subject to covenants,
conditions, restrictions, reservations, rights, rights-
of-way and easements of record.
.AND BE IT FURTHER RESOLVED that Donald R. Bates be, and he is
hereby, granted an option for a term of one year to purchase the following
described real property situated in the City of Anaheim, County of Orange,
State of California:

BE IT FURTHER RESOLVED that the Mayor and the City Clerk be,
and they are hereby, authorized to execute a good and sufficient deed
conveying to said Donald R. Bates the real property hereinabove desoribed
on which said offer to purchase was tendered and accepted by the City,
and to deliver said deed into escrow at Bank of America National Trust and
Savings Association, Fullerton, California, to be delivered to Donald R.
Bates upon completion of said escrow and the payment of the full purchase
price as hereinabove provided; and that the Mayor and the City Clerk be,
and they are hereby, authorized and directed to make, execute and deliver
an option to said Donald R. Bates to purchase the real property hereinabove
described, on which an option is herein granted, upon the terms and con-
ditions herein set forth.

BE IT FURTHER RESOLVED that the City Clerk of the City of .Anaheim
be, and she is hereby, authorized and directed to certify a copy of this
Resolution and cause the same to be attached to the Deed to be executed by
the City of Anaheim and delivered to said escrow agent as herein provided.
THE FOREGOING RESOLUTION is approved and signed by me this 12th
